LIABILITY WAIVER AND RELEASE
SAFETY POLICY: -The member understands and agrees that strict observation of the rules and regulations relative to training, including the use of fencing weapons, is required and that the use of facilities and the Member’s presence at the school are at the sole risk of the member. -The fencing floor is restricted to fencers only. Non -participants must stay in the observation area. -It is understood and agreed that rough play or dangerous actions are prohibited whether intentional or not. -Fencing weapons must be carried with points down or in a fencing bag. Walking or standing close to the fencers when blades are raised or in motion is prohibited. -Fencing mask, glove, fencing jacket , knickers , plastron , breast plate for females, and athletic pants (sweatpants, warm-ups, or leggings), and clean and dry athletic shoes with non-marking soles must be worn when fencing . - No jeans, casual pants, or shorts are allowed. -Minors may not hold swords unless they are wearing masks. - Warm up stretches are required before a lesson or practice. - No running is permitted without the coach’s permission and never with a sword.- No type of movement with the sword is allowed if any person within 6 feet of the action is unmasked, except in a private lesson under the strict direction of a VAFC coach.- When fencing, especially in a group, a student may not under any circumstances, remove a mask while another fencer’s sword point is raised or when other fencers are making any type of movement with their swords. -Walking or standing close to a fencer in a bout or practice when sword points are raised or swords are in motion is prohibited. - Unsportsmanlike behavior, horseplay (falling down), or improper rough or strong movements, whether intentional or not, are prohibited and will result in expulsion.- Each fencer has a duty to report any unsafe area or unsafe activity to the staff. Any illness, injury or the taking of medication must be reported to the instructor before a lesson or practice. - No drugs and no alcohol are allowed. - No participation in any fencing activity within the time limits for medicine to leave the participant’s system, and in no case within 6 hours of using alcohol or any other prescription or nonprescription drug that comes with a warning label that actions may be slowed or impaired. Any person not abiding by VAFC rules may be subject to expulsion. WAIVER OF LIABILITY: I represent that I am in good physical condition and have no physical or mental health problems that will preclude or inhibit my participation in fencing activities. And In connection with training and instruction sessions, there will be physical contact between instructors and Members and between and among the Members themselves and that such contact may result in personal injury despite the best intentions and following adequate precautions. I hereby agree to abide by the rules of VAFC and the USA Fencing Association and assume full responsibility for all actions during and in connection with the training and understand it is my responsibility to obtain my own medical insurance coverage. I understand and appreciate that participation in a sport carries a risk to me of serious injury, including permanent paralysis or death. I voluntarily and knowingly recognize, accept and assume the risk resulting from injury, accidents, illness, death, or other mishap that may occur while participating in VAFC programs. And The Member agrees that the school and its instructors, agents, employees, operators and authorized representatives , shall not be responsible for and are hereby released from any liability , claim , loss, including loss of property , damage , personal injury , or expense incurred by a Member or anyone claiming through a Member , or related to any activity connected with the School including , but not limited to, any caused by the negligence or gross negligence of the school or its instructors , Members, agents , employees , operators , or authorized representatives. I hereby release Virginia Apex Fencing Club (VAFC), Kihyeon Kim, their instructors, coaches, staff, and owners from any liability. I acknowledge I have read (or to have had read to me) the terms of this agreement in its entirety. If I am a Responsible Party/Buyer, as designated above, I am the parent or legal guardian or adult responsible for the Member(s) listed, with full authority to act on behalf of such Member(s). I confirm that this form is complete and accurate. I understand and acknowledge VAFC policies as outlined in the Liability Waiver and Release.
