Lead Referral Agreement
LEAD REFERRAL AGREEMENT This Lead Referral Agreement (“Agreement”) is made effective as of the date of signature below (the “Effective Date”), by and between All County Advance Property Management, a Florida-licensed real estate brokerage (“Company”), and Signed Agent (“Agent”), a duly licensed and insured real estate professional in the State of Florida. ⸻ 1. Purpose The purpose of this Agreement is to establish a mutually beneficial relationship in which the Agent refers prospective clients (“Referred Clients”) to the Company for professional property management services. In return, the Company agrees to compensate the Agent as outlined herein and to uphold specific non-compete terms to protect the Agent’s client relationships and future sales opportunities. ⸻ 2. Referral Submission The Agent may submit Referred Clients to the Company using the designated referral form, available at: 👉 https://form.jotform.com/250914306494155 Each submitted referral must be unique to the Agent and not previously introduced to the Company. ⸻ 3. Referral Compensation For each Referred Client placed under a full-service property management agreement by the Company, the Agent shall receive a $1,000 referral fee. • Payment shall be made after a tenant is successfully placed in the referred property and the lease has commenced. • The Company may, at its sole discretion, offer enhanced compensation for multi-unit owners or portfolio referrals. • This Agreement does not entitle the Agent to ongoing commissions or fees unless otherwise agreed in writing. ⸻ 4. Non-Compete and Client Protection To protect the Agent’s business interests and maintain ethical standards, the Company agrees to the following: • The Company will not solicit, pursue, or offer real estate sales or listing services to any Referred Client, so long as a valid, signed agreement exists between the Agent and the Client. • The Company will not actively market, discuss, or otherwise guide any Referred Client who is under an active contract with any real estate agent until or unless that contract is determined to be invalid, nullified, expired, or otherwise lawfully terminated. • Any inquiries by the Referred Client regarding the sale of the referred property shall be promptly referred back to the referring Agent. • All Referred Clients will be clearly designated in the Company’s client records as being associated with the Agent to prevent internal conflicts or reassignment. • The Company reserves the right to represent the buyer’s party in any transaction where: • No valid buyer-agent agreement exists with the Referred Client, and • The Company is retained by the listing agent or another third party to provide buyer representation. ⸻ 5. Term and Termination A distinct Lead Referral Agreement must be executed for each individual Referred Client. Each such agreement shall remain in effect unless: • Terminated by either party upon thirty (30) days’ written notice, or • The agency relationship or agreement between the Agent and the Referred Client is otherwise terminated, expires, or is rendered invalid, or • The Agent ceases to maintain an active Florida real estate license, adequate insurance coverage, or affiliation with a duly licensed and insured real estate brokerage. The Company shall honor all non-compete obligations for Referred Clients under active agreement until formally released. ⸻ 6. Independent Contractor Status Nothing contained in this Agreement shall be construed to create a partnership, joint venture, agency, or employment relationship between the parties. Each party is an independent contractor and shall be solely responsible for its own obligations and liabilities. ⸻ 7. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the courts of competent jurisdiction located in the State of Florida. ⸻
