1. Release and Waiver. I do hereby for and on behalf of myself, my Child and any and all of my Child’s siblings, and my heirs and legal representatives release, discharge, and forever hold harmless INTEMPO and Project Music of and from any and all claims and demands of every kind, nature and character for any loss, injury or damage which I, my Child or any of my Child’s siblings may suffer or sustain, by negligence or otherwise, to the fullest extent permitted by law, arising out of or in connection with any aspect of the Activity/Event.
I UNDERSTAND THAT THIS RELEASE DISCHARGES INTEMPO AND PROJECT MUSIC FROM ANY LIABILITY OR CLAIM THAT I, MY CHILD OR ANY OF MY CHILD’S SIBLINGS MAY HAVE AGAINST INTEMPO WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE THAT MAY RESULT FROM MY, MY CHILD’S OR ANY OF MY CHILD’S SIBLINGS’ PARTICIPATION IN THE ACTIVITY/EVENT, WHETHER CAUSED BY THE NEGLIGENCE OF INTEMPO OR OTHERWISE. I ALSO UNDERSTAND THAT INTEMPO AND PROJECT MUSIC DO NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE IN THE EVENT OF INJURY OR ILLNESS.
This Release and Waiver expressly includes any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my, my Child’s or any of my Child’s siblings’ participation in the Activity/Event.
2. Assumption of Risk. In signing this Agreement I hereby expressly and specifically assume the risk of injury or harm to me, my Child or any of my Child’s siblings arising out of or in connection with the Activity/Event, and release INTEMPO and Project Music from all liability for injury, illness, death, or property damage resulting from the Activity/Event.
3. Insurance. I understand that, except as otherwise agreed to by INTEMPO and Project Music in writing, INTEMPO and Project Music do not carry or maintain health, medical, or disability insurance that covers me, my Child or any of my Child’s siblings. I further understand that INTEMPO expects and encourages me, my Child and each of my Child’s siblings to have our own medical or health insurance coverage.
4. Photographic Release: I hereby grant and convey to INTEMPO and Project Music all right, title, and interest in any and all photographic images and video or audio recordings made of me or my Child during the Activity/Event, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings as well as use of such photographs and recordings in print and electronic media.
I acknowledge and agree that this Release and Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Connecticut, and that this Release and Waiver shall be governed by and interpreted in accordance with the laws of the State of Connecticut. Further, I understand and agree that, if any portion of this Agreement is deemed unlawful or unenforceable by a court of competent jurisdiction, that determination shall not affect the remaining provisions, and those remaining provisions shall continue in full force and effect.
By signing this Agreement, I acknowledge that I have read and understand the Agreement and that I agree to the contents stated herein.
