  • RELEASE AND WAIVER OF LIABILITY AND INDEMNITY

    RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT (hereinafter referred to as the “Release Agreement”) BY SIGNING THIS DOCUMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT PLEASE READ CAREFULLY!

    AGREEMENT:

    TO: Traction eRag (2453675 Ontario Inc.), and its directors, officers employees, instructors, guides, agents, representatives, media people, participants, independent contractors, subcontractors, suppliers, sponsors, successors, landowners covered by LUA or MOU and assigns (all of whom are hereinafter referred as “the Releasees”).

    DEFINITION: In this Release Agreement: the term "motorcycling" shall include all on or off road activities, services and use of facilities either provided by or arranged by the Releasees, including, but not limited to: orientation and instruction sessions; recreational activities undertaken during the motorcycling event, tour, travel by on and or off road motorcycle; all travel either within or beyond the designated boundaries, including in the backcountry and on logging roads and trails.

    ASSUMPTION OF RISKS: I am aware that Off Road Motorcycling involves many inherent risks, dangers and hazards, including but not limited to: exposed rock, earth, ice or other natural objects; trees, tree wells, tree stumps, forest deadfall; holes and depressions on or beneath the trail or surface; variable and difficult weather conditions; changes or variations in the terrain which may create blind spots or areas of reduced visibility; streams and creeks; cliffs; crevasses; travel on back-country roads; snowmobile trails, road-banks and cut-banks; impact or collision with other motorcycles and vehicles, becoming lost or separated from the guides or other participants; mechanical failure of motorcycles and related equipment; extreme and rapidly changing weather conditions; encounter with wildlife including bears; avalanches; the failure to operate a motorcycle safely or within one's own ability; negligence of other motorcyclists and other persons; AND NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE BY THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS REFERRED TO ABOVE. Communication in the alpine and or remote terrain may be difficult, and in the event of an accident, rescue, medical treatment and evacuation may not be available or may be delayed. Alpine weather conditions may be extreme and can change rapidly and without warning.

    I hereby confirm that I carry at least the minimum insurance on my vehicle to be used in this event and certify that I am in compliance with all acts, statutes and regulations of the province, state or territory that my motorcycle is registered in.

    I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH ON AND OR OFF ROAD MOTORCYCLING AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

    RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:

    In consideration of the RELEASEES agreeing to my participation in On and or Off Road Motorcycling and permitting my use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

    TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in On an or OFF ROAD MOTORCYCLING, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN On and or OFF ROAD MOTORCYCLING REFERRED TO ABOVE; TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in On and or Off Road Motorcycling; This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity; This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the province where the On and or Off Road Motorcycling takes place and no other jurisdiction; and Any litigation involving the parties to this Release Agreement shall be brought solely within the province where the On and or Off Road Motorcycling takes place and shall be within the exclusive jurisdiction of the Courts of that province.

    In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in On and or Off Road Motorcycling, other than what is set forth in this Release Agreement.

  • WORKPLACE SAFETY POLICIES

    This document outlines safety policies for a workplace involving vehicle operation, camp behavior, trail activities, and general safety practices. These policies aim to ensure the health & safety of all employees, guests and visitors.

    1. VEHICLE OPERATIONAL SAFETY

    General Guidelines

    • All vehicle operators must hold a valid driver’s license appropriate for the vehicle type.
    • Conduct pre-operation inspections to ensure vehicles are in safe working condition (e.g., brakes, tires, lights, and fuel levels).
    • Follow all traffic laws and workplace speed limits.
    • Use seat belts at all times when operating or riding in a vehicle.
    • No use of mobile devices or other distractions while driving.

    Specific Protocols

    • Load Security: Ensure all loads are properly secured to prevent shifting or falling during transport.
    • Passenger Limits: Do not exceed the vehicle’s rated passenger capacity.
    • Terrain Awareness: Operate vehicles only on designated roads or paths unless otherwise authorized.
    • Adverse Conditions: Exercise extra caution in adverse weather (e.g., rain, snow, or fog) and reduce speed accordingly. Be especially aware of possible oncoming traffic at all times.
    • Visibility: Run daytime running lights at all times.
    • Parking: Park vehicles in designated areas, ensuring they do not block access routes or emergency exits (ie. Lodge overhang)

    Emergency Procedures

    In case of a vehicle breakdown, move the vehicle to a safe location, activate hazard lights, and use warning triangles or cones. Report accidents or near-misses immediately to the supervisor and complete an incident report.

    2. SAFE BEHAVIOR IN CAMP

    General Conduct

    Maintain a tidy and hazard-free living and working environment.
    Store food securely to prevent wildlife attraction.
    Follow fire safety protocols, including proper use of fire pits and extinguishing all flames before leaving the area.
    At no time shall explosions, the burning of compressed gas cylinders, or misuse of flammable liquids be permitted by staff on or off site.

    Specific Protocols

    • Alcohol and Drugs: The use of alcohol or non-prescribed drugs is prohibited in camp to ensure clear judgment and safety.
    • Personal Protective Equipment (PPE): Wear appropriate PPE (e.g., helmets) when operating machinery or vehicles.
    • Waste Management: Dispose of waste in designated bins and follow recycling protocols to maintain hygiene and prevent pest or animal issues.
    • Noise Control: Respect quiet hours (e.g., 9 PM to 6 AM) to ensure rest for all camp occupants.
    • Emergency Evacuation: Familiarize yourself with the camp’s evacuation plan and assembly points.
    • Firearms: No firearms are to be openly carried or discharged without the express permission and direct supervision of Dallas Shannon.

    Health and Hygiene

    Wash hands regularly and maintain personal hygiene to prevent illness.
    Report any signs or symptoms of illness to the camp supervisor immediately.
    Use provided sanitation facilities to maintain a clean camp environment.

    3. SAFETY ON THE TRAIL

    Preparation

    • Carry a first aid kit, communication device (e.g., radio or satellite phone), and sufficient water and food for the duration of the trail activity.
    • Inform a supervisor or colleague of your planned route and expected return time.
    • Wear appropriate clothing and footwear for the terrain and weather conditions.

    Trail Conduct

    • Stay on designated trails to avoid environmental damage and reduce the risk of getting lost.
    • Maintain a safe distance from wildlife and do not feed animals.
    • Use proper lifting techniques when handling equipment or materials to avoid injury.
    • Be aware of surroundings, including potential hazards like uneven terrain, loose rocks, or falling branches.
    • In case of injury, administer first aid and contact emergency services or the camp supervisor immediately.
    • If lost, stay in place, signal for help using a whistle or reflective item, and conserve resources until assistance arrives.
    • Carry a map, compass, or GPS device, and know how to use them.

    4. GENERAL SAFETY PRACTICES

    Workplace Conduct

    • Follow all posted safety signs and instructions.
      Report hazards, unsafe conditions, or near-misses to a supervisor immediately.
    • Attend mandatory safety training sessions and stay updated on workplace safety policies.

    Personal Protective Equipment (PPE)

    • Wear required PPE (e.g., gloves, safety glasses, steel-toed boots) as specified for your role or task.
    • Inspect PPE before use and report any damage or wear to the supervisor.
    • Closed toed boots (preferably safety boots) are required at all times in and out front of the shop. No exceptions.

    Emergency Preparedness

    • Know the location of fire extinguishers, first aid kits, and emergency exits.
      Participate in regular emergency drills to ensure familiarity with procedures.
    • Report all incidents, no matter how minor, to the supervisor for documentation and follow-up.


    Mental and Physical Well-Being

    • Take regular breaks to prevent fatigue, especially during physically demanding tasks.
    • Stay hydrated and eat nutritious meals to maintain energy and focus.
    • Report any mental health concerns or stressors to a supervisor or designated support personnel.

    5. COMPLIENCE AND ACCOUNTABILITY

    • All employees, contractors, and visitors are required to comply with these safety policies.
    • Non-compliance may result in disciplinary action, including warnings, suspension, or termination, depending on the severity of the violation.
    • Supervisors are responsible for enforcing these policies and conducting regular safety audits.

  • MEDIA RELEASE AND WAIVER

    I hereby give the Traction eRag, its assigns, licensees and legal representatives the irrevocable right to use my name/photograph/image/audio recording/video recording and likeness ("My Image") in all forms and manner including but not limited to publication on Internet Web Sites, Social Media, broadcasts, and any other publications as release to or by Traction eRag.

    I understand that Traction eRag cannot control unauthorized use of My Image by person not associated with Traction eRag once My Image has been published. I hereby forever waive any right to inspect or approve any publication of My Image by Traction eRag.

    I have carefully reviewed and understand the above provisions and agree to be bound by them. I voluntarily and irrevocably give my consent and agree to this Release and Waiver.

    By signing below, you acknowledge:
    You are 18 years of age.
    You are aware that you may choose to terminate your participation at any time for any reason.

    I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

  • Drugs and Alcohol – Waiver and Expectations

    This document outlines the expectations and policies regarding the use of drugs and alcohol for all employees, contracted staff and intern volunteers of The Traction eRag during your stay.

    1. Purpose

    The purpose of this policy is to ensure a safe, healthy, and productive work environment free from the effects of drug and alcohol abuse.

    2. Scope

    This policy applies to all employees, contracted staff and intern volunteers during your attended camp series.

    3. Policy

    Employees are prohibited from using, possessing, distributing, or being under the influence of drugs or alcohol during work hours, or while representing the company in any capacity.

    Off-duty conduct must not result in an adverse effect on the individual’s job performance or the safety of others.

    4. Responsibilities

    Employees must adhere to this policy strictly, ensuring they remain free from the influence of drugs and alcohol as described above.
    Supervisors are responsible for enforcing this policy and taking appropriate corrective action if violations occur.

    5. Testing

    The Traction Erag reserves the right to conduct drug and alcohol testing where permitted by law, especially in cases of workplace accidents or if there is reasonable suspicion of policy violation.

    6. Violations

    Any violation of this policy may result in disciplinary action up to and including termination of employment. The nature and severity of the violation will be considered in determining appropriate action.

    7. Confidentiality

    All proceedings, results, and actions related to this policy will be kept confidential to the extent possible and shared only with those who have a legitimate need to know.

    8. Acknowledgment

    By signing below, I acknowledge that I have read, understood, and agreed to adhere to the Drugs and Alcohol Waiver and Expectations of The Traction eRag.
