Buffalo Harbor Sailing Club, Inc (BHSC)

Contest Overview
The Buffalo Harbor Sailing Club Inc (BHSC) is hosting a t-shirt design contest for the Chuck Chilcott Summer Regatta 2025. The winning design will be printed on t-shirts sold to raise funds for BHSC programs and may also be used in promotional materials (e.g., website, social media). By submitting a design, the artist agrees to the terms outlined below.

Waiver and Rights Transfer Agreement

1. Ownership Transfer: I understand that if my design is selected as the winner of the BHSC Chuck Chilcott Summer Regatta 2025 T-Shirt Design Contest, I will transfer all rights to my artwork to the Buffalo Harbor Sailing Club (BHSC). This includes exclusive rights to reproduce, distribute, modify, and sell the design for fundraising and promotional purposes, in perpetuity, without further compensation beyond the contest prize.
2. Waiver of Rights: I acknowledge that, if my design is selected, I will not retain any rights to the artwork and cannot use, reproduce, or sell it elsewhere. Non-winning designs remain my property, and BHSC will have no claim to them.
3. Originality of Work: I certify that the design I am submitting is my original work and does not infringe on any third-party rights, including but not limited to copyrights, trademarks, or intellectual property. I understand that BHSC is not responsible for any legal claims arising from the use of my design if it is found to violate such rights.
4. Credit and Modifications: I agree that BHSC may credit me as the artist (e.g., “Design by [My Name]”) on promotional materials but is not obligated to provide royalties or additional compensation beyond the contest prize (a complimentary Regatta dinner ticket, a free BHSC t-shirt with my design, and recognition on BHSC’s website and social media). I also understand that BHSC may make minor adjustments to the winning design (e.g., resizing, color tweaks) for printing purposes, with notification to me.
5. Liability Release: I release BHSC, its officers, members, and affiliates from any liability related to the use of my design, including but not limited to claims of infringement, misrepresentation, or financial loss. I understand that BHSC’s decisions regarding the contest, including the selection of the winner, are final.

By signing below, I confirm that I have read, understood, and agree to the terms of this waiver form. I am at least 18 years old, or I have obtained parental consent to participate (if under 18).
