LIABILITY WAIVER, TALENT RELEASE, AND COVID 19* This field is required.I HAVE READ THE AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I AM AWARE THAT THIS AGREEMENT INCLUDES A RELEASE AND WAIVER OF LIABILITY, AN ASSUMPTION OF RISK AND AN AGREEMENT TO INDEMNIFY THE RELEASEES. RELEASE, ASSUMPTION OF RISK, MEDICAL RELEASE AND INDEMNIFICATION: I (“I”, “me”, “Participant”) HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE SOUL DE SOUL (“SOUL DE SOUL”COMPANY“), its directors, employees, agents, volunteers or any student for ANY and ALL liability suits, or judgements of any and every kind arising from any injury (physically or mentally), any risk that arise from negligence or carelessness, property damage, theft, or death that I may suffer as a result of my participation in the convention and or the showcase. I acknowledge that I am responsible for the cost of any and all medical and health services and I may require as a result of participating in the above named convention. I understand there is an assumption of risk and great physical demand in the participation of this event. I understand and agree that the Company may not have medical personnel available at the location of the workshop. In the event of any medical emergency, I DO AUTHORIZE and CONSENT all dental, medical, or surgical diagnosis or treatment, and hospital care that Soul de Soul's Directors deem necessary for my safety and protection. I hereby agree that this Agreement shall be construed in accordance with the laws of the State of Claifornia. If any term of provision of the Agreement shall be held illegal, unenforceable, or in conflict with any governing, this Agreement's validity, and the remaining portions shall not be affected thereby. SUPERVISION: Attendance at SOUL DE SOUL is permitted only under the understanding that I and my Guardian agree and acknowledge to abide under the premise that I may attend only under the supervision of a chaperone who is at least 21 years of age (“Chaperone”), that such Chaperone is responsible for my supervision at all times. SOUL DE SOUL, the Company, or it’s delegates are NOT responsible in any way or to any extent for supervision of me or for my welfare during my attendance at Events and participation in Activities. TALENT RELEASE: I understand by attending the event I am willingly subjecting my personhood to areas and locations in which filming, production, photography, and videography are being used and therefore consent to SDS using my likeness on social and marketing accounts. I hereby assign and grant SOUL DE SOUL LLC the right and permission to use and publish the photographs/film/videotapes/electronic representations made of me during the registered event date by Soul de Soul and or its affiliates. Additionally I hereby release Soul de Soul LLC from any and all liability from such use and publication. I hereby authorize the reproduction, sale, copyright, exhibit, broadcast, electronic storage and/or distribution of said photographs/film/videotapes/electronic representations and/or sound recordings without limitation at the discretion of Soul de Soul and I specifically waive any right to any compensation I may have for any of the foregoing. COVID-19: Waiver of Liability Relating to Coronavirus/COVID-19 (“COVID-19” as used herein includes any known or unknown pandemic declared by the WHO) The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization (“WHO”). COVID-19 is reported to be extremely contagious. The virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and unknowingly spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. Company has put in place preventative measures to reduce the spread of COVID-19, however, Company cannot prevent you (or your children) from becoming exposed to, contracting, or spreading COVID-19 while attending Company’s Events and/or entering Company’s premises. It is not possible to completely prevent against the presence of the disease. Therefore, if you choose to attend SOUL DE SOUL’S Events and/or enter onto Company’s premises, event spaces, or the lobby you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19. COVID-19 (and all other variants) ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to attend Company’s Events and/or enter Company’s premises. I attest these services are of such value to me (and/or to my children,) that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend Company’s Events and/or premises in person.
