Renter acknowledges and agrees that Renter is solely responsible for all rented or demo equipment (“Equipment”) from the time the Equipment is released to Renter until it is returned to and accepted by Good Breeze Kiteboarding Inc (“Company”). Renter assumes all risk of loss, theft, disappearance, or damage to the Equipment, regardless of cause (including, without limitation, theft, vandalism, weather, water damage, saltwater exposure, misuse, negligence, or acts of third parties). If any Equipment is lost, stolen, not returned, or returned damaged (normal wear and tear excepted), Renter agrees to pay Company, upon demand, the full cost of repair or replacement (at Company’s option), including parts, labor, shipping/handling, and any applicable taxes and fees. Renter authorizes Company to apply any deposit and/or charge the payment method on file for any amounts due under this section.
Release of Liability*

I agree to: In consideration of being permitted to rent, demo, use, transport, or otherwise possess the Equipment and/or participate in any related activity (including, without limitation, kiteboarding, winging, foiling, surfing, eFoiling, lessons, and all water- and wind-sport activities) from Good Breeze Kiteboarding Inc (“Company”), Renter understands and acknowledges that these activities are inherently dangerous and may result in serious injury, permanent disability, paralysis, drowning, or death, as well as property damage. Renter voluntarily and knowingly assumes all risks, known and unknown, foreseeable and unforeseeable, arising out of or relating in any way to (a) the rental/demo/use of the Equipment, (b) participation in any related activity, (c) weather, surf, currents, marine life, water conditions, collisions, equipment failure, and (d) the actions or omissions of Renter and/or others.To the fullest extent permitted by law, Renter, on behalf of Renter and Renter’s heirs, assigns, personal representatives, and next of kin, releases, waives, discharges, and covenants not to sue Company and its owners, officers, directors, employees, contractors, agents, volunteers, affiliates, successors, and assigns (collectively, “Released Parties”) from any and all claims, demands, actions, causes of action, damages, losses, costs, and expenses (including attorneys’ fees) arising out of or related to any injury (including death), property damage, or loss, whether caused by the negligence of the Released Parties or otherwise, occurring during or in any way related to the rental/demo/use of the Equipment and/or participation in any related activity.Renter further agrees to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of Renter or any third party arising out of or related to Renter’s rental/demo/use of the Equipment, possession/transport of the Equipment, or participation in any related activity, including claims arising from Renter’s acts or omissions. Severability: If any portion of this Release is held invalid, the remaining portions shall remain in full force and effect.Acknowledgment: Renter affirms that Renter has read and understands this Release, understands it is a waiver of substantial rights, and signs it voluntarily.
