Surf For Special Needs (S4SN) Ongoing Event Participation Waiver
By signing this waiver, I acknowledge and accept the risks associated with participation in any current or future Surf For Special Needs (S4SN) events held in the State of Hawaii, USA, including but not limited to water activities, environmental interactions, group activities, and food consumption. I take full responsibility for my safety and well-being and waive all claims against Surf For Special Needs (S4SN), its members, staff, volunteers, sponsors, and assignees.
Activities Covered by This Waiver
This waiver applies to participation in, but is not limited to, the following activities:
- Water-based activities, including floating, swimming, paddleboarding, SUPquatch rides, outrigger canoe rides, paddling, and surfing
- CPR training and safety workshops
- Use of equipment provided by S4SN, including flotation devices, paddleboards, and canoes
- Environmental activities, including sand sifting, beach cleanups, and marine life interactions
- Art and music stations, including body painting, crafting, and live music participation
- Workshops and educational sessions, such as ocean conservation lessons
- Food and Beverage Consumption, including any meals, snacks, or drinks provided by S4SN during events
- Exposure to weather-related risks, including sun exposure, wind, currents, and unpredictable conditions
- Group and social interactions, which may involve incidental physical contact with other participants
Safety & Responsibility
- I agree to follow all safety rules and instructions provided by S4SN staff and volunteers. Failure to do so may result in removal from the event.
- In case of an emergency, I authorize S4SN staff or volunteers to seek medical care on my behalf, and I understand that I am responsible for any medical costs.
- I acknowledge that S4SN does not provide personal health or accident insurance, and I am responsible for my own coverage.
Food & Beverage Safety
- I understand that any food or beverages provided by S4SN are consumed at my own risk, and I am responsible for informing event staff of any allergies or dietary restrictions.
- I acknowledge that all provided meals, snacks, and beverages follow food safety guidelines, but I assume responsibility for any allergic reactions or illness that may occur.
- If food or beverages are provided by third-party vendors, I understand that S4SN is not liable for their quality, handling, or safety.
Liability & Legal Release
- I understand that participation in S4SN events carries inherent risks, including water hazards, environmental conditions, and interactions with other participants.
- I assume full responsibility for any injuries, accidents, or damages that may occur, including those resulting from third-party actions or unforeseen circumstances.
- I release and hold harmless Surf For Special Needs (S4SN), its members, staff, volunteers, sponsors, and assignees from any claims, liabilities, losses, or damages, except in cases of gross negligence or intentional harm by S4SN.
- I acknowledge that S4SN is not responsible for the actions of other participants, third-party vendors, or external service providers.
- If signing on behalf of a minor, I confirm that I am their legal guardian and accept full responsibility for their participation.
- This waiver applies to all current and future S4SN events held in Hawaii, USA, unless revoked in writing.
Behavior & Conduct
- I agree to conduct myself in a respectful and safe manner during all event activities. Disruptive or dangerous behavior may result in removal from the event.
Emergency Evacuation & Cancellation
- I acknowledge that events may be postponed, canceled, or altered due to weather conditions, safety concerns, or unforeseen circumstances. S4SN is not liable for any losses or inconveniences resulting from such changes.
Dispute Resolution
- Any legal disputes related to this waiver must first be resolved through mediation or arbitration before pursuing formal legal action.
Photography & Media Consent
- I grant permission for S4SN to photograph or record me during events and use such media for promotional and educational purposes unless I opt out in writing.
Governing Law & Jurisdiction
- This waiver shall be governed by the laws of the State of Hawaii, USA, and any legal disputes arising from participation shall be handled within its jurisdiction.
General Terms
- This waiver remains valid indefinitely for any S4SN event I choose to participate in unless revoked in writing.
If any part of this waiver is deemed invalid, the remainder shall remain in effect.
By signing below, I confirm that I have read, understand, and voluntarily agree to these terms for all future S4SN events in Hawaii.
