I, [Guest’s Full Name], acknowledge and agree to the following terms as a condition of my stay at [Property Name], which includes access to a swimming pool without a surrounding fence:

ASSUMPTION OF RISK

I understand that the swimming pool poses inherent risks, including but not limited to drowning, slipping, and other injuries.

I acknowledge that no lifeguard is on duty and that swimming is at my own risk.

I agree to supervise all members of my party, especially children and individuals who are unable to swim.
 
RELEASE OF LIABILITY

I fully release and discharge Velvet Ditch Villas and its owners, employees, agents, and affiliates from any claims, demands, injuries, losses, damages, or legal actions arising from the use of the pool.

I accept full responsibility for any injury, illness, property damage, or loss of life resulting from my use of the pool, whether caused by negligence or otherwise.
 
INDEMNIFICATION

I agree to indemnify and hold harmless Velvet Ditch Villas against any claims, damages, costs, or expenses (including legal fees) resulting from my use of the pool.

I acknowledge that I am responsible for any injuries or damages caused by myself, my guests, or any unauthorized persons I allow to use the pool.
 
SAFETY RULES & AGREEMENT

I agree to abide by all posted safety rules and exercise caution when using the pool.

I will not consume excessive alcohol or drugs while using the pool.

I will not hold the owner liable if the pool is unavailable due to maintenance, weather, or unforeseen circumstances.

 
ACKNOWLEDGMENT & ACCEPTANCE

I acknowledge that I have read and understood this waiver and that I am signing it voluntarily.

I understand that this waiver applies to myself, my guests, and any minors in my party.
