Participation in Motiv8 Services Car Maintenance Program for Beginners requires completion of this form.

Waiver Form (Terms of Agreement)

• Risk:  I will be engaging in physical activities and by signing this Waiver, I voluntarily assume all such risks and release Motiv8 Services and their related parties from any liability for injuries or losses that may occur. I assume full responsibility for any risks, injuries, or damages, seen or unforeseen, which I might incur as a result of participating in the Program. I voluntarily and expressly waive any and all claims, costs, suits, demands, liabilities, actions, penalties, and expenses against Motiv8 Services and its officers, employees, agents and subcontractors resulting from, or in connection with, any injury, loss or damage that may occur to me or my property, or to any other party as a result of my actions or omissions, during the time I spend on the premises at the training program.

• Safety and Guidelines:  I agree to comply with all rules, instructions, and safety guidelines provided by Motiv8 Services regarding all physical activities. I understand that failure to adhere may result in my removal from the training program without refund. I agree to adhere to all safety instructions and acknowledge failure to do so may result in personal injury, death and the risks referred to in the risk paragraph. I agree to pay due regard for the safety, consideration and confidentiality of other participants in all the activities.
  
  
• Privacy, Acknowledgement and Declaration:  I have agreed to provide my personal information to Motiv8 Services for the purpose of participating in the training program. I declare that I am 18 years of age or older, otherwise my parent/carer/guardian will sign on my behalf. I understand and agree that no part of the Motiv8 Services content, course material, procedures, processes or any proprietary intellectual property, including information that is on the Motiv8 Services website, social media, information distributed during the training program and information gathering forms can be copied, reproduced, distributed, or utilize such content for personal and/or financial gain or to benefit and/or give to third parties. Participants further agree not to engage in any activity that may infringe upon the intellectual property rights of Motiv8 Services, including but not limited to misappropriating ideas or concepts presented during the training program for the purpose of establishing a similar business or enterprise. I have carefully read and accept the terms and conditions.
  
  
• Declaration, Indemnity, Privacy and Signature:  I declare that I am 18 years of age or older, otherwise my parent/carer/guardian will sign on my behalf. I agree that I am licenced to drive alone to and from the premises for the purpose of attending the Program. In the event, I am not a fully qualified licenced holder, I agree that I will have a fully qualified, Unrestricted and Unconditional licence holder to always attend the training program with me, including driving to and from training program.
• I, the parent/carer/guardian, or adult accompanying a person who has a restricted or conditional licence and I am signing this document on behalf of, or as an agent of, the child or the individual, I agree to indemnify the Business (Motiv8 Services) against any liability, damage, or loss in respect of any claim, right or cause of action which the child or the (individual/s), who are unable to drive the vehicle alone, or their heirs, successors, executors administrators, agents and assigns might otherwise have against the Business (Motiv8 Services).

• Disclaimer:  I acknowledge and agree that this program is not a replacement for servicing my car and does not teach me how to be a licensed mechanic and / or driver.
  
  
• Right to use Image:  I acknowledge that Motiv8 Services may use photos and videos taken during the Training program for advertising unless I express otherwise. I grant Motiv8 Services permission to use any photographs, videos, or audio recordings of me taken during the training program for promotional and marketing purposes unless otherwise advised.

• Medical Conditions:  I represent and warrant that I am physically fit and I have no medical conditions (including psychological conditions) that would prevent my full and safe participation in the program activities. It is my responsibility to consult with a doctor before participating where required. If I am pregnant, I will take the necessary steps to ensure my doctor and health care providers are aware that I am participating in this training program. I assert that I am of fit health to participate in this training program and will alert all facilitators whose program I participate in of any conditions, medical or otherwise, that may be of concern. I agree that I will abstain from consuming drugs (excluding prescription drugs) and/or alcohol before or during the training program and any of the participating activities.

• Refunds:  No refunds available unless under exceptional circumstances and at the discretion of the organisers.

• Effect of this document:  I acknowledge that I have read and fully understand the meaning of this document. I understand that I am providing my complete and unconditional release of all liability against the officers, agents, subcontractors, and employees of Motiv8 Services to the greatest extent possible under the law of Australia. I have carefully read and accept the terms & conditions.
