  • We are excited for your interest in joining Dixie Days Festival hosted by the Downtown Farmers Market in St. George. The Downtown Farmers Market was established in 2007, and has always been a privately owned and operated organization. This event was created to support and promote locally grown food and locally made artisanal products. Participating in this event comes with many perks, including the opportunity to showcase your product to a weekly crowd of between 4,000-8,000 on average shoppers in the prime tourist district of downtown St. George at Vernon Worthen Park (300 S 400 E St. George, UT 84770).

  • PRODUCT INFORMATION

  • Please provide us information about what products you would like to sell. Your goods must be MADE/PRODUCED by you. Resale violates the licensing of the Farmers Market. WE DO NOT ALLOW SERVICE BASED BUSINESSES.

    Also, this event is a neutral inclusive community event. We want all members of our community to feel comfortable to come, support local, build community, and celebrate living in Southern Utah. With this in mind we will not be accepting any political charged, run for office candidates, or  religious organizations.

  • Food Handlers/Cottage Kitchen

  • Thanks to HB 181, The Home Consumption Act, we do not require that you have a cottage kitchen permit for the Downtown Farmers Market. There are, however, labelling stipulations that go along with this law.

    You must either label your products, or provide a small handout with every purchase that includes the following information: your name, you address, a disclosure statement saying the product is not for resale and has been processed without state or local inspection, and a statment listing whether the food or food product contains, or was prepared in a location that also handles common allergens.

    Anyone preparing food or giving out samples of products MUST have a hand washing station. You must be able to wash your hands regardless of gloves.

  • DTFM Terms and Conditions Agreement

  • Please read each section carefully. By selecting "YES, I agree" you are indicating you have read each section. Our goal is to be honest, clear, and concise. Please email downtownfarmerstg@gmail.com with any questions.

     

    1. The Downtown Farmers Market's mission is to provide community access to healthy, locally grown food and locally made artisanal products.                                                  
    2. We believe in community over competition at our market. 
    3. This agreement is between the Farmers, Bakers, Artisans, or Food Trucks to sell their goods at the Downtown Farmers Market. 
    4. This agreement also outlines the rules and regulations of participating in the Downtown Farmers Market. Since this is a weekly event and is still in a relatively new location (Vernon Worthen Park), new or unforeseen situations may arise that will need to be addressed. Additional rules and procedures will and can be added at anytime.
    5. DTFM and Downtown Farmers Market will be used interchangeably throughout the agreement.
    6. The DTFM is owned and operated by Ashley Tiller & Kat Puzey, and as such it is a private business run and operated at the owners' discretion.  The Downtown Farmers Market is partnering with the City of St. George to bring you this festival.

    7. If you are approved to sell at The Dixie Days Festival at The Downtown Farmers Market in St George on Sept 20th 9AM-2PM that is the ONLY day you are approved to sell at The Downtown Famers Market. (If you want to be a vendor at the Downtown Farmers Market weekly you need to fill out our vendor application for the season that is located under our Become a Vendor tab)                          

  • INSURANCE, LICENSES, AND TAXES

  • 1. Each participant will be issued a temporary business license through the DTFM. It is good ONLY for the Downtown Farmers Market and it is your responsibility to track your sales and pay the related taxes. 
    2. The DTFM requires liability insurance that must cover up to $2 million per incident to participate. Due to our policy and having to insure large areas, ALL VENDORS MUST BE INSURED THROUGH THE DOWNTOWN FARMERS MARKET.

  • PRODUCT

  • 1. WE DO NOT ALLOW RESALE.

    2. WE DO NOT ALLOW THE SALE OF LIVE ANIMALS.

    3. To keep the market fresh and varied, we prefer to limit 1 vendor per category, i.e. one watercolor artist, one beaded jewelery artist, etc. Exceptions will be made on a case by case basis to accomodate different styles and techniques if the market managers feel there is an adaquate difference in product, e.g. a vegan soap company and a goat's milk soap company. THIS DOES NOT APPLY TO FARMERS.  

    4. Fruit grown outside of Utah but within 350 miles of St. George will be accepted in fall/winter months and SELECTIVELY in summer months, but resale of ANY produce that CAN be grown in Utah will not be allowed. (Citrus from within 350 miles= okay, carrots from outside Utah = not okay) We realize some people partner with farmers and go out and harvest the produce and sell to earn payment. This subcategory will be charged as an artisan not a farmer. Resale of commercial produce grown in utah will not be allowed.

    5. If you are a visiting artist, precedence will be given to like product made in the State of Utah or within the 100 mile radius of St. George, UT. 

    6. We have the right to refuse a product that does not meet the standard quality, is not locally made/produced, or that is too similar to another product being sold. This means if we feel like your craftsmanship is not on the appropriate level your items will be denied. Also if several customer complaints have been made about quality, cleanliness, or standards DTFM reserves the right to discontinue further participation without prior warning.

    7. The DTFM does not allow products to be sold that we feel represent or promote bigotry, hate, extreme violence, are politically charged, or any other inappropriate materials including untasteful pornographic materials. 

    8. We do allow for employees/relatives to work at your booth. This is only for local artisans and farmers from Utah with under 5 employees. 

  • OPERATIONS

  • 1. Set up begins at 7AM on Sept 20th. Spots are preassigned and sent out the Friday before the event. There are no 'permanent spots' and you will be moved at the Market Managers discretion.

    2. NO VENDOR WILL BE ALLOWED TO SET UP AFTER 8:45AM AND WILL RECIEVE NO REFUND.

    3. If you cancel within 24 hours, you will not be refunded your booth fee.

    4. You must remain open the entire time. No early breakdowns EVEN IF YOU SELL OUT. The only particpants allowed to leave once they've sold out are farmers, as they are set up on the EDGE of the event. This is a LIABILITY ISSUE. We cannot have you hauling equipment through a packed event. 

    5. We do not allow you to play your own music.

    6. All booth fees must be paid through online invoice no later than THURSDAY AT 1PM before the market. 

    7. The DTFM is a rain or shine market. The only time we will cancel is for safety in 'acts of god' weather occurences (ie flash floods, fires, earthquakes).

    8. All vendors are REQUIRED to have a 10x10 pop up. We do not care about the color or brand, but we do require ALL participants to have one. This will keep you safe from heat and inclement weather, it will keep your products safe, and ensure the 10x10 spacing is enforced.

    9. We don't provide power. IF YOU REQUIRE ELECTRICITY AND CANNOT SELL WITHOUT IT you are responsible for buying your own generator which must be SILENT. 

    10. If you have burners or any open flame, you MUST have a baracde across the back of your booth so as to prevent patrons from coming into your area. YOU WILL NOT BE ALLOWED TO SET UP WITHOUT ONE.

  • NONCOMPETE/INTELLECTUAL PROPERTY:

  • DTFM has been running for 17 years and has honed segments, maps, and marketing strategies for this event. We do not believe in vendor exclusivity and understand that small businesses must be present at all types of events to be profittable. Where the line must be drawn is that if you participate, start, or support another market you agree to not steal, copy, or diliberately imperssonate DTFM segments, intellectual property, or back end. We also do not allow recruiting for events that run concurrnet to DTFM. One off events, markets on different days, and seasonal events are fine. 

    The Vendor acknowledges that DTFM has developed certain marketing strategies, customer lists, vendor lists, map-making styles, and other proprietary information (collectively, "Proprietary Information") which are unique and valuable to its business.
    The Vendor agrees not to use, disclose, or disseminate any Proprietary Information to any third party during or after the term of this Agreement, except as required in the ordinary course of performing services under this Agreement.
    The Vendor shall not replicate or use DTFM’s marketing strategies, customer lists, vendor lists, or map-making styles for their own benefit or the benefit of any other entity, including but not limited to starting or promoting a competing farmers market.

    Enforcement

    The Vendor acknowledges that any breach of this Non-Compete and Proprietary Information Clause would cause irreparable harm to DTFM, and agrees that DTFM shall be entitled to seek injunctive relief, as well as any other legal or equitable remedies, in the event of such a breach.

    Severability

    If any provision of this Non-Compete and Proprietary Information Clause is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall nevertheless remain in full force and effect and will result in permanent dismissal from the market.

    Governing Law

    This Agreement shall be governed by and construed in accordance with the laws of Wshington County, Utah without regard to its conflicts of law principles.
    By signing below, the Vendor acknowledges that they have read, understood, and agree to abide by the terms of this Non-Compete and Proprietary Information Clause.

  • WAIVER/LIABILITY:

  • The Downtown Farmers Market is not liable for any injury, theft, or damage to either the buyer or the seller or their property, arising out of or pertaining to preparation for or participation in the farmers markets, whether such injury, theft or damage occurred prior to, during, or after the hours of operation of the farmers markets. Seller further agrees to indemnify and hold harmless The Downtown Farmers Market for and against any and all claims for such injury, theft and/or damages. Seller assumes full liability for their vehicles, structures, fixtures and the product(s) they market or sell and by participation in Farmers Markets. I hereby agree to hold The Downtown Farmers Market and/or their representatives harmless against any and all claims such as but not limited to injury, theft or damage by any buyer, seller, or other persons resulting from or pertaining to the use, consumption, marketing tactics, display, negligence or disposition of seller’s products, vehicles, fixtures or structures.

  • MARKETING

  • 1. The Downtown Farmers Market team will do its best to represent the DTFM, Dixie Days, the City of St. George, their Farmers, Bakers, and Artisans through means of advertising, social media, newsletters, and websites.
    2. It is in the best interest of the Farmers, Bakers, or Artisans to provide their customers with information and promote the Dixie Day Event by sharing the provided informations/memes generated by the Team.
    3. The Downtown Farmers Market will use any information provided by the Farmers, Bakers, and Artisans during the application process for any marketing purposes. If any information changes, it is up to the Farmers, Bakers, or Artisans to provide updated information to the Team.
    4. You hereby release any photos taken of you, your booth, and your products at the events to be used by the DTFM at Dixie Days for future social media use.

  • ENFORCEMENT & NONCOMPLAINCE:

  • Enforcement of these guidelines is the responsibility of the market coordinator and volunteers. Please report any suspected offenses to one of these DTFM team members. Any vendor found not in compliance will be given one warning with minor issues and then be asked to leave.

    THE MARKET TEAM RESERVES THE RIGHT TO DISCONTINUE PARTICIPATION OF ANY VENDOR WITHOUT A FIRST WARNING FOR SEVERE OFFENSES OR IN SITUATIONS WHERE THE TEAM QUESTIONS THEIR SAFETY.

    Market Management reserves the right to refuse acceptance or deny continued participation of any vendor or product AT ANY TIME.

    Market Management reserves the right to remove, excuse, or discontinue participation in the event to any vendor who disrespects the staff, volunteers, or the integrity of the event. THIS IS EXTENDED TO SOCIAL MEDIA. Any vendor who is posting negative comments about the event and staff will be excused.

    Market Management has the authority to ask any vendor(s) to remove themselves or any product not previously approved by market management.

  • Market Management reserves the right to remove any vendors who behavior is precieved as combative to the processes or event regulations. This also applies to any vendor whose behavior or comments are perceived as racist, offensive, threatening, or insulting. The Market is an inclusive community event and such actions will not be tolerated by The Downtown Farmers Market. Any such behavior will result in immediate dismissal from the market and terminate further participation.

  • Please allow the Downtown Farmers Market team 1-2 full weeks to look over applications. If you are approved the team will reach out with you through e-mail so please make sure to check your promo and junk folders for emails from downtownfarmerstg@gmail.com.

  • I * * agree to abide by the rules and regulations outlined above by The Downtown Farmers Market, and I understand that if violate the rules I may be excused from participating in the Farmers Market without a refund and without reconsideration for participation in future DTFM events.
