In consideration of being permitted to attend the Pickleball Tournament (“Event”) and being permitted to participate in any of the activities described herein (“Activities”), I {playerName}, on behalf of myself, my family, heirs, beneficiaries, assignees, executors and personal representatives (collectively “I” or “Me”), agree as follows:
- I hereby assume all risks, known and unknown, that are associated with my attendance at the Event and participating in any Activities.
- I understand the risks of the Event and Activities include injury and bodily harm, including death, disease or permanent and temporary disability, that may be sustained from the use or presence of alcohol, firearms, pools, lakes, ponds and other water features, jet skis, kayaks and other watercraft, ATVs, bicycles and other motorized or mechanized vehicles, and wildlife; dangers and hazards inherent in engaging in swimming, hiking, biking, disc golf, kayaking, boating, skeet shooting, basketball, pickleball and other recreational activities; and the occurrence of storms, natural disasters, other acts of God and other unforeseen circumstances or events. I understand and acknowledge the potential risks and dangers associated with the consumption of alcohol. I know that physical activity is potentially hazardous and that I should not engage in any activity unless I am medically/physically able. I certify that I am in good health and have no reason to believe I am not physically capable of attending the Event or participating in any of the Activities.
- I shall be liable for all damages caused during my stay on the property and attendance of the Event, including any damage to property, ATVs, or other equipment. Wear and tear arising from reasonable use, and damage from the elements occurring without the fault or neglect of myself, are excepted. I will be held responsible for any breakage, abnormal wear and tear, and excessive cleaning if necessary. All damages will be charged accordingly. I will be responsible for the cost of damages, as well as any attorney’s fees and costs incurred in the collection of those damages.
- I understand glass containers are strictly prohibited in and around the pool area. If I violate this policy, I will be responsible for any damages or cleaning costs incurred due to broken glass and will be required to pay for any necessary repairs or cleanup.
- I hereby waive, release, discharge, hold harmless, and covenant not to sue Fredonia Big Bucks LLC, The CW Farm and Ranch Venue LLC, Clear Faith Capital LLC, all of their affiliates, owners, managers, officers, employees and agents (collectively, “Released Parties”), from all liability, claims, demands, losses, damages, actions, or causes of actions, in law or equity, arising out of or related to any loss, damage or injury, including death, disease or permanent and temporary disability, that may be sustained by Me, or to any property belonging to Me, that occurs as a result from my attending the Event or participating in any Activities.
- I hereby agree to indemnify, defend and hold harmless the Released Parties from all liability, claims, demands, losses, damages, actions, or causes of actions, in law or equity, including legal costs and attorneys’ fees, arising out of or related to my acts or omissions while attending the Event or participating in any Activities, whether those liabilities, claims, demands, losses, damages, actions and causes of actions are held by Me or by a third party.
- It is my express intent that this Agreement shall bind all persons and entities claiming by, through, for, or on account of their relationship to me, including, but not limited to, my spouse, family, heirs, beneficiaries, successors, assigns, executor and personal representative.
- If any part of this agreement is found to be void by law, the remaining provisions of this agreement will nevertheless be binding with the same effect as though the void portions were deleted.
By signing below, I acknowledge that I fully understand and accept that I am waiving significant future legal rights, including the right to pursue certain claims. I also agree to indemnify and hold harmless the Released Parties. I confirm that I am at least eighteen (18) years old and fully competent to enter into this agreement. I am signing this document freely and voluntarily, and under no duress. Additionally, I give CW Farm and Ranch Venue permission to use my email address for newsletters and related communications.
