Party Promoters Program Terms & Conditions

1. Eligibility
Open only to legal residents of New York, New Jersey, Connecticut, Pennsylvania, and Delaware who are at least 18 years old.
Participants must not be current employees of B Elevated Event House or its affiliates.

2. Enrollment & Referral Tracking
Upon sign‑up, each Promoter receives a unique referral link/code.
To qualify as a valid referral, the referred client must be new to B Elevated Event House, use the Promoter’s code/link at inquiry or booking, and pay a deposit to secure an event date.
Deposits must clear (i.e., not be refunded or charge‑backed) for the referral to count.

3. Commission Structure & Payment

Standard Booking (deposit ≥ $200): $25
Large Booking (deposit ≥ $500): $75
Premium Booking (deposit ≥ $1,000): $150
Commissions are paid monthly on the 15th via the Promoter’s chosen method (PayPal, Venmo, Zelle, Cash App, or ACH).
Minimum payout threshold is $50; amounts below $50 roll over to the next payout cycle.
Promoters are responsible for providing accurate payment details. B Elevated is not liable for delays or errors due to incorrect information.
4. Promotional Guidelines

Promoters agree to market ethically and lawfully—no spamming, misrepresentation, or trademark infringement.

Promoters may not bid on “B Elevated,” “The Whine Down,” or other branded terms in paid search campaigns.
Promoters must clearly disclose their relationship with B Elevated when sharing referral links, per FTC guidelines.
5. Term, Modification & Termination
These Terms & Conditions are effective upon sign‑up and remain in force until terminated by either party.
B Elevated reserves the right to modify commission rates, payout methods, or program rules with 30 days’ notice to Promoters.
B Elevated may suspend or terminate any Promoter’s participation for fraudulent activity, rule violations, or inactivity (no referrals in six months).
6. Confidentiality & Privacy
Promoters may not share or publish any internal program data (e.g., commission rates, payout reports) beyond what is publicly provided.
B Elevated will handle Promoter personal data (name, contact, payment details) in accordance with its Privacy Policy. Promoters consent to this processing by enrolling.
7. Tax Reporting
Promoters are independent contractors and responsible for all applicable taxes on commissions earned.
B Elevated will issue IRS Form 1099‑NEC for any Promoter earning $600 or more in a calendar year.
8. Limitation of Liability
B Elevated’s total liability under this program is limited to the commissions actually paid to the Promoter.
B Elevated is not liable for indirect, incidental, or consequential damages arising from Promoter participation.
9. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict‑of‑law principles.
