• Gentle Heart Doula Care Services Contract

  • Fresh 48 Terms

    This contract ("Contract") outlines the terms and conditions between the undersigned Client ("Client") and the Photographer ("Photographer") for the provision of a Fresh 48 Photography session. Both parties agree to the terms stated herein.

    FRESH 48 PHOTOGRAPHY SESSION DETAILS

    The Photographer agrees to provide a 30-60 minute photography session within the first 48 hours following baby’s birth, or at a later date within infant's first month of life if preferred by the Client. Client must schedule the photography session for the infant's first month of life, or forfeits the purchase.

    This session will be performed during daylight hours, either at the birth location or Client's home.

    If Photographer is unable to arrive within 48 hours of the birth, every effort will be made to provide a backup photographer or reschedule the session for the Photographer's next time available. 

    2-4 “Sneak peek” images will be delivered to the Client within 48 hours of the session, with the remaining gallery of 15+ edited images being delivered within 2 weeks of the session.

    FEES & PAYMENT

    Fees: The Client agrees & wishes to pay $150 or below-mentioned package price (for doula clients)

    Payment Method: For non-doula clients, payment is due in full at time of signing contract.

    Contract must be signed by 36 weeks gestational age, unless given permission by Photographer to sign at a later date.

    CANCELLATION & REFUND POLICY

    Cancellation Policy: Either party may cancel this contract, for any reason.
    Refund Policy: If Client cancels services before 36 weeks gestational age, full refund, minus credit card transaction fees, will be given. After 36 weeks, only a half refund will be offered.

    Rescheduling: Client may reschedule photography session once. The rescheduled session must be performed within 4 weeks from delivery. After this attempt, no refund will be offered.

    CLIENT EXPECTATIONS

    The Client is responsible for notifying the Photographer when labor starts, and again within 4 hours of delivery.


    Client agrees to provide a safe working environment during the session, including but not limited to: putting any pets away where they will not interact with Photographer during the session, and avoiding derogatory or hate speech, etc.

  • Birth Photography Terms

    This contract ("Contract") outlines the terms and conditions between the undersigned Client ("Client") and the Photographer ("Photographer") for the provision of Birth Photography services. Both parties agree to the terms stated herein.

    BIRTH PHOTOGRAPHY SERVICES

    The Photographer agrees to photograph, edit, and deliver digital images of the Client’s labor and/or birth.

    Services may be performed at the hospital, birth center, or home. Photographer will not attend "freebirths" where there is no medical professional planning to be in attendance.

    The number of images may be limited depending on how quickly the Client's birth progresses after the photographer arrives. The Photographer will aim to deliver 40+ images in each birth gallery when possible. 


    Digital image gallery will be delivered within 2 weeks of the birth.

     

    FEES & PAYMENT

    Fees: The Client agrees & wishes to pay $700 (for non-doula clients) or below-mentioned package price (for doula clients)

    Payment Method: For non-doula clients, $100 non-refundable deposit is due at time of signing contract. Payments must be made in full by 36 weeks gestation.

    CANCELLATION & REFUND POLICY

    Cancellation Policy: Either party may cancel this contract, for any reason. 


    Refund Policy: If Client cancels services before 36 weeks gestational age, full refund, minus the deposit and any credit card transaction fees, will be given. After 36 weeks, only a half refund will be offered.

     

    EQUIPMENT FAILURE POLICY

    In the unlikely event of camera failure, Photographer will use their phone to capture photos/video of the birth. If this happens, Photographer will issue a 50% refund of the birth photography fee and offer a Fresh 48 session at no additional cost.

     

    CLIENT EXPECTATIONS

    The Client is responsible for texting the Photographer when labor starts or waters break, and calling when contractions are 3-5 minutes apart, or when client is 4-6cm dilated. 


    Client agrees to provide a safe working environment during the session, including but not limited to: putting any pets away, and avoiding derogatory or hate speech, etc.


    PHOTOGRAPHER’S AVAILABILITY

    Photographer will arrive within 2 hours of being notified.

    Backup Photographer: Every effort will be made to provide a back up photographer, if I am unable to attend for any reason, including planned time ofof. 


    Photographer will provide up to 6-8 hours of photography during labor, birth and golden hour. Depending on length of labor, the Photographer may leave or take short breaks as needed.

     

    MISSED BIRTH

    In the event that the Photographer arrives after the birth due to unforeseen events, rapid birth or medical emergency, Fresh 48 Services will be offered at no additional cost.


    No Notification: If the Client fails to notify the Photographer of labor, or fails to request Photographer's presence at the agreed upon time above, birth photography services will be considered to have been forefeited and no refund will apply. 

  • Birth Doula Terms

    This contract ("Contract") outlines the terms and conditions between the undersigned Client ("Client") and the Birth Doula ("Doula") for the provision of birth doula services. Both parties agree to the terms stated herein.

    BIRTH DOULA SERVICES

    The Doula agrees to provide birth doula services, within the following doula scope of practice: emotional, physical, informational, and advocacy support.

    The Client understands Doula is not providing medical advice or clinical care, and is not expected to speak to medical professionals on Client's behalf.

     

    FEES & PAYMENT


    Payment Schedule: A non-refundable deposit of $200 is due upon signing of this contract. The remaining balance is due in full by 36 weeks gestational age.


    Payment Method: Payments can be made by credit card, cash, or personal check. $25 discount is offered to Clients paying with check.

     

    CANCELLATION POLICY

    Cancellation Policy: Either party may cancel this contract, for any reason before 32 weeks gestational age. Cancellation cannot occur after the baby is born.


    Refund Policy: The deposit is non-refundable. If doula services are cancelled before 32 weeks gestational age, the entire paid amount (minus fees for services used and the non-refundable deposit) may be refunded.


    When applicable regarding refunds, prenatal visits are valued at $100 each.

    TERMINATION OF SERVICES

    Conditions for Termination: Termination may occur at any time if either party breaches the terms of this contract. In order for termination to be in effect, the responsible party needs to notify the other party by writing.

    Please note: delivery by cesarean is not a reason for termination.

    Refund Policy: If services are terminated before labor support begins, a refund of up to $450 will be issued. No refund applies if services are terminated after the start of labor support.

    CLIENT EXPECTATIONS

    Timely Communication: The Client agrees to inform the Doula promptly by phone call when they think they are in labor or their waters break.

    Accuracy of Information: The Client will provide accurate and complete medical information, as well as any pertinent updates throughout pregnancy.

    Medical Provider: It is the Client’s responsibility to ensure the necessary arrangements are made to have a medical practitioner (not the Doula) present at the birth.

    Childbirth Education: The Client agrees to attend a childbirth education class during their pregnancy.

     

    DOULA’S AVAILABILITY

    The Client may contact the Doula 24/7 when labor begins or waters break.

    The Doula agrees to arrive within 2 hours of being requested for in-person support. Arrival time may vary for births located outside of Wichita, KS city limits.

    Backup Doula: If Doula is not available, every effort will be made to provide a back up doula. 

     

    BIRTH SUPPORT

    Labor and Birth Support: The doula will support the Client during labor until 1-2 hours after the birth. The Doula(s) may switch shifts after 12 hours. Depending on the length of labor, the Doula may take short breaks for meals and rest.

    MISSED BIRTH

    Missed Birth: In the event that the Doula is unable to support the birth due to unforeseen circumstances or error on the Doula’s part, $450 will be refunded to the Client.

    No Notification: If the Client fails to notify the Doula of labor, or fails to request the doula to come, no refund will apply. 

    Circumstances Beyond Control: In situations like rapid birth or medical emergency, it may be impossible for the Doula to provide services. If Client delivers baby less than two hours after requesting Doula for in-person support, and Doula was not able to make it in time, no refund will apply.

     

    CLIENT VISITS

    Rescheduling: Visit(s) may be rescheduled, depending on Doula and Client availability. Client is responsible for ensuring all prenatal visits are scheduled before the birth. Depending on Doula and Client's availability the number of visits listed in the package may not be able to be scheduled before the birth and the client may forfeit one or more of their visits.

  • Photo Release

    Acknoweldgements

    I understand that all photographs taken of me and/or my family (including my partner, children, etc.) are the property of Gentle Heart Doula Care. I grant permission for Gentle Heart Doula Care LLC to use these photographs for any of the following purposes websites or social media accounts advertisements promotional publications articles and other marketing materials, or any other lawful purpose whatsoever

    I understand that I am able to print or share any of my images for personal use only, and cannot authorize any other businesses to use them without purchasing a commercial use license from Gentle Heart Doula Care.


    I relinquish any right to examine or approve the completed product. I understand that while I can request specific images, no one shot is guaranteed to be captured.
    I relieve Gentle Heart Doula Car and its contractors of any liability due to photography equipment failure or malfunction.


    I can withdraw the consent I have given at any time However I understand that any images already published may not be able to be fully removed from existing materials


    I affirm that I am at least 18 years of age, have read the above release and agreement prior to its execution and fully understand it


    I acknowledge that my laboring environment may be dim and difficult to capture images in.

    I understand it is my responsibility to download my entire gallery once it is delivered, and that Gentle Heart Doula Care is not to be held liable for lost images after 14 days from gallery delivery

  • MEDICAID DOULA SUPPORT

    This contract ("Contract") outlines the terms and conditions between the undersigned Client ("Client") and the Birth Doula ("Doula") for the provision of birth doula services. Both parties agree to the terms stated herein.

    DOULA SERVICES

    The Doula agrees to provide birth doula services, within the following doula scope of practice: emotional, physical, informational, and advocacy support.

    The Client agrees Doula is not expected to provide medical advice, clinical care, or to speak to medical professionals on Client's behalf. 

    Services may be rendered during prenatal visit(s), birth support, or postpartum visit(s).

    Client may choose to receive only prenatal visits (and no birth support). If so, this will have been communicated and agreed upon by both parties before signing of this contract

     

    FEES & PAYMENT

    The Client is responsible for ensuring active coverage with Insurance or Payer throughout the perinatal period. The Client agrees to notify Doula of any changes to their insurance coverage prior to any appointment or as soon as possible to avoid delays in claim processing


    If Payer denies payment due to client’s failure to maintain coverage, submit required documentation, or meet eligibility requirements, the client will be responsible for the full payment of services as listed on Doula’s website, payable within 60 days of notice of denial.

    Any services not covered by Payer can be purchased separately. 

    CANCELLATION POLICY

    Cancellation Policy: Either party may cancel this contract, for any reason, at any time. 

    Conditions for Termination: Termination may occur at any time if either party breaches the terms of this contract. In order for termination to be in effect, the responsible party needs to notify the other party by writing.

    DOULA’S AVAILABILITY

    The Client may contact the Doula 24/7 when labor begins or waters break.

    The Doula agrees to arrive within 2 hours of being requested for in-person support. Arrival time may vary for births located outside of Wichita, KS city limits.

    Special note: on-call availability is not limited to a certain "window" within the Client's pregnancy. If there will be a period of time where the Doula will not be available (for example, planned travel to a destination more than 2 hours outside of Wichita, KS), Doula will make arrangements for a local backup doula to be on-call. 

    In the rare circumstances a back-up doula is not available, this will be communicated to Client as soon as possible. At that time, Client will be given the option to cancel this contract. If Client wishes to exercise this option, they must do so within 48 hours of being notified.

    Backup Doula: Every effort will be made to provide a back up doula that is in-network with Payer if Client's Doula is unable to attend. If no in-network backup doula is available, Client will be responsible for paying $500 directly to backup doula that attends if requested by Client.

     

    CLIENT EXPECTATIONS

    Timely Communication: The Client agrees to inform the Doula promptly by phone call when they think they are in labor or their waters break. This allows the Doula time to make necessary arrangements and travel to the Client.


    Accuracy of Information: The Client will provide accurate and complete medical information, as well as any pertinent updates throughout pregnancy.

    Client acknowledges that Payer will only pay one doula for birth support each pregnancy, and Client agrees to not hire a second doula to perform this service.

     Medical Provider: It is the Client’s responsibility to ensure the necessary arrangements are made to have a medical practitioner present at the birth.

    BIRTH SUPPORT

    Labor and Birth Support: The doula will support the Client during labor until 1-2 hours after the birth. The Doula may be unable to support labors lasting longer than 12 hours.

    Breaks: Depending on the length of labor, the Doula may take short breaks for meals and rest.

    CLIENT VISITS

    Rescheduling: Visits may be rescheduled, depending on Doula and Client availability.

    Number of Visits: Depending on availability, the number of visits listed in the package may not be able to be scheduled before the birth and the client may forfeit one or more of their visits.

     

    MISSED BIRTH

    Client understands that unforeseen circumstances, rapid birth, medical emergency, or other reason may prohibit Doula from arriving in time for Client's birth. Client agrees hold Doula harmless if this occurs.

    OPTIONAL ADD-ON SERVICES:

    Fees & Payment: Payer does not cover birth or fresh 48 photography services and is separate from doula services (as outlined above.) If Client would like the Doula to act in the additional role as a Photographer during their birth and bring their camera to capture, edit, and deliver professional images of the birth. Client will need to sign and pay for this separately. Client acknowledges that this is an optional service and even wiithout purchasing these services, they are still able to receive iPhone (or other equivalent) photos of the birth. If Client does not wish to purchase these services it will in no way hinder their birth support as covered by Insurance or Payer.

    SIGNATURES

    By signing, the Client agrees to the following: I authorize the release of any medical or other information necessary to process claims. I also request payment of government benefits either to myself or to the party who accepts assignment below. I authorize payment of medical benefits to the undersigned physician or supplier for services described above.

    The Client understands that they may revoke this consent in writing at any time. However, revocation will not apply to services already rendered or claims already submitted.

  • CODE OF CONDUCT

    Professionalism: The Doula or Photographer as described above (hereafter referred to as "Provider") will maintain professionalism and respect at all times, treating the Client and their partner with kindness, empathy, and discretion.
    Confidentiality: All identifying information shared by the Client will be kept confidential. The Provider will not share personal or medical information without the Client's expressed consent.

    LIABILITY

    The Client acknowledges that the Provider is not providing medical advice, performing clinical assessments, administering medications, or engaging in any activities that require a nursing or other medical license. All information, guidance, and support provided are for educational, emotional, advocacy support, and physical comfort purposes only, and do not substitute for care from a licensed medical provider.

    The Client agrees that they will not interpret any guidance or information provided as medical advice, and releases the Provider from any liability for decisions Client makes regarding their health or the health of their baby during pregnancy, labor, birth, or postpartum.

    The Client understands that they are responsible for consulting their healthcare provider(s) for any medical concerns.

    CONSENT & PERMISSIONS

    Consent to Provide Services: The Client consents to receiving services selected as above.


    Permission to Share Information: The Client permits the Doula to share Client’s information with the backup doula, and/or medical professionals as necessary to ensure the Client's well-being and the effective support of their birth plan.

    COMMUNICATION 

    Both parties agree to respond to messages within a reasonable time frame. Failure to respond to at least 3 consecutive contact attempts each occuring on different days will be considered cause for termination of this contract.
