Painting & Remodeling Services – Colorado Springs, CO
Effective Date: [April 15th, 2025]
1. Scope of Work
[Mahi Painting & Remodeling LLC] ("Company") agrees to perform painting, remodeling, and related services ("Services") for the client ("Client") at the specified project location. A detailed description of work will be outlined in a separate project proposal or estimate, which is incorporated herein by reference giving by the client.
2. Estimates & Pricing
All estimates are valid for 14 days. Prices are subject to change if scope of work changes or unforeseen conditions arise. The final cost will be provided in a written agreement and must be approved by the Client prior to commencement of work.
3. Payment Terms
A deposit of [30%] is due for materials before work begins.
Progress payments may be required for projects exceeding $7,500 or 10 days.
Final payment is due upon completion of services.
Late payments are subject to a $100 late fee per day for everyday payment is late beyond 10 days.
4. Scheduling & Delays
The Company will make reasonable efforts to adhere to the project timeline. However, delays due to weather, supply shortages, inspections, or other unforeseen events may occur. The Company is not liable for such delays.
5. Client Responsibilities
The Client agrees to:
Provide clear access to the worksite
Remove or protect personal belongings in work areas
Notify the Company of any known hazards or special conditions
Obtain necessary approvals from HOA (if applicable)
6. Change Orders
Any changes to the original scope of work must be made in writing and may result in additional charges and timeline adjustments.
7. Warranty
The Company offers a limited warranty of 1 year on workmanship. This does not cover:
Damage caused by the Client or third parties
Normal wear and tear or misuse
Structural issues or existing defects not addressed during the project
8. Cancellation & Refunds
Cancellations made less than [72 hours] before the project start may result in forfeiture of deposit. Refunds will be provided at the Company's discretion and only for work not yet completed.
9. Limitation of Liability
The Company shall not be liable for incidental, indirect, or consequential damages. Maximum liability shall not exceed the total amount paid by the Client for services rendered.
10. Insurance & Licensing
The Company is licensed and insured in the state of Colorado. Proof of insurance is available upon request.
11. Dispute Resolution
Any disputes will first be attempted to be resolved through informal negotiation. If unresolved, both parties agree to submit to binding arbitration in El Paso County, Colorado.
12. Governing Law
These Terms are governed by the laws of the State of Colorado.
13. Acceptance
By hiring the Company, the Client agrees to these Terms and Conditions. A signed proposal or the commencement of services shall constitute acceptance.
