PARTICIPATION AGREEMENT, RELEASE, AND ASSUMPTION OF RISK

In consideration of the services of The Cheer Center, d/b/a World Cup Ohio, its owners, agents, officers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “WCO”), I hereby agree to the following:

1. I represent that I am the parent, or legal guardian, of {athleteName} (the “Athlete”), or that I as the Athlete am over the age of 18, and that I have full authority to enter in to this Agreement, on behalf of myself and the Athlete, as applicable.

2. I understand and acknowledge that the activities that I, or my Athlete, engage in while on the WCO property (the “Property”), or at any other time while under the supervision and control of WCO, pose both known and unknown risks which could result in injury, paralysis, death, emotional distress, or damage to myself, my Athlete, our property, or third parties. The sports of cheerleading, dance, and gymnastics ─including tumbling, performance of stunts, and use of trampolines ─ entail certain risks that simply cannot be eliminated without jeopardizing the essential qualities of the activity. Without a certain degree of risk, students would not improve their skills and the enjoyment of the sport would be diminished. The following describes some, but not all, of those risks: cuts, bruises, sprains, broken bones, paralysis, and death. Further, I understand and acknowledge, that traveling to and from practice, shows, competitions, and exhibitions raises the possibility of any manner of risk associated with transportation accidents.

3. I hereby acknowledge that participation in WCO related activities, poses a risk of exposure to COVID-19 and/or other contagious viruses carried by another athlete, staff member, family member, or third-party. I am knowingly, and voluntarily, assuming this risk on behalf of myself, and my Athlete, including the risk of contracting a virus, becoming ill from it, or even death.

4. With full knowledge of the potential risks associated with WCO related activities, I consent to participate, and allow my Athlete, to participate in such activities, despite the risks. My participation, and that of my Athlete, is purely voluntary. No one has forced or coerced me, or my Athlete, to participate. Accordingly, I promise to accept all risks, known and unknown, connected with WCO related activities, including but not limited tumbling, performance of stunts, and use of trampolines.

5. I hereby voluntarily release, forever discharge, and agree to hold harmless and indemnify WCO, on behalf of myself, my Athlete, my parents, my heirs, assigns, personal representative, and their associated estates, from any and all liability, claims, demands, actions, or rights of action, which are related to, arise out of, or are in any way connected with my, or my Athlete’s, participation in WCO related activities.

6. Should WCO be required to incur attorney’s fees, costs, and/or expenses to enforce this Agreement, I agree to indemnify and reimburse WCO for such fees, costs, and/or expenses.

7. I certify that I, and my Athlete, have health, accident, and liability insurance to cover bodily injury and/or property damage that may be incurred while participating in WCO related activities, or else, I agree to bear the cost of such injury or damage to myself or my Athlete.

8. In the event that I file a lawsuit against WCO on behalf of myself, of my Athlete, I agree to do so solely in the State of Ohio, and I further agree that the substantive and procedural laws of Ohio shall apply in any such action. I agree that if any portion of this Agreement is found void and unenforceable, the remaining portions shall remain in full force and effect. Further, I waive all rights I may have to a jury trial on behalf on myself, and my Athlete.

9. By signing this Agreement, I acknowledge that if anyone is hurt, or property is damaged, during my, or my Athlete’s, participation in WCO related activities, I have affirmatively waived my, and my Athlete’s right, to maintain a lawsuit against WCO on the basis of any, and all, potential claims related to participation in WCO related activities.

World Cup Ohio 2025-2026 Financial Agreement

We, the undersigned, agree to pay the tuition and fees set forth in the Team Tryout packet for World Cup Ohio, as may be reasonably amended from time to time at the discretion of World Cup Ohio without notice.  All fees are payable on the date indicated.  Late fees will be assessed if payment is not received by the due date.

We understand that All Star is a competitive sport, which involves a commitment to a team.  If, at any time, my account becomes past due, my child may be suspended and not able to participate in practices or competitions until the account becomes current.  This will strongly affect the team, as they rely on everyone to be in attendance.
 

Booster fees, competition fees, transportation and hotel costs are not included in this agreement.  We do our best to estimate the cost based on the previous year, however, any overage that may be incurred due to increased pricing, will be assessed to your account. 

Most fees are non-refundable, unless injured and unable to participate.  In the event you quit or are removed from the team, there will be no refunds, under any circumstance.  Please read all World Cup Ohio Policies and Procedures before signing this agreement.

I understand any past-due accounts are subject to monthly late fees and may be referred to a collection agency and/or attorney. I agree to pay all fees, costs, and expenses associated with the collection of any past due accounts, including, but not limited to, attorney’s fees and expenses associated with legal action. I authorize World Cup Ohio to communicate with collection and credit reporting agencies and/or other similar services for the purposes of obtaining and furnishing appropriate information in connection with my gym account.

By signing this agreement, I will abide by all Financial Commitment as stated in the 2025-2026 World Cup Ohio Gym Handbook and Tryout Packet, as may be reasonably amended from time to time at the discretion of World Cup Ohio without notice.

World Cup Ohio 2025-2026 Gym Handbook Agreement

In order to maintain a positive environment, World Cup Ohio must set forth certain rules that apply to all athletes.  All rules, requirements and policies are outlined, in detail, in the 2024-2025 Gym Handbook including, but not limited to:

By signing this agreement, we (both myself and my Athlete) will abide by all Rules stated in the 2025-2026 World Cup Ohio Gym Handbook.

Cheer Center Boosters
2025-2026 Release, Waiver, and Indemnity Agreement

In consideration of being permitted to participate in the Cheer Center Booster Club (the “Club”) activities and/or my child/ward being permitted to be a member of the Club’s cheer and/or dance competition team(s), Releasor for himself/herself and his/her personal representatives, heirs, and next of kin, releases, waives, discharges and covenants not to sue the Club, its officers, and/or members and their personal representatives, heirs, and next of kin (all referred to as “Releasees”), from all liability to Releasor, his/her personal representatives, assigns, heirs and next of kin for any and all claim, loss, action or right of action of whatsoever kind or nature either in law or equity, or damage on account of bodily or personal injury, death, and/or property damage, whether caused by the negligence of Releasees or otherwise while Releasor and/or Releasor’s child/ward is participating in any Club activity.

Releasor agrees to indemnify the Releasees from any loss, liability, damage, cost, or expense including reasonable attorney fees, Releasees may incur due to the participation by Releasor and/or Releasor’s child/ward in any Club activity, whether caused by the negligence of Releasees or otherwise.

Releasor assumes full responsibility for and risk of bodily injury, death, and/or property damage due to negligence of Releasees or otherwise while Releasor and/or Releasor’s child/ward is participating in any Club activity.

Releasor agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Ohio and that if any portion of the Release is held invalid, it is agreed that the balance will, notwithstanding, continue in full legal force and effect.

Releasor states that he/she carefully has read this Release, knows the contents of it, and signs this Agreement as his/her own free act.

2025-2026 Cheer Center Boosters Financial Consent and Authorization

I understand that as a participant at World Cup Ohio, I have separate and distinct financial obligations to both World Cup Ohio and The Cheer Center Boosters.

I understand that failure to make payments for membership fees, competition fees, or other amounts owed The Cheer Center Booster Club when due, or to arrange for such payments before their due dates, is considered sufficient cause to:

(1) bar/prevent the Athlete from practicing in competitions;
(2) bar/prevent the Athlete from being registered for competitions; and/or,
(3) drop the Athlete from pre-registered competitions, camps, or other scheduled activities.

I understand any past-due accounts are subject to monthly late fees and may be referred to a collection agency and/or attorney. I agree to pay all fees, costs, and expenses associated with the collection of any past due accounts, including, but not limited to, attorney’s fees and expenses associated with legal action. I authorize The Cheer Center Boosters to communicate with collection and credit reporting agencies and/or other similar services for the purposes of obtaining and furnishing appropriate information in connection with my booster account.

I understand the Annual Booster Fee and all Monthly Booster Fees are non-refundable and payable even if my athlete chooses to quit after the teams are formed, or a team in unable to compete for any reason. I understand that the budget established for the season is based on the number of participants at the time the competition squads are established, and all applicable fees may be adjusted if needed. I agree to pay any increased adjustments to any/all applicable fees should they be required.

I will make the required payments on time as outlined in the Cheer Center and/or Booster handbooks or as informed by notice if applicable.
