AUTO PAYMENT AGREEMENT SECTION:

PAYMENT AUTHORIZATION

For my payment of the noted amount above, I agree that all payments are payable in advance, and will be charged to my account as duly noted. I understand all program memberships are subject to approval and should any payments not be able to be processed for any reason, I will pay a $25 service charge per failed attempt. Koko FitClub will immediately notify you through your email on record each time an attempt has failed and the date the next attempt will be scheduled. After three (3) attempts to collect fail, your account will be transferred to a Collection Agency, which will also trigger a notification to the Credit Bureau.

DEFAULT: Should I default in my payment obligation; I agree to pay all costs of collection, including court costs and attorney's fees.

TERMS AND CONDITIONS SECTION:

 

Attendance: Non-use of Koko FitClub will not relieve the Member’s obligation to make payments as outlined herein.

Disability/Death: If by reason of death or permanent disability, the Member(s) is unable to continue his/her membership, the Member’s estate shall be relieved from the obligations of this agreement, upon receipt of written notification. Request to cancellation by notice sent by registered or certified mail, return receipt requested, or personally delivered to the address of the health club specified in the contract upon the buyer's death or permanent disability, if the permanent disability is fully described with timelines and confirmed to the health club by the State of New Jersey and a written physician form. A PHYSICIAN’S NOTE ON A PRESCRIPTION IS NOT ADEQUATE PROOF.

ANY HOLDER OF THIS CONSUMER CREDIT AGREEMENT IS SUBJECT TO ALL CLAIMS AND DEFENSES, WHICH THE BUYER/MEMBER COULD ASSERT AGAINST THE CLUB AS A RESULT OF THIS AGREEMENT.  RECOVERY BY THE BUYER/MEMBER SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE BUYER/MEMBER TO THE CLUB PURSUANT TO THIS AGREEMENT.  YOU THE BUYER MAY CANCEL THIS AGREEMENT BY MIDNIGHT OF THE CLUB’S THIRD BUSINESS DAY AFTER THE DATE OF THIS AGREEMENT, AND SUCH CANCELLATION MUST BE IN WRITING.  IN THE EVENT THE CLUB CLOSES AND CEASES DOING BUSINESS, YOU ARE THEN NO LONGER OBLIGATED TO MAKE PAYMENTS UNDER THIS AGREEMENT UNLESS YOUR MEMBERSHIP WILL BE HONORED AT ONE OF OUR OTHER FACILITIES WITHIN FIFTEEN (15) MILES OF THE MEMBER’S ADDRESS OF RECORD.  RATES SUBJECT TO CHANGE WITH THIRTY (30) DAY WRITTEN NOTICE.  THIS AGREEMENT IS INTENDED TO COMPLY WITH ALL APPLICABLE LAWS, INCLUDING WITHOUT LIMITATION APPLICABLE CONSUMER PROTECTION STATUTES. IF THERE IS A CONFLICT BETWEEN THIS AGREEMENT AND APPLICABLE LAW, THE BUYER’S OBLIGATION UNDER THIS AGREEMENT SHALL BE REDUCED, OR IF NECESSARY ELIMINATED, SO AS TO BE CONSISTENT WITH THE LAW.

I VERIFY THAT I AM IN GOOD HEALTH AND HAVE READ AND UNDERSTAND THE COMPLETE TERMS OF THIS MEMBERSHIP AGREEMENT. I AGREE TO ABIDE BY THIS KOKO FITCLUB TRAINING AGREEMENT IN ITS ENTIRETY, INCLUDING THE KOKO FITCLUB BYLAWS, ALONG WITH ANY ADDITIONAL RULES AND REGULATIONS POSTED AT KOKO FITCLUB. I ACKNOWLEDGE THAT REASONABLE CHANGES IN OPERATING PROCEDURES AND SCHEDULES MAY OCCUR FROM TIME TO TIME.

REFUNDS (MINUS $25 PROCESS FEE) PROVIDED UP TO 14 DAYS OF KICKSTART BEGIN DATE. IF AFTER THE 14 DAYS, A CREDIT MAY BE APPLIED ON AN AS NEEDED BASES.
