Before we make or finalize arrangements for your trip, we require that you sign below or click “I Agree” on our website. Your signature or click will signify your agreement with the following terms and conditions.
Please read our Terms and Conditions (“Terms of Use) carefully before using our website. The following Terms of use are entered into by and between (“You, visitors, travelers, customers, clients, and passengers, users”) who access and use this website and Bluediamond & Zircon Travels Services LLC., (“us”, “we”, our “). These terms and conditions together with any document they expressly incorporate by reference (“ collectively, these terms of use”) govern Your access to use the Bluediamond & Zircon Travel Services, LLC (the website) and include any consent, functionality, and services offered on or through Bluediamond & Zircon Travel Services, LLC ( the “Website”). The Terms of Use apply to everyone who accesses or uses this website. By accessing or using this website you accept and agree to be bound by these Terms of Use, our Privacy Policy, incorporated herein by reference, and Disclaimer incorporated herein by reference. If you do not want to agree to these terms of use or disagree with any part of the Terms of use, you must not access or use this website.
1. Intermediary Role (Agent for Suppliers): Bluediamond & Zircon Travel Services LLC acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers/Vendors”). We are not responsible for the acts or omissions of the Suppliers or their failure to adhere to their schedules, provide services or refunds, financial default, or failure to honor future trip credits. We have no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit instead of a refund. You consent to and request the use of those suppliers and agree not to hold us responsible should any of these suppliers: 1) fail to provide the travel services purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes any sort of injury, damage, delay or inconvenience. We are not liable for any direct, indirect, incidental, or consequential damages, including lost profits or theft of items arising out of the use or inability to use the agency services.
2. Reservation: Reservations can be made by our website at Bluediamond & Zircon Travel Services, LLC or by email at bluediamond@zircontravels.co.site
You are responsible for reviewing all booking reservations and/or itineraries sent by us and ensuring the accuracy of all booking information including but not limited to, names, dates of birth, travel dates, itinerary schedule, airfare and/or car rental reservations, hotel, resort or cruise accommodations, optional activities, and pricing and immediately inform us if there are any omissions or errors before issuance of Tickets/Services. Changes to an existing reservation, regardless of the reason for the change, will incur a service charge per person, plus any additional supplier/vendor fees which will be determined at the request of changes. This policy includes name changes, and/or removal/addition of any services. Once reservations have been made, cancellations/changes will only be accepted in writing via email to bluediamond@zircontravels.co.site , This email should include your full name, date of travel, and invoice/account/package/ ticket number. Reservations completed online are subject to review and if necessary, may be rebooked to match minimum connecting time requirements and/or travel package itineraries, in which case the customer will be immediately.
3. Risks of Travel and Release: Travel is personal, and everyone’s goals and experiences may differ. We cannot be bound by, or liable for any description, photography, representation, or warranty made by or provided by representation, of any independent third party or Travel agency. We assume no responsibility for and shall not be liable for the acts or omissions of any party not under our control, or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illnesses, weather hazards, mechanical failures, local laws, criminal acts, or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, clicking on "Find International travel Information” then clicking on "Country Information", and filling in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. It is your personal decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions about the risks of COVID-19.
YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.
4. Vaccination Requirements and Other Rules: We have no responsibility for COVID-19-related requirements that travel suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings before departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, we recommend going to IATA’s website at https://www.iatatravelcentre.com/international-travel-document-news/1580226297.htm. For the latest travel supplier rules, check the website of each supplier, and keep checking because these rules are constantly changing, and we are not responsible for those changes.
5. Other Foreign Entry Rules: You assume complete responsibility for checking and verifying all passports, visas, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. If you do not have the visas or travel requirements, you may be denied boarding a flight or refusal at the port of entry. Some countries will not admit people convicted of a crime. Some countries require both parents’ consent for minors to travel. You are strongly encouraged to review travel prohibitions, warnings, announcements, vaccinations, and advisories issued by the relevant governments and every other entry requirement before booking travel to domestic/ international destinations. Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov.
Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov.
6. Transportation Security Administration (TSA) requires you to provide your full name, date of birth, and gender for watch list screening, under the authority of 49 U.S.C section 114, the Intelligence Reform and Terrorism Prevention Act of 2004, and 49 C.F.F parts 1540 and 1560. You may also provide your Redress Number, if available. Failure to provide your full name, date of birth, and gender may result in denial of transport or denial of authority to enter the boarding area. TSA may share information you provide with law enforcement or intelligence agencies or others under its published system of records notice. For more information on TSA privacy policies, or to review the system of records notice and the privacy impact assessment, please see the TSA website at www.tsa.gov.The Transportation Security Administration requires you to carry a government-issued identification card when boarding and that the name, and date of birth and gender that appears on the identification card must exactly match such data that is listed on the airline ticket and in the booking records. Failure to strictly comply with these requirements may result in denying boarding or an undue delay at an airport security checkpoint potentially causing a missed flight.
7. Claims Deadline and Exclusive Jurisdiction: You agree to present any claims against us within 30 days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in [Bucks County, Pennsylvania] will be exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
8. Airlines and Supplier Terms: You are subject to the terms and conditions of purchases imposed by the suppliers, including payment obligations and compliance with suppliers’ rules and restrictions. We are not responsible for the services and policies imposed by the applicable airlines or Suppliers. Suppliers’ schedules and flights are subject to change without notice. We are not responsible for penalties incurred for tickets, international or domestic, whether issued by us or not due to schedule and/or flight changes. Airline reservations completed online are subject to review and should we deem it necessary, they may be rebooked to match minimum connecting time requirements and/or travel package itineraries, in which case you will be notified immediately. Any violations of any supplier terms and conditions including ours may result in cancellation or denial of access, or forfeiture of payment. You are required to regularly check the supplier’s website and content for the latest information and updates. We are not responsible for the services and policies imposed by the applicable Suppliers.
9. Supplier Additional terms and conditions: Additional terms and conditions may apply to us or our supplier to your reservation and purchase of travel-related goods and services that you choose. Please read these additional terms and conditions carefully. If you have purchased an airfare, please ensure you read the full terms and conditions of carriage issued by the supplier, which can be found on the supplier's website. Regardless of which means of travel you have purchased, you agree to abide by the terms and conditions imposed by any supplier with whom you choose to deal, including, but not limited to, payment of all amounts when due, and compliance with the supplier’s rules and restrictions regarding availability and use of fares, products, or services. Airfare is only guaranteed once the purchase has been completed, and the tickets have been issued. Airlines and other travel suppliers may change their prices without notice.
10. In some locations, aircraft may be subject to insecticide spraying before the flight or while you are on the aircraft. You are strongly encouraged to always check the list of countries that require airlines to treat the passenger cabin with insecticides http://alturl.com/3rtty as this list is updated regularly.
11. Fees and Price Drops: You agree to pay for the travel planning, change, research fees, and other fees required by us or the supplier which are not refundable at the time of reservation. The amount may vary depending on the complexity and customization of the travel package and the supplier’s policies. All our fees are non-refundable. If a Supplier drops the price of a trip after booking, we will try to assist you with rebooking if the Supplier allows it, and a fee may apply. We do not guarantee any refunds or successful rebooking.
12. Price Increases: Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. And authorize your credit or debit card to be used for them. Suppliers have their contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms.
13. Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance to cover certain risks inherent in travel such as supplier bankruptcy and the inability to travel due to medical emergency. Please note that, unless you buy a cancel-for-any-reason policy, most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. You agree to hold us harmless for your choice not to purchase travel insurance or for any denial of claim by the travel insurer as it relates to COVID-19 or any other claim under the policy.
14. Price and payment policy: Fares and availability are subject to change until ticketed. You must note that airfares, aircraft availability, hotel rates and room availability, tour prices, and availability, ticket prices for events, car type and rentals, and transfer availability continually fluctuate and add applicable surcharges, package prices and availability will change accordingly. In the event of a computer or human error, we reserve the right to re-invoice customers for the correct price or service. All advanced ticket purchases are non-refundable and non-transferable. You understand that ‘discounted fares typically involve restrictions and that changing any aspect of the travel arrangements may result in the payment of additional fees. Conversely, cancellation of any aspect of the travel arrangements may result in financial penalties, or forfeiting the amount paid altogether by the supplier’s cancellation policies. When a reservation requires a deposit, it’s typically due at the time the reservation is made to secure the reservation. All deposits are non-refundable and non-transferable. All reservations, except where specified, will require a deposit and will specify the amount due as well as any payment plans, if applicable. By submitting a deposit or payment, you formally accept our Terms and Conditions as stated herein. Any violation on your part will constitute a breach and possible forfeiture of all payments and services.
15. Cancellation Policy: All reservations are subject to cancellation until bought or ticketed. You are aware that all travel expenses will be subject to the loss of all the fares or require the expenditure of additional money if you choose to change dates or cancel reservations. The Airline or Supplier reserves the right to cancel part of or all the booking/products or services if full payment is not received at the time of purchase. Ticket changes or cancellations may incur penalties and /or increased fares depending on the class and airline policy. Some tickets, especially discounted ones, may not be refundable. Specific rules and restrictions on cancellations and changes vary depending on the price of the ticket. Once reservations have been made, cancellations will only be accepted in writing via email to bluediamond@zircontravels.co.site This email should include your full name, date of travel, and invoice/account/package/ ticket number. We are not responsible for the services and policies imposed by the applicable Suppliers. Airlines, hotels, cruise tour operators, car rental, and other services are subject to change without notice. We are not responsible for penalties incurred for tickets, hotels, Cruises, or car rentals international or domestic, whether they are issued through us or not due to schedule and/or flight changes. Suppliers reserve the right to demand immediate issuance of tickets whenever they determine that specific flights/ services are heavily booked, even when normal ticketing rules do not require tickets to be issued until a later date. In this instance, we will require immediate and full payment of the airfare/cruise fees, hotel fees, and other service fees. This situation overrides invoice terms and conditions, and payment due dates through any payment plans you may enter with us. If full payment is not received, seats will be canceled by the supplier and may not be available to be rebooked on the same flights or at the same fare/vendor. Any replacement air arrangements, airfare, or other services will be the sole responsibility of the traveler. We will do our best to use major suppliers for your travel arrangements. There may be times when discount suppliers are used. You will be notified beforehand if this is the case.
16. Credit Card Merchant: We strongly recommend that you use a credit card for your purchase so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased. However, if we are the credit card merchant, our role is to facilitate the sale, collect funds on your behalf, and remit those funds to the Suppliers. If the Suppliers do not provide the services, your only recourse would be against the Suppliers, and you agree not to initiate a chargeback against us.
17. Refund Policy All payments to us are non-refundable and non-transferable. This policy is because we have contractual agreements with host agencies, hotels, airlines, and other vendors that will not allow us to obtain any refunds. By a specific travel package/ticket terms and conditions and contingent upon availability, if a major change is initiated by the airline or supplier such as cancellation, the traveler might be entitled to a refund or rebooking options based on the Airline/Supplier policy and ticket terms.
18. No show: If you fail to show up for a scheduled flight, or travel packages/Services including cruises and events, you might automatically lose the value of the ticket or service depending on the supplier policy without any refund.
19. Warranties: We provide services “as is” and without warranties of any kind either express or implied including accuracy, reliability, merchantability, or fitness for a particular purpose.
20. Cruises and Hotels: We do not endorse or recommend any cruise line or hotel. Our role is to facilitate your bookings. Our hotel and cruise ship packages are based upon information provided to us by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. We do our best to maintain current information, however, we are not responsible for any inaccuracies, changes in description details or amenities, or images provided by third parties. Cruise itineraries and ships are subject to change without notice. Furthermore, cruise ships may be chartered and/or departure dates canceled, in which case all monies will be refunded by applicable cruise line terms and policy. We take no responsibility for ship substitutions or itinerary changes imposed by a cruise line, and we are not responsible for any losses you may incur, including the issuance and/or cancellation of airline tickets or visa fees. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver before participating in the service and/or activity they offer. Any violation of any such supplier/vendor's rules and restrictions may result in cancellation of your reservation(s), denied access to the applicable travel product or services, or forfeiture of all monies paid for such reservation(s), and/ may also result in us debiting your account for any costs we may incur because of such violation.
21. Indemnification: You agree to defend and indemnify Bluediamond & Zircon Travel Services LLC and/or its respective suppliers/vendors, and any of their officers, directors, employees, and agents from and against any claims, demands, actions, liabilities, recoveries, losses, damages, fines, penalties, settlements, judgments costs and expenses of any kind or nature including but not limited to reasonable attorneys and accounting fees, arising out of or brought by third parties as a result of:
(1). Your breach of these Terms of Use (2.) Your violation of any law or the rights of a third party, or (3). Your use of our Services.
22. Age Requirements: All travelers must be of legal age (18) to book and travel independently or be accompanied by a parent or legal guardian under 18. We are not responsible for any issues arising from age-related restrictions or requirements at the destination or for any unaccompanied minors. By booking with us you acknowledged and agreed to these requirements.
23. CHILDREN’S ONLINE PRIVACY PROTECTION ACT (COPPA) COMPLIANCE
As per COPPA requirements, we do not collect any information from anyone under 13 years of age without verifiable parental consent. Our website, products, and services are all directed at people who are at least 18 and older. If under 18, paternal consent is required.
24. Travel information and tickets: Tickets and other travel information will be sent upon receiving full payment for your service no later than 21 days of purchase. If paper documents are requested when e-documents are available, documents will be delivered to you via USPS approximately 14-21 days prior, and a $40 convenience fee will apply. We will only mail to a physical address, not a PO Box.
25. Copyright protection: This website and its original content, features, and functionality are owned by Bluediamond & Zircon Travel Services LLC, and are protected by copyright laws, you are not allowed to use any information including text, images, and other materials without our permission.

We do not own, have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Assumption of Risk: You acknowledge that travel, including the activities and excursions you are participating in, involves inherent risks, including but not limited to physical or psychological, dangers, injuries, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), Economic or Emotional Loss, and delays, and unforeseen circumstances. You understand that these injuries and outcomes may arise from your own or others' negligence, conditions, related to your travel or vacation, or the condition of the location of the vacation. Nonetheless, you assume all related risks both known and unknown to you regarding your participation in your travel or vacation. You understand and voluntarily assume these risks. You hereby release Bluediamond & Zircon Travel Services LLC its, employees, agents, and affiliates from all liability for any loss, damage, injury, or death that may occur during your trip or participation in the activities, even if caused by the negligence of Bluediamaond & Zircon Travel Services LLC or its employees. You further agree to indemnify and hold harmless Bluediamond & Zircon Travel Services LLC from any claims, lawsuits, or demands arising from participation in the trip activities.
28. Consent for media use: We may take photographs or video (“media”) of our trips, and travelers grant us permission to do so, and for us to use this media for promotional or commercial use without payment of any compensation to the traveler. We will do our best to credit the traveler’s name or organization, however, this is not a binding agreement or obligation on our part and cannot be legally used against us.
29. Right to Suspend /Termination: We reserve the right to immediately suspend or terminate access to our website without prior notice or liability, for any reason whatsoever, including without limitation, violation of the website’s terms of use, posting illegal or harmful content, engaging in abusive or disruptive behavior, failure to comply with the website policies.
These provisions of these Terms of Use, which by their nature should survive termination, include, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
