Introduction
This Services Waiver Agreement ("Agreement") is between Wagging Wheels Inc., referred to as "the Groomer," and the above mentioned client, referred to as "the Client," collectively known as "the Parties." The purpose is to outline the terms of the services and inform the Client of associated risks. By signing, the Client acknowledges and accepts these risks regarding their pet(s).
Services Description
The Groomer agrees to perform grooming services and/or dog walking and/or dog sitting services for the Client's pet(s). These services will be provided at the client location.
Acknowledgment of Risks
Grooming
- The Client acknowledges that the grooming process can be stressful, especially for pets unfamiliar with such services.
- Special risks may arise, including nicks, scratches, quicking of nails, stress-related issues, or allergic reactions to grooming products.
- The Client agrees that the Groomer bears no liability for any accident or injury to the Client's pet during grooming services, except in cases of negligence or failure to provide agreed-upon services safely and competently.
Dog Walking/Dog Sitting
- The Client understands and accepts the inherent risks associated with dog walking/sitting, including but not limited to:
- Injuries to the dog due to accidents, falls, encounters with other animals, or traffic.
- Injuries to the dog walker or others from the dog's actions.
- Possible loss or damage to the dog or the client's property.
Health and Vaccination Assurance
The Client ensures that their pet(s) are in good health. All necessary vaccinations, such as rabies, have been administered and documented by a licensed veterinarian. Proof of vaccination must be provided upon request prior to any services being performed.
Cancellation and Rescheduling Policy
The Client agrees to notify the Groomer at least 24 hours in advance to cancel or reschedule an appointment. Failure to do so may result in a cancellation fee as detailed by the Groomer's standard policy.
Special Instructions and Liability Waiver
The Client can provide specific care instructions for their pet(s). The Groomer will make reasonable efforts to follow these instructions. If the pet's behavior poses a safety threat, instructions may be adjusted accordingly. By signing the Agreement, the Client releases Wagging Wheels Inc. and its staff from liability for any damage, loss, or injury resulting from reasonable care practices, except in cases of negligence or willful misconduct by the Groomer. This waiver ensures that the Client acknowledges and accepts the inherent risks associated with grooming and/or dog walking and/or dog sitting services provided by Wagging Wheels Inc.
Agreement to Perform Services
The services agreed upon under this Agreement are selected voluntarily by the Client, and the Client acknowledges that they have had the opportunity to discuss all concerned details with the Groomer. This Agreement is binding upon both parties, their heirs, assigns, and personal representatives.
Legal Considerations and Jurisdiction
This Agreement shall be governed and construed in accordance with the laws of British Columbia Province, Canada where Wagging Wheels Inc. is located. Any disputes arising under this document will be handled in the courts of said jurisdiction.
Signature
By signing below, the Client confirms that they have read, understood, and agree to the terms of this Waiver Agreement, that they are the legal owner of the pet(s), and that they have the authority to enter into this Agreement.
