WAIVER / RELEASE OF LIABILITY

Please read carefully before signing:

1. I have rented a bicycle from Tour the Shore Bike Rentals, LLC (“Company”), along with lock, lights, helmet (if desired), basket (if desired), and other associated safety equipment.
2. I am knowledgeable as to how to ride a bicycle, and I am medically cleared to do so.
3. I acknowledge that Company officials have provided an orientation on the overall features, operational aspects, and safety protocol for the bicycle(s) I have rented.
4. I am not under the influence of medication, alcohol, marijuana, or drugs, as I understand the same can compromise/impair my ability to safely operate the bicycle and safely interact and/or otherwise respond to traffic signals, other bicycles, pedestrians, and the like. Additionally, for the aforesaid same reasons, I will not operate the bicycle under the influence of medication, alcohol, marijuana, or other drugs.
5. I am aware that if I do take medication or otherwise consume alcohol / marijuana / drugs, I shall immediately stop operating the bicycle, lock the bicycle in a safe location, and secure alternate transportation (at my cost) to my point of destination.
6. Company officials have advised me that during the use of the bicycle, I should not wear headphones, utilize a cell phone, or otherwise engage in any activity which could potentially distract or otherwise compromise my ability to safely interact with other vehicles, traffic, road conditions, emergency service vehicles, etc.
7. I am aware that New Jersey law requires certain individuals to wear a helmet while riding a bicycle. I am furthermore aware that in order to prevent or minimize any head injury, Company officials have encouraged me to wear a helmet and have offered me a helmet to so utilize (even if the prevailing law does not require the same).
8. Company officials have encouraged me to utilize designated bike lanes where the same exist.
9. I am aware that only 1 person can safely ride the same bicycle at the same time, and I will only utilize the bicycle for its intended purposes.
10. I am aware that I cannot ride the bicycle in areas where 2 wheeled vehicles are not permitted.
11. I am aware that some Shore area towns restrict bicycle use on the boardwalks, during certain times of year, and during certain times of the day. I agree to comply with all prevailing municipal regulations in the said regard.
12. I shall comply with, and obey, all traffic signals, road signs, and directions from traffic safety officers. I am aware that I am financially responsible for any fines/penalties resulting from improper use/storage of the bicycle(s).
13. I will utilize the bicycle lights (front and rear) when necessary/appropriate.
14. I am aware that if I wear glasses / contact lenses , I should utilize glasses / contact lenses when riding the bicycle.
15. I am aware that while bicycle riding can be a relaxing experience, the same can, at times, also constitute a vigorous form of exercise. As such, and as is standard, I have consulted with my medical representatives , and I am fit to ride a bicycle.
16. I am aware that the use of a bicycle involves inherent risk and potential hazards – including, but not limited to, the following:
    - Adverse weather, changing road conditions, non-paved riding surfaces, riding surface imperfections, vehicular traffic, pedestrian traffic, bright sunshine, shade, potholes, equipment malfunctions, vehicles entering / exiting parking spaces / driveways, leaves / brush / garbage debris, roadway obstacles, broken glass, compromised tire pressure, bicycle falls, stationary/parked cars, and individuals exiting stationary/parked cars, etc.
17. I am aware that improper use of the bicycle, and/or non-observance of traffic signals / conditions can expose myself (and others) to injury, harm, and damage.
18. I fully accept the inherent risks associated with the use of the bicycle, and I agree not to sue the Company (or its representatives) associated with the operation of the bicycle(s).
19. I hereby agree to release, defend, indemnify, and hold Tour the Shore Bike Rentals, LLC (and their agents, representatives, employees, principals, contractors) harmless from and against any and all losses / liabilities / damages / judgments (including reasonable attorney fees) associated with my use of the rented bicycle, and/or any damages / injuries / harm /liability associated with, or otherwise affiliated with, the same.
20. I am aware that the within Release / Waiver of Liability is binding upon myself, my heirs, assigns, estate, etc.
