Rental Terms and Conditions
- Reservation Date: Waterfront Development Corporation (WDC) needs a minimum of 30 days’ notice prior to a reservation.
- Payment: Full payment is required to reserve the date. All balances must be paid to WDC promptly when invoice is received. Payments may be made by credit card or check (payable to Waterfront Development Corporation).
- Conduct: Renters are responsible for the conduct of participants while at the event building and assume liability for injuries, property damage, theft, or loss during the rental period. Violations may result in denial of future reservation requests.
- Cancellation:
- If cancelled 14 or more days prior to the event, the deposit will be refunded.
- If cancelled less than 14 days prior to the event, the deposit will be forfeited.
- There are no refunds for rainy days.
- Returned Checks: $50 fee for any returned checks
- Setup and Cleanup:
- Events may access the event building 30 minutes in advance of the scheduled event start time for set up; cleanup and load out must be complete no more than 30 minutes after the event end time.
- If an event needs additional time for load in or load out, this would be subject to availability and requires WDC prior approval.
- The event building must be left in the condition it was found, including the kitchen/prep area and restrooms. Food, beverages, equipment, trash, and supplies must be removed immediately after use. Spillage must be cleaned promptly.
Additional Rental Requirements
- All events shall end by the approved time reflected on the invoice and all persons must vacate the event building.
- Late Hours Fee:
- With Prior Approval: $150/hour
- Without Approval: $250/hour
- Liability Insurance: WDC reserves the right to require liability insurance. If required, Certificates of Insurance must name Waterfront Development Corporation and Louisville/Jefferson County Metro Government as additionally insured and be submitted 14 days prior to the event.
- No Smoking: PlayPort is tobacco-free; smoking, vaping, and e-cigarettes are not allowed inside the building, within the play areas of PlayPort, or any surrounding park property.
- Alcohol Restrictions: No alcohol is permitted on the play areas of PlayPort under any circumstances. Alcohol is not permitted within the event building unless the prior express written approval of WDC is given and shall be conditioned upon the undersigned obtaining and maintaining insurance coverage that meets all requirements established by WDC.
- Parking: Free parking. Guests may park in the Aqua Parking Lot or on surrounding streets. Unauthorized parking may result in towing at the owner’s expense. Neither WDC nor Louisville Metro Government shall bear any responsibility or liability for any vehicle or its contents while parked on or near the premises.
- Pets: Pets are not allowed in the event building or on the playground. Service animals are permitted in accordance with ADA guidelines.
- Supervision: For their safety, please supervise children at all times.
- Building Access: A “private event” sign will be set in front of the doors parallel to the playground. It is the responsibility of the renter to control guests access into the building during the duration of their event.
- Lost, Stolen, or Missing Items: WDC is not responsible for any lost, stolen, or missing items.
- Trash/Litter: Trash must be properly disposed of in garbage bags or trash bins. All trash will need to be set outside the back door of the building and liners replaced in trash cans.
- Damage to Building or Property: Renters will be held liable for any damage to the event building or surrounding property.
- Waterfront Development Corporation reserves the right to ask a visitor to leave for inappropriate or offensive behavior.
WAIVER – RELEASE OF LIABILITY - INDEMNIFICATION
1. Acknowledgment of Participation and Responsibility: The undersigned acknowledges that it is voluntarily bringing guests, invitees, participating children, and other third parties to Waterfront Park PlayPort and the PlayPort Event Building (“PlayPort”) for recreational activities and acknowledges those recreational activities come with inherent risks. The undersigned understands that it is solely responsible for the supervision, conduct, and safety of all individuals it brings.
2. Release of Liability: In consideration for being permitted to use PlayPort, the undersigned hereby releases, waives, and holds harmless Waterfront Development Corporation and Louisville/Jefferson County Metro Government, their elected and appointed officials, employees, agents and successors in interest from any and all claims, demands, actions, liabilities, or causes of action arising out of or related to injury, loss, or damage occurring during the undersigned’s use of the facility, whether caused by negligence or otherwise, to the fullest extent permitted by law.
3. Duty of Supervision: The undersigned agrees that:
- It is fully responsible for supervising all participants/guests it brings to Waterfront Park PlayPort and the PlayPort Event Building.
- It will ensure that all participants follow posted rules and instructions from PlayPort Event Building staff.
- It will provide adequate adult supervision at all times.
- It accepts responsibility for the conduct, safety, and behavior of its participants/guests.
4. Indemnification: The undersigned agrees to indemnify and hold harmless Waterfront Development Corporation and Louisville/Jefferson County Metro Government, their elected and appointed officials, employees, agents and successors in interest from any losses, damages, liabilities, or expenses including attorney’s fees from claims brought by guests, invitees, volunteers, participating children, parents/guardians, or any other third parties arising directly or indirectly from the undersigned’s use of PlayPort, its supervision practices, and/or the actions or behavior of its agents, guests, invitees, volunteers, participants, or parents/ guardians. This Hold Harmless and Indemnification Clause shall in no way be limited by any financial responsibility or insurance requirements and shall survive the termination of this Agreement.
