____*I understand that by entering this exhibition images of my artwork may be used by The Butler Art Center for in the promotion of exhibitions shown at The Butler Art Center. I agree to appoint The Butler Art Center as my non-exclusive agent for use of reproductions of my original art works in promotion and marketing purposes. I agree to allow The Butler Art Center to make, or arrange to be made, reproductions of the art provided. The reproduction of the art may be used for the purpose of advertising and promoting exhibitions, or for inclusion in a program for exhibitions.
____*I agree that The Butler Art Center has the final say on the overall appearance of the exhibition.
COPYRIGHT AND LICENSING:
____*I pledge that I have full authority to enter into this Agreement. I understand that The Butler Art Center will acquire only the rights specified in this Agreement and that I will remain the owner of the art.
____*To the best of my knowledge, my art does not infringe on the copyright or trademark of a third party. I also agree to assume all responsibility for all claims resulting from false or inaccurate representations I made in this Agreement or in person to The Butler Art Center that I knew, or had reason to know, to be false or inaccurate.
SALES:
____*I understand that those works for which I have designated a retail price will be available for purchase. I also understand that should sales result, a 30% Member/40% non-member commission will be due to The Butler Art Center, and that Pennsylvania law requires payment of a 6% sales tax.
____*I understand that a commission of the sale of my artwork will be paid to me by The Butler Art Center.
AVAILABILITY OF WORK:
*I understand that my art, selected to be included in the exhibition, may not be withdrawn from the agreed upon exhibition schedule after signing and returning this agreement.
MY RESPONSIBILITIES:
____ *I understand that my art must be suitably prepared for exhibition installation (*wired and ready to hang*), and that all works must be of sufficiently durable materials to withstand necessary handling, and that work not meeting exhibition standards will not be exhibited.
____*I understand that I may not make changes in the art as it appears in the images I have submitted or the title of the art. I understand that I may not make changes to the retail selling price after submitting this agreement.
____*I understand that I must hand-deliver my work to The Butler Art Center, by January 31, 2025
____*I understand that The Butler Art Center is not responsible for holding my work past the pick-up date, that I will risk loss or damage to the artwork, and that I must contact the Art Center if extenuating circumstance prevent me from picking up my work on the specified dates and times.
_____I understand that if I have not picked up my artwork after thirty (30) days from the close of the exhibit or arranged for return shipping, it becomes the property of The Butler Art Center and will be added to The Butler Art Center’s permanent collection.
THE BUTLER ART CENTER’S RESPONSIBILITIES:
____* The Butler Art Center agrees to install exhibition for the dates of the exhibition. The Butler Art Center agrees to print and prepare labels for artwork. The Butler Art Center agrees to process all artwork sales.
____* The Butler Art Center agrees to promote the exhibition in accordance with its customary publicity program which may include any or all or some of the following: promotion in the corresponding website, email blasts, postcards, community websites, press releases to local newspapers and magazines, and reception.
____* The Butler Art Center agrees to provide exhibitor with a commission check for any artwork sold.
LOSS OR DAMAGE TO THE ART:
____*I will not hold The Butler Art Center responsible for any loss or damage to my art. I do not give anyone permission to clean, restore, or repair my art without my consent. I understand that The Butler Art Center does not carry insurance to cover my artwork in the event of damage, and that it is my responsibility to carry coverage for my artwork.
