SWMLS Waiver Eligibility & Certification Statement
As established in the SWMLS Rules and Policies, the individual(s) named on this form may be exempt from MLS Subscription Fees, provided they continuously meet the following conditions:
No Use of SWMLS Services or Content:
The Waiver Applicant does not, and will not:
- Access current listing data, comparable or statistical information/reports, or MLS data feeds.
- Use MLS products or services that are only available to authorized SWMLS subscribers.
- Act as the listing agent on any property filed with SWMLS.
- Be part of a real estate Team where any member is a SWMLS subscriber.
Certification by MLS Participant / Principal Broker
I certify that the Waiver Applicant(s) named on this form are affiliated with my office and meet all the eligibility criteria above. Therefore, they qualify for exemption from MLS Subscription Fees.
I understand and agree to the following:
- A separate signed Waiver Request Form is required for each future applicant.
- I will notify SWMLS within 30 calendar days if any waiver recipient becomes ineligible.
- Upon notification, I will either:
- (i) Sever the agent from my office, or
- (ii) Ensure the agent subscribes to SWMLS within 30 business days.
Completing either (i) or (ii) will not be considered a breach of this agreement and will not trigger penalties.
Penalties for Non-Compliance
- Any violation will result in immediate revocation of the waiver for that individual.
- I agree to pay:
- All applicable MLS Subscription Fees (retroactive to July 1 or the application date, whichever is later)
- A $50 non-compliance fee for each revoked waiver
- Payment is due within 30 calendar days of ineligibility.
- Failure to pay may result in suspension of MLS access for myself and all affiliated subscribers.
Waiver Term & Renewal
- The waiver term aligns with the SWMLS billing cycle: July 1 – June 30.
- If a Waiver Applicant uses any SWMLS services during this period, the waiver is automatically revoked for that individual.
- Renewal applications must be submitted by May 31 each year to avoid interruption.
