Applicant Acknowledgement and Declaration
By submitting this pet application, I/we (being the owner, owner’s agent, or authorised applicant on behalf of the occupant) acknowledge and agree to the following:
1. Legislative Process
This application will be referred to the Owners Corporation or Strata Committee for determination in accordance with the Strata Schemes Management Act 2015 (NSW) and the scheme’s by-laws.
I/We acknowledge that the Owners Corporation may incur administrative and meeting-related costs in processing this application. Any recovery of such costs (if applicable) will only occur where permitted by the Strata Schemes Management Act 2015 (NSW) and any valid and enforceable by-law of the scheme. No fee is presently payable unless otherwise advised in writing in accordance with the Act.
2. Conditions of Keeping the Pet
If approval is granted, I/we agree that:
- The pet will be kept on a leash or transported in an appropriate carrier at all times while on common property and will not be permitted to roam freely, including in gardens, corridors, lobbies, or car parks.
- The pet will not cause harm, pose a threat, or create a nuisance to any resident, visitor, or other animal, including through unreasonable or excessive noise.
- All pet waste, including excreta, will be promptly and properly disposed of. Pet waste (including kitty litter) will not be disposed of via sewerage or water systems.
- The pet will enter and exit the building only via designated access points (including car park floors and lifts, where applicable) and will not be brought through main lobbies or into restricted areas such as pool areas, unless otherwise permitted by the Owners Corporation.
- Approval, if granted, applies only to the pet named in this application. A separate application must be submitted for any additional pet.
- I/We will notify the Owners Corporation in writing if the pet no longer resides at the property.
3. Responsibility and Indemnity
I/We accept full responsibility for the conduct and supervision of the pet at all times.
I/We indemnify the Owners Corporation against any damage to common property or injury caused by the pet or arising from my/our failure to comply with the Act or the by-laws, except to the extent caused or contributed to by the Owners Corporation.
4. Review of Approval
I/We acknowledge that any approval may be reviewed or revoked if the pet causes a nuisance, hazard, or breach of the by-laws or the Strata Schemes Management Act 2015 (NSW).
I/We confirm that the information provided in this application is true and correct.
