  • LIABILITY RELEASE AND INDEMNIFICATION AGREEMENT
    (Applicable to Adult Participants and Parents/Guardians of Minors)

    NOTICE: THIS AGREEMENT AFFECTS LEGAL RIGHTS. CONSULT AN ATTORNEY BEFORE SIGNING.

    1. ASSUMPTION OF INHERENT RISKS


    1.1 Defined Activities


    Participants engage in cycling activities including but not limited to: road riding, trail navigation, group training, and competitive events. Risks include collisions, falls, equipment failure, weather hazards, and terrain-related injuries.

    1.2 Washington Recreational Immunity


    Pac Rats Youth Cycling Club operates under RCW 4.24.210, which grants immunity for unintentional injuries on land open for public recreation without fee. This does not apply to gross negligence or intentional misconduct.

    2. RELEASE OF LIABILITY


    2.1 Adult Participants (18+)


    I hereby release Pac Rats Youth Cycling Club, its officers, and agents from all claims arising from ordinary negligence related to:


    - Route selection and trail maintenance
    - Equipment inspections
    - Volunteer staff supervision.

    2.2 Parental/Guardian Release


    As parent/guardian of {participantName} (Minor), I:


    - Waive my personal claims against the Club for injuries to the Minor
    - Acknowledge Washington law preserves the Minor's right to pursue claims until age 18 + 3 years (RCW 4.16.350).

    3. INDEMNIFICATION PROVISIONS


    3.1 Concurrent Negligence Standard


    Under RCW 4.24.115, I agree to indemnify the Club only for claims arising from:


    - The Minor’s intentional misconduct
    - My failure to disclose medical conditions
    - Equipment modifications made without Club approval.

    3.2 Financial Responsibility


    Includes attorney fees, court costs, and settlements proportional to my/child’s fault. Does not apply to Club’s sole negligence.

    4. MEDICAL AUTHORIZATION


    4.1 Emergency Care


    I authorize emergency medical treatment per RCW 7.70.065, understanding:


    - Providers may treat without consent in life-threatening situations
    - Financial responsibility remains with parent/guardian regardless of waiver.

    5. WASHINGTON-SPECIFIC PROVISIONS


    5.1 Severability Clause


    If any section is invalidated under RCW 4.24.210 or Wagenblast v. Odessa Sch. Dist., remaining terms remain enforceable.

    5.2 Gross Negligence Exclusion


    This waiver does not release claims involving:


    - Willful disregard for safety protocols
    - Intoxicated staff supervision
    - Known unaddressed equipment defects.
