WAIVER & RELEASE OF LIABILITY: All workouts, classes, dance classes and use of equipment with Ngoc Huynh and Knockout shall be at the participant/member’s sole risk. Ngoc Huynh and Knockout, its owners, franchisees, franchisors, employees, contractors, managers and all other related entities and individuals, shall not be liable to the participant/member for any claims, demands, damages or causes of actions due to injury to participant/member’s person or property arising out of or in connection with the use by participant/member of the services, facilities and/or premises of any location with Ngoc Huynh’s and Knockout’s class/event. This waiver and release specifically applies to claims of negligent instruction and/or supervision that may arise as a result of injuries sustained during classes or training programs and the waiver and release applies regardless of whether the claimed injury occurred before, during or after any of the scheduled programs offered with Ngoc Huynh/Knockout. As further consideration for being allowed to participate with Ngoc Huynh’s/Knockout’s activities it is expressly agreed that the use of all premises and facilities (including but not limited to the dance floor area, outdoor areas, back room, parking lots, bathroom, common areas, etc.), without limitation and whether engaging in exercise activities or not, shall be undertaken by the participant/member at his/her/their sole risk. It is agreed that this waiver and release agreement applies to any and all incidents occurring on any operated premises or facilities as well as Ngoc Huynh/Knockout classes/events. This waiver and release agreement specifically applies to, but is not limited to, slip, trip, fall, injury incidents, regardless of the cause. I also certify that I am physically fit and have not been advised otherwise by a qualified medical person to participate in physical activities.
Promotional Release: I understand that during classes and events or related activities, I may be photographed and recorded. I agree to allow photo, video or film likeness of me to be used for any legitimate purpose by Ngoc Huynh/Knockout, their agents, contractors, employees, officials, producers, sponsors, organizers, other participants and/or assigns.
The member also expressly acknowledges that by signing below he or she is relinquishing all rights he or she may have to sue Ngoc Huynh/Knockout for any concerns arising out of the use of its premises, facilities and/or its services.
