Notice: THIS IS A LEGALLY BINDING AGREEMENT. Read this entire document carefully.

The terms (“we,” “us,” “our,” and “The Bridge”) refer to {trainingLocation} and its affiliates and you, the customer, are referred to as (“you,” “You,” “your,” “Your,” and “I”).

By signing this agreement, you give up your right (and the minor you are executing this for, if applicable) to bring a court action to recover compensation or obtain any other remedy for any personal injury or property damage arising out of your participation in our training program (“Program”), and your use of the Bridge facility (“Facility”).

1. Assumption of Risk

As a condition of being allowed to participate in the Program and related activities and your use of the Facility (“Permitted Use”), you or the parent/guardian of the minor are bound by the terms, conditions, and risks set out below. You will not hold us or any affiliated person, including officers, directors, employees, and agents (“Releasees” ), liable for any such risk of illness (including COVID-19), injury, paralysis, death and other losses sustained by you in connection with the Program.

You represent that you or the parent/guardian of the minor are:

1. at least 18 years of age or older;
2. do not currently suffer from any physical or mental condition that would impair your ability to fully participate in the Permitted Use;
3. participating in the Permitted Use voluntarily;
4. understanding that your participation carries with it certain risks, including injury, paralysis, or even death;
5. fully aware of such risks, and you freely assume all risks of participation in the Permitted Use, including any such risk of death, injury and other losses and damages sustained by you arising out of the Permitted Use, even if arising from the negligence of the Releasees or others, and assume full responsibility for your participation for the Permitted Use; and
6. certify that you are physically fit for participation, and you have not been advised against participation by a qualified medical healthcare professional.

 

2. Indemnification

You, and on behalf of your heirs, personal representatives, successors, and (where permitted) assigns, will indemnify and release the Releasees from any liability, claims, actions, losses, or damages from your use of the Facility and participation in the Program. You waive the right to pursue legal action against the Releasees arising directly or indirectly from your participation in the Permitted Use, including claims or damages resulting from death, personal injury, partial or permanent disability or property damage, medical or economic losses, including attorney’s fees, whether caused in whole or in part from any instruction or training hereunder and whether based upon the breach of any express or implied warranty, negligence or under any other legal theory.

3. Disclaimer

You understand that we expressly disclaim all express or implied warranties arising by law, conduct, or otherwise, and any other alleged obligation or liability arising from contract, negligence, tort, or otherwise. Under no circumstances will the Releasees be liable for special, indirect, incidental or consequential damages of any nature whatsoever. You hereby waive and release the Releasees from any claims based on any oral or written statements made prior to or contemporaneous with the release and disclaim any reliance on any such statements.

4. Acknowledgment of Release Terms and Conditions

By signing below, you represent and agree as follows:

1. You have carefully read and fully understand the contents of this release.
2. This release is legally binding and enforceable.
3. The terms and conditions of this release bind you.
4. You are giving up substantial rights by signing it, and you sign it freely and voluntarily without any inducement.
5. You are aware that we will not be collecting any information about your health history, physical condition, or other related details, nor will we be doing any assessment of your training needs.

5. Privacy and Sharing of Information

Your privacy is important to us. All information collected will be kept confidential unless requested by the client or required by law. We follow PIPEDA, PIPA, and, when appropriate, FOIPP regulations for the storage and transmission of your confidential information. Jane is our current electronic record-keeping system. We store your personal information on Jane, which is password-protected, encrypted, and stored on Canadian servers.

6. Media and Photography Consent

The Bridge has a growing media presence on a variety of platforms. We may request permission to upload photos or videos of you to our website or social media platforms. These photos may be posted on, but are not limited to, our website, Instagram, Facebook, and YouTube.

For good and valuable consideration, the receipt and sufficiency of which you hereby acknowledge, you agree as follows:

You consent to be photographed or videoed by us and our agents.
You hereby irrevocably authorize us and our affiliates to copyright, publish, reproduce, exhibit, transmit, broadcast, televise, digitize, display, otherwise use, and permit others to use: (a) your image, likeness, and (b) all photographs of myself (collectively, the “Materials”), in any manner, form, or format whatsoever now or in the future created, including on the Internet, and for any purpose, including, our advertising or promotion including our affiliates, or their services, without further consent from or payment to you.
You understand that all of the materials, reproductions, media, plates, negatives, photocopies, and electronic and digital copies of the Materials are our sole property.
You must not contest the rights or authority granted to us under this agreement. 
You hereby release and discharge us and our employees, licensees, agents, successors, and assigns from any claims, actions, damages, liabilities, costs, or demands arising by reason of defamation, invasion of privacy, right of publicity, copyright infringement, or any other personal or property rights from or related to any use of the Materials. You understand that we are under no obligation to use the Materials.
This document contains the entire agreement between you and us concerning the subject matter of this agreement.

If the above client/athlete is under 18 years of age, a guardian must sign the Training Waiver on their behalf.
