Amenity Access Options
Each household may choose one of the following access methods:

Mobile App Access
You'll receive an email with a download link and activation instructions once approved by management.

Physical Access Fob
One fob per household is provided at no cost. Additional or replacement fobs cost $25 each.
If you select this option, you must pick up your fob at the Grand Opening Event.

Important Notes:
Access will not be available until the Grand Opening.
If multiple household members (18+) want access, each person must complete this form individually with their own signature.
If your household chooses both mobile and fob access, please make sure only one person requests the physical fob to avoid delays.

AGREEMENT TO ASSUME RISKS. I understand that my and my minor children, my guests, and my invitees’ (collectively referred to as the “Releasors”) use of the Amenity Center involves certain risks and dangers of bodily injury, loss or damage, and other hazards arising out of or related to various activities and/or events at or on the Amenity Center that may be caused by my own actions or inactions and the actions or inactions of others. I fully understand that there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time and voluntarily agree to assume all such risks on my own behalf and my Releasors.

WAIVER OF LIABILITY AND RELEASE OF CLAIMS. I agree on my own behalf, my assigns, executors, heirs, and on behalf of my Releasors, to waive all claims and release, indemnify, and hold harmless the Association, its Board Members, its Committee Members, officers, employees, and agents from any and all liability, damage or claim of any kind arising out of or in any way related to my use, entrance, or participation of activities on or near the Amenity Center. This waiver and release shall include, but is not limited to, bodily injury, loss or damage, and other hazards arising out of or related to my use, entrance, and/or participation of activities on or near the Amenity Center that may be caused by my own actions or inactions and the actions or inactions of others. I understand that the Association does not provide any accidental or medical insurance and that I am required to provide my own accidental and medical insurance.

AGREEMENT TO INDEMNIFY. I agree on my own behalf, my assigns, executors, heirs, and on behalf of my own Releasors, to indemnify and hold harmless the Association, its Board Members, its Committee Members, officers, employees, and agents from and against any loss, liability, damage, or costs and attorney’s fees that the Association may incur arising from my use, entrance, and/or participation in activities on or near the Amenity Center. I fully understand that there may be other risk and social and economic loses either not known to me or not readily foreseeable at this time, including losses, theft, costs, and damages incurred as a result of my use, entrance, or participation in activities on or near the Amenity Center. I have carefully read this Agreement and understand that it is intended to constitute a legally binding agreement. I acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Texas, and if any portion of the Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall continue in full force and effect.

DOG PARK RELEASE. I understand that my dog’s or dogs’ attendance at the Amenity Center of the Association, in areas in which dogs are authorized within the Amenity Center, is not without risk to myself my dog(s), and other individuals present on or near the Amenity Center either human or animal. I understand that such risks can include, but are not limited to, risks of physical injury, mental injury, emotional distress, trauma, severe injury, and incapacitation. I fully understand that there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time and voluntarily agree to assume all such risk to my own person, my Releasors, and to my dog. I agree and on my own behalf, my assigns, executors, and heirs, to waive all claims and release, indemnify, and hold harmless the Association, its Board Members, its Committee Members, officers, employees, and agents from any and all liability, damage, or claim of any kind arising out of or in any way related to my use of the Amenity Center of the Association with my dog(s) present. This Agreement shall include, but is not limited to, bodily injury, loss, or damage, and all other hazards arising out of or related to my use of the Amenity Center with my dog(s) present. I understand that the Association does not provide any accidental or medical insurance for humans or canines and that I am required to provide my own accidental, medical, and pet insurance. I hereby agree that I am financially responsible for all such expenses related to any accidents that may or may not be caused by the negligence of others in connection with bringing my dogs on to the Amenity Center of the Association. I agree on my own behalf, my assigns, executors, and heirs, to indemnify and hold harmless the Association, its Board Members, it Committee Members, officers, employees, and agents from and against any loss, liability, damage, or costs, including court costs and attorney’s fees that the Association may incur arising from bringing my dog(s) into the Amenity Center, in areas in which dogs are authorized within the Amenity Center, of the Association. I agree to abide by all rules and regulations of the Association with regard to my dog(s) and my failure to abide by all rules and regulations of the Association or my failure to ensure my dog(s) abide by all rules and regulations of the Association, may result in the removal of my dog(s) and my person and Releasors from the Amenity Center. I have carefully read this Agreement and understand that it is intended to constitute a legally binding agreement. I acknowledge that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Texas.

SWIM RELEASE. I, on my own behalf and on behalf of my Releasors, acknowledge and agree to allow myself and my Releasors to swim in the Amenity Center under my own supervision. I understand that my participation or the participation of myself and my Releasors subjects myself and my Releasors to the possibility of physical illness or injury (medical, physical, minimal, serious, catastrophic, drowning, and/or death). I acknowledge and understand that I will be responsible for any and all medical and related bills that may be incurred on behalf of myself and my Releasors, that may be incurred on their behalf in which they may sustain while swimming or traveling to and from the Amenity Center. I further acknowledge that the Association may not have lifeguards on duty and is not responsible for maintaining the safety of myself and my Releasors. Further, I acknowledge on my own behalf and on behalf of my Releasors, that we shall follow all instructions of staff, if any, or any posted rules, which may help to avoid injury by slipping, falling, drowning, running, etc. and my own failure of the failure of my Releasors to follow any rules or instructions of the Association or its staff may result in my and my Releasors removal from the Amenity Center.

APPEARANCE RELEASE. I understand that as a visitor, attendant, or user of the Amenity Center, I and/or my Releasors may be included in videotapes, photographs, DVDs, Podcasts, Videocasts, and other forms of digital media taken to promote the Amenity Center or the Association. Therefore, without reservation of limitations, I, on my own behalf and on behalf of my Releasors, hereby assign, transfer and grant to the Association, the affiliates of the Association, and the respective directors, officers, representatives, members, agents, and employees of proceeding parties, its successors, assignees, licensees, sponsors, any television networks, and all other commercial exhibitors the exclusive right to photograph and/or videotape myself and my Releasors, and to utilize such videotapes and photographs and myself and my Releasors’ name, face, likeness, voice, and appearance as part of my and my Releasors’ use of the Amenity Center, in advertising and promoting the Amenity Center for any purpose whatsoever and without reservations or limitations. I further understand that neither the Association, the affiliates of the Association, and the respective directors, officers, representatives, members, agents, and employees of proceeding parties nor any third party is under any obligation to exercise any of the foregoing rights, licenses, and privileges. I, on my own behalf and on behalf of my Releasors, waive any right to inspect or approve the copies of any promotional materials related thereto.

AMENITY CENTER RULES. I understand that the Association has established or will establish rules and regulations, which are subject to amendment and/or change, pertaining to the conduct, behavior, and activities of the Amenity Center, by which I, on my own behalf, and on behalf of my Releasors agree to abide by while in the Amenity Center and that I, on my own behalf, and on behalf of my Releasors, will be responsible for my/his/her/their failure to abide by those rules and regulations. I understand that I have received, read, and understand the Amenity Center rules and regulations and understand my failure or the failure of my Releasors’ failure to abide by the Amenity Center rules may result in my, his, her, their removal from the Amenity Center. I further acknowledge and understand that if I or my Releasors break or damage any property owned by the Association as a result of my or my Releasors’ direct or indirect behavior, I hereby agree to pay for its repair or replacement in its entirety at the sole discretion of the Association.

MISCELLANEOUS. This Agreement constitutes the entire agreement of the Parties with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Agreement or the application thereof to any party or circumstance is held invalid, illegal, or unenforceable to any extent, then the remaining terms and provisions and their application to other parties or circumstances will not be affected thereby and will be enforced to the greatest extent permitted by law. This Agreement is binding on and will inure to the benefit of the Associations and its Owners and their respective successors and assigns. All matters arising out of or related to this Agreement will be governed by and construed in accordance with the internal laws of the State of Texas, excluding any conflicts-of-laws rule or principles that might refer to the governance or the construction of this Agreement to the laws of another jurisdiction.

I have read this WAIVER OF LIABILITY, INDEMNITY, AND RELEASE, and have signed it freely without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this Agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
