    This agreement expires at the end of the current camping season
  • Any articles, including RVs, to be sold or gifted on the property are subject to Windmill Point Park & Campground Exclusive Marketing Agreement.  Please submit the completed form to Windmill Point Park & Campground for review and approval.  Not all articles will be considered for sale. 

    Sale of any article on Park property, without prior approval, will result in penalty fees and immediate eviction without refund.

    Windmill Point Park & Campground will not sell any articles during the closed season, from October 16 to April 30.

  • TERMS AND CONDITIONS


    1) The Exclusive Marketing Agreement must be completed and signed prior to any gifting, marketing and advertising. RVs older than 10 years are usually not considered but Windmill Point Park & Campground reserves the right to accept or decline marketing and selling any recreational vehicle and/or articles.  THIS IS NOT A REAL ESTATE TRANSACTION.  THIS IS A PRIVATE SALE BETWEEN A BUYER AND A SELLER OF A RECREATIONAL VERHICLE AND/OR OTHER ARTICLES ON A CAMPSITE.

    Windmill Point Park & Campground reserves FIRST RIGHT TO OFFER or FIRST RIGHT TO PURCHASE all RVs and articles for sale. If the Seller changes the terms of the Exclusive Marketing Agreement, Windmill Point Park will have have FIRST RIGHT TO OFFER or FIRST RIGHT TO PURCHASE under the new terms.

    If the RV and other articles are found to be marketed, advertised and/or sold outside of the Exclusive Marketing Agreement, the Licence of Occupation may be deemed terminated, as per Windmill Point Park & Campground.

    2) The OCCUPANT(S) may request to transfer their RV and/or articles on the site directly to a family member without selling through Windmill Point Park & Campground and without a commission fee. If approved by Windmill Point Park & Campground, the new OCCUPANT(S) will sign a new Licence of Occupation. There will be an Administrative Fee of $2,000 (plus HST) in this instance. Eligible family members include spouses, children and grandchildren, parents and grandparents, and siblings. In all other ways this transfer is to follow the same rules as a sale.

    3) The seller is responsible for researching and exercising due diligence in setting the selling price for the RV and any articles for sale on the site.  Windmill Point Park & Campground reserves the right to accept or decline marketing or selling any recreational vehicles and/or articles if the selling price is deemed unreasonable or unjustified.

    4) If the selling price is modified in any way, outside of negotiations with a potential Buyer, a new Exclusive Marketing Agreement must be completed.  The latest Exclusive Marketing Agreement will be referenced at all times for pricing and details.

    4) RV sales with or without additional articles, are subject to $250.00 (two hundred and fifty dollars)  administration fee plus tax and $250.00 (two hundred and fifty dollars) advertising fee plus tax.  These are payable PRIOR to any marketing and are non-refundable.

    5) Marketing and advertising includes

    ✓ Creating the listing information and hand out to pass on to potential Buyers

    ✓ Posting the listing information to our existing Seasonal Campers first.

    ✓ Posting the listing information on our website and social media pages.

    6) Enhanced and/or additional listings performed by Windmill Point Park & Campground will be at the expense of the Seller if requested by the Seller.

    7) Additional advertising is at the expense of the Seller.

    8) A 15% commission fee + tax will be deducted from the selling price prior to the seller receiving payment for the RV.

    9) For articles sold on the site, without an RV, the listing and advertizing fee will be waived.  The commission fee will be 15% of the sale price + HST or $1000.00 +HST, whichever is lesser. 

    10) Outstanding accounts and monies owing must be paid in full. Seasonal camping fees, hydro, and other associated invoices must be paid when due while the RV is for sale.

    11) All other outstanding fees owed by the seller to Windmill Point Park & Campground, with prior authorization, will be deducted from the selling price prior to the seller receiving payment for the RV.

    12) You must supply Windmill Point Park with functioning keys and we will accompany potential Buyers to view your RV.

    13) You must supply Windmill Point Park with a copy of a valid ownership/vehicle registration in YOUR name prior to any marketing.

    14) You must continue to provide insurance for the RV until the day the sale is complete.

    15) You must provide a USED VEHICLE INFORMATION PACKAGE (UVIP), issued the the Ministry of Transportation prior to listing your RV, at your own cost. This can be ordered through Service Ontario.

    16) The seller is responsible and will arrange for a Propane Inspection Certificate, provide by a reputable Class G2 Propane Inspector as a condition of marketing the RV and at the seller's cost. A valid propane inspection certificate must be provided at the time of the sale and prior to closing date. The inspection includes:

    ✓ Checking for propane leaks

    ✓ Start up of all appliances

    ✓ Check all appliances are in working order and will advise what is required & cost to fix if deemed necessary & not in working order.

    17) Viewing by potential Buyers is private. You are expected to vacate the RV and site during a viewing. We do our best to give you prior notification that we will be coming with potential Buyers. Please keep your RV and site in a state of readiness and be prepared to go for a short walk when we arrive.

    18) Offers to purchase will be accepted by text or email so there is a date and time stamp for any offers, counteroffers, refusals, acceptance or withdrawls.  Offers will be accepted until until an agreement is reached between the buyer and the seller.  In the event of multiple offers, offers will continue to be accepted until the highest offer is reached and both the buyer and sellers are in agreement.

    19) The original valid ownership/vehicle registration is required at the time of an offer. The ownership must be signed by all registered owners at the time of closing. A photocopy of the ownership must be given to Windmill Point Park prior to marketing the RV.

    20) Windmill Point Park requires the Buyers to bring a certified cheque, bank draft or cash for payment of the RV. If said RV is sold and is to be removed from the Park property, all fees and commissions must be paid in advance of removal.

    21) The amount payable to the seller equals the Selling Amount less the 15% commission fee + tax and any other outstanding balances owing + or – the campsite account balance.

    22) Partial season fees for mid-season departures are pro-rated based on the closing date. For example, if the Park is open for 20 weeks and the closing date is 6 weeks after opening, the buyer will pay for 14 weeks/20 weeks x site fees and the seller will pay for 6 weeks/20 weeks x site fees.

    23) On closing day, any extra keys, gate cards and original RV ownership are required to be submitted. The RV Bill of Sale and will also be signed by both the Seller and Buyer.

    24) All articles not sold by Windmill Point Park & Campground may not be used at the Campground for a minimum of 1 year from the time it is removed from Windmill Point Park.

    25) Windmill Point Park & Campground is committed to ensuring an enjoyable summer vacation destination for all campers and reserves the right to approve of all potential Buyers.

    I hereby authorize and grant permission to 582027 Ontario Limited O/A Windmill Point Park Inc., to advertise and show the RV and all other articles for sale and to receive and present offers.BY SIGNING AND SUBMITTING THIS AGREEMENT, I AGREE TO ALL TERMS AND CONDITIONS AS SET FORTH.
