I , the abovenamed player / team official (“the Participant”) hereby confirm that:

1. I have carefully read this Deed, Official Rules and Codes of Conduct;

2. I am satisfied with the terms of this Deed, Official Rules and Codes of Conduct; 3. I understand the terms of the Deed, Official Rules and Codes of Conduct;

4. by signing this Deed, I accept the offer made by MD Events(NQ) Pty Ltd A.C.N. 677 040 452 (“the Organiser”) to participate in the Mendi9s 2025 Competition (“the Event”);

5. my participation in the Event and below signature confirms my acceptance of the terms contained in this Deed and I agree to be bound by the conditions below;

6. I will adhere to the Code of Conduct;

7. I will play the game / ensure that my team plays the game(as the case may be) in accordance with the Townsville Mendi 9s Official Rules;

8. I authorise the Organiser to take my photograph(s) and/or video(s) during the Event;

9. I grant the Organiser consent to use my name, photograph(s)and/or video(s) on the Organiser’s (and its related and affiliate entities)social media platforms;

10. I consent to the Organiser to edit, alter, copy or distribute the photograph(s) and/or video(s) for social media advertising and marketing;

11. the photograph(s) and/or video(s) belong to the Organiser;

12. I understand that I will not receive any monetary compensation for any photograph(s) and/or video(s);

13. I authorise for any refunds of registration fees and/or prize money to be paid into the bank account nominated by the team manager from time-to-time;

14. in consideration for, and as a condition to my / my team’s participation in the Event, I: a) acknowledge and accept that participation in the Event may involve the risk of injury, serious physical and/or mental injury or death from various causes including but not limited to: dehydration, over-exertion,equipment failure and accidents or the act or omission of other participants in the Event and third parties; b) acknowledge that there may be no or inadequate facilities for treatment or transport of a participant if they are injured; c) acknowledge that participation in the Event is at my own risk; d) acknowledge that I am fully aware of the risks associated with participating in the Event and I voluntarily assume all of those risks on my behalf; e) confirm that I have disclosed to the Organiser any medical condition that may affect the ability to safely participate in the Event; f) confirm that I have not been advised by any health professional that I or the participant I represent should exclude, restrict or avoid any types of physical activity or exercise due to personal health risks; g) declare that I am or the participant that I represent is physically fit and have trained sufficiently to participate and compete in the Event; h) agree and undertake to adhere to all Event rules and conditions and I acknowledge and understand that I must follow the Event’s rules and obey all directions and instructions given by the Organiser, Evento fficials and/or volunteers; i) acknowledge that personal property may be lost, damaged or stolen and I agree to release and indemnify the Organiser, its directors,authorised representatives, servants, agents and volunteers from any such loss caused by third parties; j) to the extent permitted by law :- (i) I release the Organiser, its directors,agents, employees, and volunteers from any,claim, right or cause of action which may be made by me or my servants or agents in respect of any disease, illness, injury, loss, damage to person or property or death caused by the participation in the Event including but not limited to liability arising for negligence and/or breach of contract; and (ii) I shall at all times after the Event indemnify and keep indemnified the Organiser, its directors, agents, employees, and volunteers from any and all claims, liability and damages, arising from participation in the Event whether made directly or indirectly including in respect of all costs, charges or expenses which may be incurred by the Organiser and/or its servants or agents in defending or settling such actions, suits, claims,demands and costs; and k) acknowledge that to the extent permitted by law, the Organiser excludes liability for: (i) death; (ii) personal injury; (iii) the contraction, aggravation, acceleration of a disease; and (iv) the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs in relation to an individualor community: (A) that is or may be harmful or disadvantageous to an individual or community; or (B) that may result in the harm or disadvantage to an individual or community, arising out of any failure by the Organisers, its directors,agents, employees, authorised representatives, servants and volunteers to comply with any consumer guarantees applying to the Event.
