    Limited Warranty Policy
  •  At Castaway Customs Southern Atlantic Coast, we are committed to delivering superior SeaDek products and installations. This Limited Warranty ("Warranty") outlines the coverage provided to the original purchaser ("Purchaser") for SeaDek products ("Product(s)") installed by Castaway Customs.

    What Is Covered

    This Warranty covers defects in materials and workmanship, specifically:

    • Adhesion: Ensures the Product adheres properly to non-porous surfaces such as fiberglass and aluminum.
    • Light Amplification: Addresses potential damage due to the magnifying effect of reflectedsunlight.
    • Delamination: The separation of the foam lamination. This is the separation between the layersof foam.
    • Pits: Small holes in the material that are present from the supplier of the raw materials providedfrom SeaDek.
    • Damage from Production: Damage of the product that was caused during the process ofproducing the product
    • Production Errors: Mistakes or issues that occur during the production of the product. CAD Errors - Errors stemming from the initial drawing or nesting of the covered product. NOTE: If the errors is found on the drawing and the drawing has been approved by the customer it WILL NOT be covered.
    • Logistics Errors: The shipment of the Product to the wrong address, the carrier losing theshipment in transit, or damage caused by the carrier’s mishandling of the Product.
    • Excessive Fading: The premature and/or excessive lightening of the color of the Product. Due tothe nature of the Product, the Product may fade over time. Excessive fading is outside of thescope of what would be considered normal fading. Material Degradation - This is thedeterioration of material when exposed to an environment resulting in the loss of the material.
    • Color Bleeding - When the Product gets wet, and the dye is extracted from the Product.

  • Warranty Period

    The Warranty is valid for five (5) years/Tiered from the date of installation ("Warranty Period"). This Warranty is non-transferable and applies only to the original Purchaser. For projects being installed by Castaway Customs, your warranty starts on the day of installation. For projects being shipped to customers for a self-installation, the warranty starts the day the project is shipped.

    To be eligible for coverage under Warranty, all claims must be fully documented with clear photographs and submitted to Castaway Customs Southern Atlantic Coast no later than the final day of the Warranty Period (and within 7 days of identifying there is an issue with the product Failure to file a claim within the Warranty Period will result in the forfeiture of any rights to a Warranty claim, and the Warranty will be considered void for the affected issue.

    *For replacement material-please note that there can be slight changes in the shade of a color. We Can Not guarantee that any replacement material will be a 100% match. That color guarantee match is only

    1. Adhesion Coverage

    Coverage Limits: This Warranty provides coverage for adhesion damage on a one-time basis during the Warranty Period, and only if a Certified Installer completed the installation:

    • First 24 months: 100% of the material cost for repaired or replaced pad(s) will be covered, provided claims are submitted within this timeframe. Labor is Covered* Months 25-36: 25% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost is not included*
    • Months 37-48: 15% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost is not included*
    • Months 49-60: 10% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost is not included*

    2. Light Amplification Coverage

    Explanation of Light Amplification- The SeaDek Product is designed to withstand typical environmental conditions, but it may distort or fade if exposed to temperatures exceeding 180°F. Reflected sunlight from adjacent surfaces, such as polished metal, glass, or gelcoat, can create a magnifying effect that intensifies heat and causes damage beyond the Product's designed tolerance.

  • This Warranty covers instances of Light Amplification damage only when:

    1. Preventative Maintenance: Proper care and preventative measures were implemented to mitigate risks (as described in the Mitigation Tactics section below

    2. Identified Areas: The affected area had been identified and addressed with an appropriate Mitigation Tactic that was properly and continuously maintained.

    3. Unexpected Causes: The damage occurred due to an unforeseen object, surface, or feature of the boat that was not previously documented in SeaDek's Light Amplification guidelines.

     

    Coverage Limits: This Warranty provides coverage for Light Amplification damage on a one-time basis during the Warranty Period:

    • First 15 months: 100% of the material cost for repaired or replaced pad(s) will be covered, provided claims are submitted within this timeframe. *Labor cost are not included*
    • Months 16-36: 25% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost are not included*
    • Months 37-48: 15% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost are not included*
    • Months 49-60: 10% of the material cost for repaired or replaced pad(s) will be covered, calculated using current Certified Dealer pricing at the time of the claim. *Labor cost are not included*

    Mitigation Tactics: SeaDek has developed practical recommendations to minimize the risk of Light Amplification damage. These include:

    • Identifying and documenting reflective or heat-intensifying surfaces near the installation area.
    • Using mitigation tools, such as protective covers, towels, rubber cover pads or light reflecting pads or diffusion pads, to shield vulnerable areas.
    • Following SeaDek's installation and maintenance guidelines to ensure optimal performance.

    Failure to implement and maintain recommended Mitigation Tactics for identified problem areas will void this portion of the Warranty.

    This coverage applies only once during the Warranty Period. Any subsequent Light Amplification damage, or damage resulting from failure to apply recommended Mitigation Tactics, will not be covered. For detailed guidance on prevention, please refer to the "Light Amplification Prevention Addendum" provided by SeaDek.

  • 3. Additional Warranty Coverage- Manufacture Warranty By SeaDek

    *These items below are covered for 3 years (material and labor included)

    • Delamination
    • Pits
    • Excessive Fading

    4. Exclusions

    This Warranty does not cover:

    • Normal Wear and Tear: Scuffs, scratches, stains, or other cosmetic issues from regular use.
    • Improper Maintenance: Damage from harsh chemicals, abrasive cleaning methods, or neglect.
    • Unauthorized Modifications: Alterations or repairs not performed or authorized by Castaway
    • Environmental Factors: Damage from light amplification due to unaddressed reflective surfaces, improper storage, exposure to temperatures exceeding 180°F (82°C) or acts of God.
    • Use of Black as Top Color: Due to its heat-absorbing properties, black as a top color is not covered under this Warranty.

    5. Warranty Claim Procedure

    To initiate a warranty claim:

    1. Notification: Contact Castaway Customs within seven (7) days of discovering the defect.

    2.Documentation: Provide proof of purchase, a detailed description of the defect, and multiple photographs of the affected area.

    3. Inspection: Allow Castaway Customs to inspect the Product to determine the validity of the claim, if Castaway Customs deems it is necessary

  • 6. Remedies

    If a defect is confirmed, Castaway Customs will at it's discretion:

    1. Replace the defective portion of the product with as close to identical product as possible.

    **The coloring of material may change slightly from batch to batch. We will provide replacement pads with the closest matching solution, but the colors are not guaranteed to match, and this is not covered under warranty.**

     

    7. Limitation of Liability

    Castaway Customs' liability under this Warranty is limited to the remedies stated above. We are not responsible for any incidental, indirect, or consequential damages.

    8. Care and Maintenance

    To ensure the longevity and performance of your SeaDek Product:

    • Regular Cleaning: Use mild soap and water or recommended cleaners.
    • Avoid Harsh Chemicals: Do not use abrasive tools, power washers, or harsh chemicals.
    • Protect from Prolonged UV Exposure: Use covers or shading when the boat is not in use.

    9. Governing Law

    This Warranty is governed by the laws of the State of Florida (Castaway Customs headquarters Any disputes arising from this Warranty shall be resolved in the state or federal courts located in St. Johns County, Florida.

    10. Entire Agreement

    This document constitutes the entire Warranty agreement between Castaway Customs and the Purchaser, superseding any prior agreements or representations.

    12. Miscellaneous Provisions

    Castaway Customs total liability under this Warranty shall not exceed the replacement value of the covered product.

    In no event will Castaway Customs be liable under any theory of liability or be obligated for consequential or indirect damages of any type or nature.

    Consequential or Indirect Damage - damages from an indirect result of an event or incident. This can include property damage, personal injury, or loss of use.

  • Warranty Disclaimers

    Except for the provisions set forth in this Warranty, no agent, employee, subcontractor, or representative of Castaway Customs has any authority to bind Castaway Customs to any other affirmation, representation, or warranty concerning the product sold to the Buyer. Unless an affirmation, representation or warranty is specifically included in this Warranty, it shall not be enforceable by the Buyer.

    Acknowledgement of Buyer

    By purchasing a Hyperform/SeaDek product, the Buyer accepts this Warranty and acknowledges the following: The Buyer has read and understands and agrees to the terms and limitations of this Warranty. The Buyer has been provided with sufficient opportunity to consult with an independent legal counsel regarding this Warranty and the limitations hereof, and that Buyer has not relied upon any statements or representations of Hyperform for Buyer's understanding or interpretation of any provisions hereof.

    By signing this Agreement, I acknowledge that I have read, and understand all the information provided in this Warranty.
