This Liability Waiver and Release of Claims ("Agreement") is entered into by the undersigned individual ("Participant") in favor of Fresh Air Inflatables ("Company") in consideration of the opportunity to participate in activities involving the use of inflatable bounce houses and related equipment ("Equipment") at a public or private event.
1. Acknowledgment of Risks
By signing this Agreement, the Participant acknowledges and understands that the use of inflatable equipment involves inherent risks, including but not limited to physical injury, property damage, or other unforeseeable risks.
2. Assumption of Risk
The Participant voluntarily assumes all risks associated with participating in bounce house activities, including but not limited to injuries resulting from falls, collisions, improper use, or equipment malfunction.
3. Release of Liability
The Participant hereby releases, waives, and discharges Fresh Air Inflatables, its owners, employees, agents, and affiliates from any and all claims or causes of action arising out of or related to the use of the Equipment, including claims for personal injury, property damage, or wrongful death, regardless of cause or negligence.
4. Indemnification
The Participant agrees to indemnify and hold harmless Fresh Air Inflatables from all claims, damages, losses, and expenses (including attorney fees) resulting from their participation or the participation of any minor under their care.
5. Rules and Safety
The Participant agrees to abide by all safety rules provided by Fresh Air Inflatables, including but not limited to:
No sharp objects, food, or drinks in the bounce house.
No exceeding weight or occupancy limits.
No rough play or flips.
Adult supervision of children is required at all times.
6. Parental/Guardian Responsibility (if applicable)
If the Participant is signing on behalf of a minor, they affirm that they are the parent or legal guardian of the child and accept full responsibility for the child's participation and safety. The same assumptions of risk, release of liability, and indemnification apply to the child.
7. Severability
If any portion of this Agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.
8. Agreement to Terms
By signing electronically or in person, the Participant affirms they have read, understood, and voluntarily agreed to the terms of this Liability Waiver and Release of Claims.
