  • SECTION F: DECLARATION

  • Vendor Compliance, Quality Assurance and Product Acceptance Requirements
    1. Regulatory Compliance
    The Vendor shall comply at all times with all applicable laws, regulations, standards, guidelines, circulars, and directives issued by the State of Qatar and its competent authorities relating to food safety, food quality, importation, manufacturing, storage, transportation, distribution, packaging, labeling, occupational health and safety, and environmental protection.

    The Vendor shall maintain valid licenses, permits, registrations, certifications, and approvals required for the lawful supply of goods and services throughout the duration of the contract.


    2. Product Quality and Food Safety
    The Vendor warrants that all products supplied:

    Are genuine, safe, wholesome, and fit for their intended purpose.
    Comply with all applicable food safety and quality requirements.
    Conform to the agreed specifications, approved samples, and contractual requirements.
    Are free from contamination, foreign materials, infestation, adulteration, defects, damage, spoilage, or deterioration.
    Are manufactured, handled, stored, and transported in accordance with recognized food safety standards and best industry practices.
    The Vendor shall provide, upon request, supporting documentation including but not limited to:

    • Food Grade Certificates
    • Certificates of Analysis (COA)
    • Health Certificates
    • Halal Certificates (where applicable)
    • Product Specifications
    • Country of Origin Certificates
    • Material Safety Data Sheets (MSDS), where applicable
    • Any other compliance documents required by the Purchaser or regulatory authorities

    3. Minimum Shelf-Life Requirement
    All food and beverage products supplied shall have a minimum remaining shelf life of fifty percent (50%) of the manufacturer's declared shelf life at the time of delivery, unless otherwise approved in writing by the Purchaser.

    The Purchaser reserves the right to reject any products delivered with insufficient remaining shelf life.


    4. Inspection and Right of Rejection
    The Purchaser reserves the unrestricted right to inspect, test, sample, verify, and assess any products supplied under this Tender and any associated facilities, processes, records, or documentation of the Vendor.

    The Purchaser may reject, in whole or in part, any products that:

    Do not meet agreed specifications or approved samples;
    Are defective, damaged, contaminated, adulterated, or unsafe;
    Are improperly packaged, labeled, stored, or transported;
    Have insufficient remaining shelf life;
    Fail to comply with applicable laws, regulations, or food safety requirements;
    Do not meet the Purchaser's quality standards or operational requirements.
    Any rejected products shall be removed and replaced by the Vendor at its sole cost and risk within the timeframe specified by the Purchaser.


    5. Product Acceptance
    Acceptance of goods upon delivery shall not constitute final acceptance by the Purchaser.

    The Purchaser reserves the right to subsequently reject products upon discovery of latent defects, contamination, food safety concerns, quality issues, regulatory non-compliance, or any other deficiencies that were not reasonably identifiable during initial inspection.


    6. Product Recall and Regulatory Notification
    The Vendor shall immediately notify the Purchaser of:

    Any product recall;
    Food safety incident;
    Regulatory investigation;
    Warning notice;
    Suspension or cancellation of licenses;
    Any event that may impact product safety, quality, legality, or supply continuity.

    7. Indemnity and Liability
    The Vendor shall be fully responsible for and shall indemnify, defend, and hold harmless the Purchaser, its affiliates, directors, officers, employees, and representatives against any claims, losses, damages, penalties, fines, recalls, costs, expenses, liabilities, or regulatory actions arising from:

    Non-compliance with applicable laws and regulations;
    Supply of defective, unsafe, contaminated, or non-conforming products;
    Breach of food safety requirements;
    Failure to meet contractual obligations.

    8. Non-Compliance
    Failure to comply with any provision of this requirement may result in:

    Rejection of products;
    Suspension of deliveries;
    Disqualification from the tender process;
    Contract termination;
    Recovery of all associated costs and damages;
    Any other remedies available under applicable law.
    Submission of a Tender shall constitute the Vendor's full acceptance of these requirements and confirmation that all information and documents provided are accurate, complete, and valid.
