Big Bank's Football Legends Camp
WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
(For participation in Mikey’s League programming and associated events)

DEFINITIONS
For purposes of this Agreement:

“Participant” refers to the individual engaging in the Activity, whether a minor or an adult.
“Signer” refers to the individual executing this Agreement, either as the Participant or as the Participant’s parent, legal guardian, or authorized representative.

ACCIDENT WAIVER AND RELEASE OF LIABILITY
I, the Signer, hereby acknowledge and agree that participation in Big Bank’s Football Legends Camp, including all football-related drills, games, physical activities, training, educational sessions, autograph/photo opportunities, and any associated travel or social activities (collectively, the “Activity”), involves inherent risks of injury, illness, and property loss.

These risks include, but are not limited to: slips, falls, sprains, fractures, concussions, head or spinal injuries, emotional distress, property damage, and exposure to contagious diseases such as COVID-19.

I expressly and voluntarily assume all risks associated with participation in the Activity, including those arising from:

The negligence or carelessness of any of the Releasees (defined below),
Dangerous or defective equipment, facilities, or property,
Conditions of the field, weather, temperature, or hydration,
Actions or inactions of other participants, volunteers, or spectators.
In consideration for being permitted to participate, I agree, on behalf of myself, the Participant (if applicable), and our heirs, executors, administrators, successors, and assigns, to:

WAIVE, RELEASE, AND DISCHARGE from any and all liability for personal injury, illness, death, property damage, or other loss—whether caused by negligence or otherwise—the following Releasees:
Mikey’s League, Inc., Michael Bankston, the National Football League Players Association (NFLPA), The National Football League Players Association (Phoenix Chapter), the Bankston Mattox Foundation, their officers, directors, agents, employees, contractors, volunteers, sponsors, partners, venue operators, and representatives.
INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the above Releasees for any claims, demands, losses, or expenses (including attorney’s fees) that may arise out of or in connection with participation in this Activity.

ASSUMPTION OF RISK
I understand and acknowledge that:

This Activity includes flag football and related activities, which may test physical and mental limits.
Risks include environmental hazards, inadequate safety equipment, or misjudgments by instructors or other participants.
These risks are present for participants and volunteers alike.
Participation is voluntary, and I freely and knowingly assume all such risks.

HEALTH AND SAFETY
I certify that the Participant is physically fit, has sufficiently prepared for participation, and has not been advised by a medical professional to avoid such activities. I agree to:

Comply with all safety instructions provided by camp staff and organizers.
Immediately report any unsafe behavior or conditions.
Consent to receive emergency medical care if needed and accept full responsibility for any related medical expenses.

INFECTIOUS DISEASE WAIVER
I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I (or the Participant) may be exposed to or infected by COVID-19 during this Activity. I understand such exposure could result in personal injury, illness, or death. I accept full responsibility for all risks related to exposure, even if arising from the negligence of the Releasees.

PHOTO/VIDEO RELEASE
I grant permission for the Participant’s image, likeness, or voice to be recorded and used by the organizers, partners, or media for promotional or educational purposes, without compensation or right of approval.

GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, and any dispute shall be resolved exclusively in the courts located in Maricopa County, Arizona.

ACKNOWLEDGMENT AND SIGNATURE
I CERTIFY THAT I HAVE READ THIS DOCUMENT, FULLY UNDERSTAND ITS CONTENT, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR ORDINARY NEGLIGENCE.

I FURTHER CERTIFY THAT:

I am either the Participant named below, or
I am the parent, legal guardian, or authorized representative of the Participant and have full legal authority to sign this agreement on their behalf.
I affirm that I am not under any legal disabilities or restrictions that would prevent me from being legally bound by this agreement, and that all information provided is true and accurate.
