    Fonda Park Vendor Rules & Regulations for Village-Hosted Events

    The Village of Fonda welcomes vendors to participate in events at Fonda Park. The following rules and regulations must be followed to ensure a successful and enjoyable experience for all. Failure to comply may result in removal from the event and denial of future participation.

    APPLICATION & REGISTRATION

    • Registration is not guaranteed—acceptance is at the sole discretion of the Village of Fonda.
    • Vendors must register at least one month before the event to allow for proper logistical planning and event marketing. Ideally, vendors should register two to three months in advance to secure a spot. Late registrations are strongly discouraged but may be considered at the Village of Fonda's discretion, with no guarantee of acceptance.
    • Space location requests are not honored—event organizers make assignments.
    • Payment is required to reserve space—unpaid applications will not be processed.
    • Vendors must provide all necessary permits, including a valid NYS Department of Health Permit (if applicable).
    • Vendors must submit proof of liability insurance and any required insurance certificates, naming the Village of Fonda as an additional insured.
    • The Village may limit duplicate vendor types, but exclusivity is not guaranteed.


    SETUP & BREAKDOWN

    • Vendors may begin loading in and setting up one hour before the event starts. All vendors must be fully operational and ready to serve guests no later than 30 minutes before the event begins.
    • Vendors must stay for the entire event—no early breakdown or departure is allowed.
    • No packing or dismantling of booths is allowed before the event ends.
    • Vendors must set up within the designated time frame provided by event organizers.
    • Late arrivals may be denied entry, and no refunds will be issued.
    • After unloading, vendors must park in designated areas. Vehicles are not permitted to remain inside the vendor area unless authorized.

     

    OPERATIONAL GUIDELINES

    • Vendors are responsible for keeping their area clean and debris-free during and after the event.
    • All garbage and waste must be disposed of in designated receptacles. If the event bins are full, vendors must remove their own trash.
    • All displays, tables, and merchandise must be kept within the assigned space and not obstruct walkways, emergency access routes, or other vendors. 
    • Vendors must comply with all local, state, and federal regulations related to their business.
    • Vendors must provide their tents, tables, chairs, and necessary equipment.
    • Tents and canopies must be properly secured with weights. Depending on park conditions, staking into the ground may not be permitted.
    • If electricity is provided, vendors must use outdoor-rated extension cords and ensure cords are secured to prevent tripping hazards.


    FIRE & SAFETY REQUIREMENTS

    • Vendors cooking with oil must have a K-rated fire extinguisher at their booth.
    • Vendors cooking with charcoal must have an ABC-rated fire extinguisher readily available.
    • Open flames, propane, and electrical cooking equipment must be used safely and in compliance with fire codes.
    • Combustible materials must be removed from all cooking areas, and fire safety precautions must be followed at all times.
    • Electrical hookups may be available at the established fee upon request but are not guaranteed. Vendors using generators must ensure they are quiet and safely positioned.


    PROHIBITED SUBSTANCES & RESTRICTED USE AREAS

    • The use, possession, or consumption of marijuana or any cannabis-related products is strictly prohibited within Fonda Park, regardless of state licensing, medical approval, or recreational status.
    • Tobacco use and vaping are only permitted in designated areas approved by the Village of Fonda.
    • Alcohol consumption is only allowed in approved locations and must comply with local and state liquor laws. Vendors or individuals serving alcohol must have the proper permits and follow all event regulations.

     

    VENDOR CONDUCT & COMPLIANCE

    • Vendors must professionally conduct themselves at all times.
    • Offensive, disruptive, or unsafe behavior will not be tolerated and may result in immediate removal.
    • If a vendor cannot attend, they must provide advance notification before the event.
    • The Village of Fonda reserves the right to deny participation or remove vendors who fail to comply with these regulations.
    • Vendors may not use amplified sound without prior approval.
    • Any raffles, giveaways, or promotions must comply with local and state laws and be pre approved by event organizers.


    REFUND & CANCELLATION POLICY

    • If the Village of Fonda cancels the event for any reason (e.g., severe weather, emergencies, low participation), vendors will be notified as soon as possible.
    • Vendors who cancel their participation must provide at least [X] days’ notice to be eligible for a refund (if applicable).
    • No refunds will be issued for no-shows or vendors who fail to comply with event rules.
    • Refunds will only be for actual amount minus the processing fee.


    WEATHER & LIABILITY

    • Events are rain or shine unless otherwise notified.
    • Vendors participate at their own risk. The Village of Fonda is not responsible for loss, theft, damage, or injury before, during, or after the event.
    • Vendors must provide any necessary insurance coverage as required by the Village of Fonda, including liability insurance and proof of coverage upon request. The Village of Fonda must be named as an additional insured on all required insurance policies.

     

    COMPLIANCE WITH LAWS & PARK POLICIES

    • Vendors must comply with all federal, state, and local laws and Village of Fonda and Fonda Park policies, including the Facility Usage Policies.
    • Vendors are responsible for obtaining sales tax permits (if applicable) and remitting required taxes.
    • Food vendors must follow health and safety guidelines outlined by the New York State Department of Health.

     

    ADA COMPLIANCE & ACCESSIBILITY

    • Vendors who use a trailer, building structure, or fixed setup that requires customer entry must ensure reasonable accessibility.
    • Vendors operating out of tents or standard booths are not required to have ramps or modified access, but they should arrange their space to allow customers with disabilities to engage with their services.
    • Vendor equipment, signage, or merchandise must not obstruct walkways, ramps, and designated ADA-accessible areas.

     

    PRODUCT & SERVICE RESTRICTIONS
    • The Village of Fonda reserves the right to prohibit the sale or promotion of certain items, including but not limited to:

       o Weapons, ammunition, or firearms
       o Explosives, fireworks, or hazardous materials
       o Illicit drugs, paraphernalia, or adult-only content
       o Items or services that violate state or federal laws

    • Vendors selling handmade or food products must accurately label all ingredients and allergens for consumer safety.


    Vendors who submit applications and participate in an event at Fonda Park agree to abide by these rules and regulations. The Village of Fonda reserves the right to modify these rules as necessary.
