BOOKING CONTRACT / TERMS & CONDITIONS
PRIOR TO SCHEDULING YOUR EVENT: Please contact Demetria (DJ Meech!e) via email (meechiethedj@gmail.com) to inquire and ensure all expectations can be met for events.
BOOKING POLICY:
At the time of booking, a non-refundable retainer for 50% of the total amount due is required to hold your date and time. Your non-refundable retainer can be made in the form of cash or card. Appointments made without a retainer will NOT be honored and are subject to cancellation. Payment of the non-refundable retainer acts as an agreement to all of DJ Meech!e's (Demetria Jennings) policies.
PAYMENT POLICY & TERMS:
All events must be paid in full prior to the event date or no later than 2 hours after the conclusion of the event via cash or card. Checks are not accepted.
Late Payments & Fees
Any payment not received within 1 calendar day of the due date will be considered late. A late fee of $50 per day will be added until the balance is paid in full.
Breach of Contract & Acceleration
Failure to submit payment by the agreed date constitutes a breach of contract. If payment remains unpaid after 10 calendar days, the full remaining balance becomes immediately due and payable, and DJ Meech!e (Demetria Jennings) reserves the right to pursue legal action for the full balance owed, including all applicable fees and damages allowed by law.
DJ Meech!e (Demetria Jennings) reserves the right to withhold services and refuse to perform if full payment has not been received by the scheduled performance time, without being considered in breach of this agreement.
Cancellation & Client Responsibility
If the event is cancelled, the non-refundable retainer will act as a cancellation fee. Cancellations made more than 7 days prior to the event may be eligible to transfer the retainer one (1) time to a future date, at DJ’s sole discretion. Cancellations made within 7 days of the event remain fully chargeable at 100% of the agreed performance fee.
Attorney Fees & Collections
In the event that legal action or collections become necessary, Client agrees to be responsible for all reasonable attorney fees, court costs, and collection expenses incurred by DJ Meech!e (Demetria Jennings).
Governing Law & Venue
This agreement shall be governed by the laws of the State of North Carolina, and any legal action shall be filed in North Carolina.
Small Claims Enforcement
DJ Meech!e (Demetria Jennings) reserves the right to pursue any unpaid balances through Small Claims Court when applicable.
Client agrees not to initiate any chargeback or payment dispute after services have been rendered. Any chargeback will be considered a breach of contract and will result in legal action. Client remains fully responsible for the unpaid balance during any chargeback investigation.
Client is responsible for ensuring that all payment methods are valid and capable of processing the full balance due.
If performance is interrupted or stopped due to circumstances beyond DJ’s control (including venue shutdown, client misconduct, crowd interference, or law enforcement action), Client remains responsible for full payment.
DJ shall not be held liable for any damages, losses, or claims arising from refusal to perform due to nonpayment.
DJ is an independent contractor and not an employee of the Client or venue.
Client is responsible for any damage to DJ equipment caused by guests, staff, or venue conditions.
All payments are non-refundable once services have been rendered, regardless of client dissatisfaction, crowd response, or event outcome.
DJ does not guarantee the performance of any specific song requests and retains full creative control over music selection based on crowd response and event flow.
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
CANCELLATION POLICY:
This cancellation policy is subject to and governed by the cancellation terms outlined in the Payment Policy above.
If the event is cancelled, all non-refundable retainers will act as a cancellation fee. The DJ reserves the right to deny service to any client(s) who repeatedly have a history of cancellations. If DJ Meech!e cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the DJ's illness or emergency, then the DJ shall return the retainer fee to the client but shall have no further liability with respect to the contract. In the event DJ Meech!e fails for any other reason, DJ Meech!e (Demetria Jennings) shall not be liable for any amount in excess of all monies paid.
Consultations are HIGHLY ENCOURAGED AND REQUIRED if Questionnaire forms are NOT completed before events to ensure all expectations can be met. Client authorizes DJ Meech!e (Demetria Jennings) to charge the card on file for the no-show fee (50% of the total service cost) in the event of failure to complete required consultations or questionnaires.
** Payment of the non-refundable retainer and signature constitutes agreement to DJ Meech!e’s (Demetria Jennings) policies and procedures. **
