3. You must be either resident in the UK or hold a valid UK passport.

4. "Y Llais" is a Welsh language programme for S4C and you will be required to sing and perform songs in Welsh.

5. You must not be an employee or a member of the close family (child, parent, sibling or grandparent) or living in the same household as an employee of S4C, Boom, ITV or any other person or company directly connected with the Programme.

I have read, understand and agree to the Entry Terms and Conditions.

Y LLAIS (ENTRY TERMS AND CONDITIONS)

Boom Cymru TV Cyf of Gloworks, Ffordd Porth Teigr, Cardiff, CF10 4GA (“we”, “us”, “our”) are the producers of “Y Llais” (the “Programme”) based on the format “The Voice”.

By completing and submitting an entry form for the Programme (the “Entry Form”) you agree to these terms and conditions (the “Terms and Conditions”) and agree and acknowledge that these Terms and Conditions form part of your entry.

GENERAL

Only applicants who are eligible will be able to take part in the Programme.

Due to the large number of entries, unfortunately we can’t acknowledge or respond to every Entry Form submitted but only those who we wish to put forward to the next stage of the selection process. We will select the applicants for the next stage at our sole discretion.

Please note that receiving a phone call and/or any other correspondence from a member of the Programme production team and/or attending any recording days does not automatically mean that you will be appearing on the Programme.

If you are chosen by the Programme production team to move to the next stage of selection, we will contact you by telephone on the number you provided in the Entry Form. Moving to the next stage of selection does not guarantee that you will be selected to ultimately take part in the Programme.

YOUR OBLIGATIONS

We may require you to film certain materials including interviews or recordings at your home and with your family or friends and you agree to make every effort to facilitate these recordings.

We may require you to sing and/or perform a different version of your preferred songs (e.g. a longer/shorter version) and/or to sing and/or perform songs selected by us as part of the Programme. We may require that you sing a Welsh translation of any song selected which was not originally composed in Welsh.

Proof of age will be required. We may in our absolute discretion withdraw you from the selection of the Programme if we suspect or find that your age verification documents are not genuine.

You confirm that:

a) the content of your Entry Form is true in all respects;

b) if required by us, you will provide us with evidence to confirm any information provided in your Entry Form including your compliance with the Eligibility Criteria;

c) you understand the nature and purpose of the Programme (which includes finding a winner for the Programme);

d) you understand that the prize for the winner is an opportunity to record an especially composed song by an acclaimed composer.

e) to the extent your Entry Form submission remains in contention for inclusion in the Programme, you will advise us of any information which might compromise or call into question the integrity of the Programme and/or which might impact our reputation or the reputation of S4C;

f) nothing in your Entry Form will infringe any copyright (save music clearances) or any other right of any person, breach any contract or duty of confidence, constitute a contempt of court, be defamatory, and/or otherwise bring us, the Programme or any other party into disrepute; and

g) you will comply with all other relevant laws in connection with the submission of your Entry Form.

If you are formally selected to appear on the Programme, you agree to sign a contribution agreement with us (the “Contribution Agreement”) which will contain without limitation the terms and conditions of your participation in the Programme. If you choose not to or fail to sign the Contribution Agreement before a date reasonably specified by us, we may in our absolute discretion withdraw you from participating in the Programme.

If relevant, you agree to provide us with full details of the following which could restrict in any way your ability to participate in the Programme or otherwise obligate you to make payments to any third party:

a) any recording contract or music publishing agreements which you have previously had (the “Previous Artist Agreements”); and/or

b) any other agreement, including without limitation, any other recording contracts or music publishing agreements (whether written or oral and current or otherwise) with any third party (“Commercial Agreement(s)”)

Should you fail to inform us of any such Previous Artist Agreements and/or Commercial Agreements, we shall be entitled in our absolute discretion to withdraw you from participating in the Programme at any stage.

You agree to seek our written approval before entering into any new Commercial Agreement which you may be offered during your continued participation in the Programme. You agree and acknowledge that if you enter into a new Commercial Agreement between the date of your Entry Form and your continued involvement in the Programme without first seeking our prior written approval we shall have the right to withdraw you from the Programme and/or replace you with an alternative participant.

ANY VIDEOS OR OTHER MATERIALS WHICH YOU SUBMIT WITH YOUR ENTRY FORM

When submitting videos and/or any other materials with your Entry Form (the “Materials”):

a) you confirm that you have the rights and permissions to submit the Materials as part of your Entry Form; and

b) if you are selected for the Programme you give us permission to use your performance and any original material created by you within the Materials as part of the Programme without any further fees or payments becoming due to you or any other person or company apart from music clearances.

CONFIDENTIALITY

Unless otherwise agreed by us in writing, you shall keep any information, or other material relating to your Entry Form confidential and shall not disclose it to any third party. The same applies to any information, photographs or other material we give to you and tell you to keep confidential.

MISCELLANEOUS

We may amend, change or revise the Terms and Conditions at any time in our absolute discretion.

We shall be entitled to assign these Terms and Conditions and these Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, the parties herein hereby submit to the exclusive jurisdiction of the courts of England and Wales.

DATA PROTECTION

Any personal information provided in the Entry Form will be collected and processed in accordance with our privacy notice along with S4C’s Privacy Policy.
