Pilates Virtual Session Agreement & Terms
This Agreement is entered into between Valerie Isham ("Instructor") and the undersigned client ("Client") for participation in virtual Pilates sessions.
Scope of Services
-Live Pilates instruction conducted via video chat.
-Sessions are personalized to support functional movement, mobility, strength, and wellness goals.
-Instruction is for general wellness purposes and is not a substitute for professional medical advice, diagnosis, or treatment.
Client Responsibilities
-Full disclosure of any injuries, conditions, or limitations prior to sessions.
-Participation with care and awareness of their own body.
-Client is solely responsible for creating a safe, distraction-free space to practice.
-Always consult a qualified healthcare provider before beginning any new exercise program.
Scheduling & Attendance
-Sessions are scheduled by the client.
-Client must cancel or reschedule at least 24 hours in advance to avoid forfeiture.
-No refunds, credits, or rescheduling will be granted for no-shows or late arrivals.Sessions begin promptly at the scheduled time.
Payment & Refund Policy
-Payment is due at the time of booking.
-All sales are final. No refunds.
Technology Disclaimer
-Client is responsible for ensuring a reliable internet connection and functional video/audio setup.
-Instructor is not liable for disruptions caused by technical issues on the client’s side.
Liability Disclaimer
-Participation is voluntary and at the client's own risk.
-The instructor is not liable for injury or conditions resulting from participation.
-Full disclosure of physical conditions is crucial for the safety and effectiveness of the session.
-Instructor does not diagnose or treat any medical conditions.
-No guarantee of outcome. Progress depends on individual factors such as consistency, effort, health status.
Privacy & Recording Policy
-Instructor will not record sessions.
-No client information will be disclosed to third parties.
-Billing is managed through a secure third-party platform.
Intellectual Property
-All instructional content, including verbal cues and movement sequences, is the intellectual property of the Instructor.
-Client agrees not to reproduce, share, or distribute any part of the sessions without prior written consent.
Termination of Services
-Instructor reserves the right to refuse or terminate services for inappropriate behavior or breach of terms.
Legal Jurisdiction
This Agreement is governed by the laws of the State of Washington.
Pilates Privacy Policy
Your privacy is important to me. This Privacy Policy explains how your personal information is collected, used, and protected during your engagement in Pilates sessions provided by Valerie Isham.
Information Collected
The only personal information collected may include:
-Contact information (name, email) for scheduling and communication
-Health or physical condition disclosures voluntarily provided to tailor sessions to your needs
Use of Information
-Your information is used solely for the purpose of providing safe and personalized Pilates instruction.
-No client information is ever sold, shared, or disclosed to third parties under any circumstances.
Session Privacy
-Sessions are not recorded or stored in any format.
-All live video sessions are conducted in real-time and are private between you and the instructor.
Billing & Payment
-Payments are handled securely via third-party platforms (e.g., Stripe, PayPal, etc.).
I do not have access to or store any of your financial or payment information.
Data Protection
-Any personal health or communication details shared directly with me are kept confidential and handled with care.
-Only the instructor has access to information shared for instructional purposes.
Deletion of Information
-Upon termination of services, any private notes or information will be securely deleted.
Pilates Liability Waiver
By signing this waiver, you acknowledge and agree to the following terms in connection with participating in Pilates sessions provided by Valerie Isham:
Assumption of Risk
You understand that participation in Pilates sessions involves physical activity and carries inherent risks of injury or complications. You voluntarily choose to participate and assume full responsibility for any risks, injuries, or damages—known or unknown—that may arise.
Health Disclosure
You affirm that you have disclosed all relevant health conditions, injuries, or physical limitations to the instructor. You agree to inform the instructor of any changes to your health before continuing participation in future sessions.
Not Medical Advice
You understand that the instructor is not a licensed medical professional and does not provide medical advice, diagnosis, or treatment. Pilates sessions are not a substitute for professional medical guidance.
Release of Liability
To the fullest extent permitted by law, you hereby release, waive, and discharge [Instructor Name] from any and all liability, claims, demands, or causes of action related to injuries or health conditions sustained during or following participation in Pilates sessions.
No Guarantee of Results
You understand that outcomes may vary and no specific results are guaranteed. Your progress depends on a range of factors including consistency, personal effort, and individual health status.
Technology Risks (for virtual sessions)
You acknowledge that virtual sessions may be affected by technical difficulties. You accept these risks and agree to use a safe and clear space during your participation in online Pilates sessions.
Legal Jurisdiction
This waiver is governed by the laws of the State of Washington. Any legal disputes shall be resolved in the appropriate courts within this jurisdiction.
