Release of Liability In return for being allowed to participate in volunteer activities, the Volunteer (or Parent/Legal Guardian of Volunteer if Volunteer is under age 18) (hereafter referred to using “I”, “me” or “my”) agrees to the following terms: Release of Liability: I understand and agree that volunteer activities with Swan Food Pantry involve certain foreseen and unforeseen hazards and risks. I am voluntarily participating in the volunteer activities with knowledge of the danger involved and I agree to accept all risks of participation. I understand and agree that Swan Food Pantry is not responsible for any injury, personal illness or property damage arising out of the volunteer activities. I agree to indemnify and hold harmless Swan Food Pantry for all claims arising out of my participation in volunteer activities, including any claims based on negligence. I agree to release, waive, discharge, not to sue or assert any claim against Swan Food Pantry or its officers, agents, employees, or affiliates from any and all liability, claims, demands, actions and causes of action of any kind or nature, damages, judgments and expenses, including attorneys’ fees and costs, that arise out of or are in any way related to any loss, damage, illness or injury that I or my property may sustain in connection with participation in volunteer activities wherever, whenever, or however the same may occur. I give consent and authority to Swan Food Pantry to obtain medical treatment in the event I am injured or become ill during volunteer activities. I understand that I am responsible for all costs related to such medical treatment. Photographic Release: I understand and agree that I may be photographed or videotaped during volunteer activities for internal and/or promotional use. I hereby grant and convey to Swan Food Pantry and its successors or affiliates all right, title and interest, including but not limited to, any royalties, proceeds or other benefits, in any and all such photographs or video recordings, and I consent to the use of my name, image, likeness and voice in perpetuity, in any medium or format, for any publicity without notice, compensation or further permission. I do hereby grant to Swan Food Pantry or its officers, agents, employees, or affiliates the absolute right and permission to copyright and use, re-use, publish, and re-publish photographic portraits or pictures of me or in which I may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations from time to time, in conjunction with my own or a fictitious name, or reproductions in color or otherwise, made through any medium, and in any and all media now known or later becoming available, for art, advertising, trade, or any other purpose whatsoever. I also consent to the use of any printed matter in conjunction therewith. I waives any right to inspect or approve the finished product or products or the advertising copy or printed matter that may be used or the use to which it may be applied. I release, discharge, and agree to hold harmless Swan Food Pantry from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of a picture or in any subsequent processing, as well as any publication, including without limitation any claims for libel or invasion of privacy. I understand that this document is intended to be as broad and inclusive as permitted by the laws of the State of Texas and agree that if any portion of this agreement is invalid, the remainder will continue in full legal force and effect. BY CLICKING AGREE AND SUBMIT, I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND ALL OF THE TERMS OF THIS RELEASE AND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
