WHEELS UP LLC – 2025 WAIVER & RELEASE OF LIABILITY
Valid January 1, 2025 – December 31, 2025
PLEASE READ CAREFULLY – BY SIGNING, YOU WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
This Release of Liability, Waiver of Claims, Assumption of Risk, and Indemnity Agreement (“Release”) applies to all events, programs, and activities offered by Wheels Up LLC in 2025.
DEFINITION OF ACTIVITIES
"Mountain Biking" includes, but is not limited to: bike riding, clinics, camps, rentals, instruction, guided rides, races, travel, lodging, and any associated use of equipment, trails, and facilities provided or organized by Wheels Up LLC (“the Releasees”).
ACKNOWLEDGEMENT OF RISK
I understand that mountain biking involves significant risks, including but not limited to: terrain hazards, weather, collisions, mechanical failure, wildlife, and the actions or negligence of others. I am voluntarily participating with full awareness of these risks and accept full responsibility for any injury, damage, or loss that may occur.
RELEASE OF LIABILITY & WAIVER OF CLAIMS
I hereby waive, release, and forever discharge Wheels Up LLC, its officers, directors, employees, volunteers, contractors, and partners from any and all liability for any personal injury, death, property damage, or loss arising from my (or my child’s) participation, regardless of cause, including negligence.
I agree to indemnify and hold harmless the Releasees from any claims made by others arising from my (or my child’s) participation.
This Release is binding on myself, my child, and our heirs, executors, and assigns.
FITNESS TO PARTICIPATE
I (or my child) am in good physical and mental condition and have adequate insurance coverage. I accept responsibility for all medical or emergency expenses incurred during participation.
PHOTO & VIDEO RELEASE
I grant permission to Wheels Up LLC to use my or my child’s image, likeness, and voice in photographs, videos, and promotional materials without compensation. I waive any rights to privacy or claims related to such use.
REFUND & CANCELLATION POLICY
No refunds will be issued due to injury before the session. Riders injured during the first half session may transfer registration to a future session, subject to availability and any applicable fees. Cases will be evaluated fairly by the Wheels Up.
Cancellations made within 72 hours of an event are eligible for the following options:
A 35% refund of the registration fee, or
A credit toward a future Wheels Up event, valid for use through the following calendar year at any local or sanctioned event.
If the credit is not used within the following year, the registration fee will be forfeited. Wheels Up is committed to fairness and will work with each rider on a case-by-case basis for special circumstances.
