  • This Agreement pertains to OWNER’S horse or mule more specifically described below:

    This agreement is intended to operate on a month-to-month basis. Either party may terminate this agreement with thirty (30) days’ written notice. However, if the Owner elects to remove the horse or mule prior to the completion of a paid training month, no refund or proration will be given for that month.

    Owners who intend to keep their horse or mule in training for only one (1) month are not required to provide thirty (30) days’ advance notice, provided the horse or mule is removed on or before the final day of the paid training month.

    Trainer agrees to accept Owner’s horse or mule for training, and Owner agrees to place said horse or mule in training under the following Terms and Conditions:

    Liability and Insurance:

    Owner agrees that NonPareil Ranch and Trading Company LLC, its owners: Jack and Sarah Smith, employees, and agents, shall not be held liable for the death, sickness, theft, or injury (including consequential damages) to the horse or mule while in training. In addition, Owner agrees to hold Trainer completely harmless and not liable for any injury or damage caused to the horse or mule, Owner, or any related parties.

    Owner acknowledges that equine activities involve inherent risks, including but not limited to the unpredictable behavior of horses and mules, and assumes all such risks.

    It is the sole responsibility of the Owner to maintain full liability and mortality insurance coverage for his/her horse or mule, personal person, and personal property during the period the animal is in training.

    Vaccination Requirements:
    Owner shall provide proof of current vaccinations for tetanus, influenza, West Nile, and sleeping sickness prior to the horse or mule being admitted into training.

    Trainer reserves the right to refuse entry or continue services for any horse or mule lacking proper vaccination documentation.

    Thereafter, the Owner shall be responsible for the cost of updating and maintaining all required vaccinations during the animal’s stay at the ranch.


    Veterinary Care and Emergency Authorization:

    NonPareil Ranch and Trading Company LLC will make every reasonable effort to notify the Owner promptly in the event of illness, injury, or emergency. However, if the Owner cannot be reached in a timely manner, the Trainer is authorized to act in the best interest of the animal and obtain veterinary care as deemed necessary.

    Owner hereby grants full authorization for emergency medical treatment in such circumstances.

    The Trainer will use a veterinarian of his choosing unless the Owner has specifically requested in writing that a preferred veterinarian be used. If that veterinarian is unavailable, the Trainer reserves the right to engage a veterinarian of his choice to ensure timely care.

    All veterinary costs shall be the sole responsibility of the Owner.


    Additional Expenses:

    In addition to the monthly training and boarding fee, the Owner is responsible for all other expenses incurred on behalf of the horse or mule, including but not limited to:

    • Farrier services
    • Dental care
    • Deworming
    • Supplements
    • Blankets and sheets
    • Medical supplies
    • Any other necessary services or equipment

    All veterinary, farrier, and other out-of-pocket costs paid by Trainer on behalf of Owner will be billed on the next scheduled invoice following the date the expense is incurred.


    Training Disclaimer:

    Trainer agrees to make every reasonable effort to train the horse or mule to achieve its full potential. However, no guarantees, warranties, or representations are expressed or implied regarding the results of training.

    Each animal responds individually to training methods, and outcomes may vary. Owner acknowledges that progress depends on numerous factors including temperament, prior handling, physical condition, and consistency of follow-through once the animal leaves training.

    Payment Terms:

    Payment for training and boarding services is due in advance.

    The monthly fee is $1,250.00 per horse or mule. Payment is due on the initial drop-off date and on the same calendar day of each subsequent month.

    For example, if the animal is dropped off on the 5th, payment will be due on the 5th of each following month.

    If payment is not received within ten (10) days of the due date, a late fee of $5.00 per day will begin accruing on the 11th day.

    No horse or mule may be removed from the premises until all outstanding balances are paid in full.

    If payment remains unpaid for sixty (60) days past due, Trainer reserves the right to exercise all rights available under California law, including but not limited to stableman’s or agister’s lien rights, and may pursue legal remedies to recover unpaid amounts.

    Owner shall remain responsible for all costs associated with collection, including reasonable attorney’s fees where permitted by law.

  • Entire Agreement:
    This contract is non-transferable and represents the entire agreement between the parties. No verbal agreements or promises, expressed or implied, are included unless specifically stated in writing.

    This contract is entered into in the State of California and shall be interpreted in accordance with the laws of most states. Upon signature by the Owner, this agreement shall become binding on both parties.
