Liability Waiver and Release Agreement
By signing this agreement, I acknowledge and agree to the following terms and conditions for participating in the honey bee hive tour and/or class hosted by Bee EZ Apiary at Artesian Lake Estates Park:
1. Assumption of Risk:
I understand that participating in the honey bee hive tour and/or class involves inherent risks, including but not limited to, honey bee stings, allergic reactions, heat-related illnesses (such as heat stroke), physical exertion, and other potential hazards associated with outdoor activities and interacting with live honey bees.
2. Release of Liability:
I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and discharge Bee EZ Apiary, its owners, employees, agents, volunteers, and representatives, as well as the property owners of Artesian Lake Estates Park, from any and all claims, demands, actions, causes of action, and liabilities of any kind arising out of or related to any loss, damage, injury, or death that may be sustained by me while participating in the honey bee hive tour and/or class, whether caused by the negligence of the released parties or otherwise.
3. Indemnification:
I agree to indemnify and hold harmless Bee EZ Apiary and Artesian Lake Estates and Artesian Lake Estates Park from any and all claims, demands, actions, causes of action, liabilities, costs, and expenses, including attorneys' fees, arising out of or related to my participation in the honey bee hive tour.
4. Medical Treatment:
I consent to receive any necessary medical treatment in the event of injury, accident, and/or illness during the honey bee hive tour. I understand that I am responsible for all costs and expenses related to such medical treatment.
5. Acknowledgment of Understanding:
I have read this liability waiver and release agreement, and fully understand its terms. I acknowledge that I am signing this agreement freely and voluntarily, and intend by my signature to grant a complete and unconditional release of all liability to the greatest extent allowed by law.
6. Private Park Notice:
I understand that the honey bee hive tours and classes are held at Artesian Lake Estates Park, a private park. This park is to be utilized solely for these tours and classes at predesignated hours under the supervision and guidance of a beekeeper from Bee EZ Apiary. Access to the park for any other purpose or without authorized supervision is strictly prohibited.
