Waiver and Release of Liability:
In consideration of being allowed to participate in any way in the Off Balanced Run Club events, the undersigned acknowledges, appreciates, and agrees that:
1. Assumption of Risk: I understand that participating in running events involves risks of injury, including but not limited to, falls, contact with other participants, the effects of the weather, traffic, and conditions of the road/trail. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the released parties or others, and I assume full responsibility for my participation.
2. Release and Waiver: I, for myself and anyone entitled to act on my behalf, hereby release, indemnify, and hold harmless Off Balanced Run Club, its officers, directors, employees, agents, representatives, and sponsors, from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or death I may suffer, or loss or damage to property, whether arising from the negligence of the released parties or otherwise, to the fullest extent permitted by laws of the State of Florida. This release includes claims that may arise from the negligence of the Released Parties, to the fullest extent permitted by law.
3. Medical Treatment: I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during this activity. I understand that I am solely responsible for any medical expenses incurred as a result of my participation in club activities.
4. Compliance with Rules: I agree to abide by the rules of the event and the instructions of the event organizers.
Media Consent:
1. Grant of Rights: I hereby grant Off Balanced Run Club permission to record, photograph, and use any form of media containing my image, voice, or likeness from the Off Balanced Run Club events.
2. Usage: I understand that these recordings and photographs may be used for promotional, advertising, and educational purposes in any and all media, including but not limited to social media, websites, and print materials, without compensation to me.
3. Release: I release Off Balanced Run Club from any liability or claims that may arise out of or in connection with the use of my image, voice, or likeness, including any claims of defamation, invasion of privacy, or infringement of moral rights or rights of publicity.
Acknowledgment of Understanding:
I have read this waiver and release of liability and media consent form, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
