GIG WORKER CONTRACT AGREEMENT
This Gig Worker Contract Agreement ("Agreement") is entered into between GroceryList Jamaica ("the Company") and the undersigned individual ("Gig Worker"), collectively "the Parties". This Agreement outlines the terms and conditions under which the Gig Worker will perform services for the Company.
1.0 ENGAGEMENT
1.1 This Agreement does not create an employer-employee relationship, partnership, agency, or joint venture. The Gig Worker operates as an independent contractor and agrees that they are not entitled to receive any employment benefits, including but not limited to National Insurance Scheme (NIS) contributions, paid leave, redundancy benefits, or any other benefits afforded to employees under the Jamaican Labour Laws. The Company does not guarantee any minimum number of engagements. The Gig Worker is free to accept or decline assignments based on their own schedule, and the Company shall exercise no control over how the work is executed, other than expected results and quality standards.
2.0 SCOPE OF WORK
2.1 The Gig Worker may perform any of the following roles:
* In-Store Shopper: Shops only - USD $10 per order
* Delivery Driver: Delivers only - USD $12 per order
* Full-Service Shopper: Shops and delivers - USD $17 per order
2.2 Tasks are accepted voluntarily, and the Company retains no obligation to offer a specific number of tasks.
3.0 LEGAL AND OPERATIONAL REQUIREMENTS FOR ELIGIBILITY
3.1 To qualify as a Gig Worker, the following must be met:
* Must be 18 years or older.
* Must provide a valid form of identification (Passport, TRN, or National ID).
* Hold a valid Jamaican driver’s license. (For Delivery Drivers and Full-service Shoppers ONLY)
* Must have reliable transportation in roadworthy condition with valid motor vehicle insurance. (For Delivery Drivers and Full-service Shoppers ONLY)
* Confirm that their insurance policy covers commercial or delivery work, as required. (For Delivery Drivers and Full-service Shoppers ONLY)
* Must be able to pass a background check if requested.
* Must have an active bank account for payments.
3.2 Failure to maintain documentation (e.g. insurance) may result in suspension or termination.
4.0 INSURANCE AND LIABILITY
4.1 The Company does not provide any health, personal accident, disability, vehicle, or life insurance to Gig Workers.
4.2 Gig Workers are solely responsible for obtaining and maintaining adequate coverage and furnish proof of insurance if requested. This includes but is not limited to:
* Personal health and accident insurance.
* Commercial motor vehicle insurance (where applicable).
* Public liability coverage.
4.3 The Company will not provide benefits, insurance, or paid time off.
4.4 The Gig Worker is responsible for all insurance and necessary permits.
4.5 The Gig Worker acknowledges that any work carried out under this Agreement is done at their own risk and expense.
4.6 The Company shall not be liable for any personal injury, property damage, or loss incurred during the execution of services.
5.0 COMPENSATION & PAYMENT TERMS
5.1 Payments will be disbursed bi-monthly on the 1st and 15th of each month via the Gig Worker’s selected payment method.
5.2 No deductions for statutory payments or taxes will be made by the Company.
5.3 No entitlement to overtime or Holiday rates.
5.4 Payment disputes must be submitted in writing within three (3) days.
6.0 WAIVER OF CLAIMS AND INDEMNIFICATION
6.1 The Gig Worker hereby agrees to:
* Release and hold harmless the Company, its directors, officers, and agents from any claims, liabilities, damages, or injuries sustained during the course of performing services.
* Indemnify and defend the Company from any third-party claims arising from actions taken while performing services under this Agreement.
6.2 This clause survives termination of the Agreement.
7.0 CONDUCT AND STANDARDS
7.1 The Gig Worker agrees to:
* Conduct services with professionalism and care.
* Communicate promptly with the Company regarding delays, emergencies, or customer complaints.
* Maintain the confidentiality of any sensitive customer information.
7.2 The Company reserves the right to suspend or terminate access to the platform for misconduct, breach of this Agreement, or failure to meet service standards.
8.0 TERMINATION
8.1 This Agreement may be terminated by either party at any time, with or without cause, upon written notice. Any unpaid amounts for completed services will be settled at the next scheduled payout.
8.2 The Company may terminate this Agreement immediately for cause, including but not limited to:
* Failure to perform agreed-upon services.
* Breach of confidentiality obligations.
* Engaging in conduct detrimental to the Company’s reputation or business including but not limited to, misconduct (harassment, intoxication while on duty etc.), fraud, or policy violations.
* Failure to meet the eligibility requirements.
8.3 Termination shall not entitle the Gig Worker to any compensation or damages for loss of future income or opportunities.
9.0 DISPUTE RESOLUTION
9.1 Any disputes arising from this Agreement shall first be addressed through mediation.
9.2 If unresolved, disputes shall be referred to arbitration in accordance with the Arbitration Act of Jamaica.
10.0 CONFIDENTIALITY & DATA PROTECTION
10.1 The Gig Worker agrees to maintain the confidentiality of all proprietary and confidential information obtained in adherence to the Data Protection Act (2020) while providing Services to the Company.
10.2 The Gig Worker shall not disclose or use such information for any purpose other than the performance of this Agreement without prior written consent from the Company.
* The Gig Worker agrees not to disclose customer or business information to third parties.
* The use of the Company’s mobile app, Shopping Card, and customer data is strictly for work-related purposes.
* Breach of confidentiality may result in legal action.
10.3 The Gig worker should ensure secure deletion of sensitive data post-engagement.
11.0 ENTIRE AGREEMENT
11.1 This Agreement constitutes the entire agreement between the Parties and supersedes any prior discussions or representations.
11.2 Amendments must be made in writing and signed by both Parties.
12.0 GOVERNING LAW
12.1 This Agreement shall be governed by and construed in accordance with the laws of Jamaica.
13.0 GENERAL PROVISIONS
13.1 If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13.2 This Agreement is non-exclusive. The Gig Worker may provide services to other companies or clients, provided such activities do not conflict with the obligations herein.
