LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK

Activity: Participation in airsoft activities, including but not limited to simulated combat, target shooting, equipment handling, and being present on the premises of Rapid Fire Airsoft LLC (the “Activity”).

Acknowledgement of Risks:

I understand and acknowledge that participation in the Activity involves inherent risks, dangers, and hazards, which may result in serious injury or death. These risks include, but are not limited to:

Being struck by airsoft projectiles, which can cause eye injury (including blindness), head injury, dental injury, and other bodily harm, even with protective gear.
Tripping, slipping, and falling on uneven terrain or obstacles, resulting in sprains, fractures, or other injuries.
Collisions with other participants or stationary objects.
Equipment malfunction or failure, leading to injury.
Exposure to outdoor elements, including weather conditions, insects, and natural hazards.
Actions or inactions of other participants, which may be negligent or unintentional.
The potential for serious and permanent eye injury, including loss of eyesight, can occur regardless of whether approved airsoft safety goggles are worn in any area where airsoft weapons may be discharged.
Other foreseeable and unforeseeable risks associated with recreational activities.
I confirm that I am voluntarily participating in the Activity with full knowledge and understanding of these risks. I am physically and mentally capable of participating in the Activity.

Waiver and Release of Liability:

In consideration for being permitted to participate in the Activity, I, for myself, my heirs, executors, administrators, assigns, and next of kin, hereby waive, release, and forever discharge Rapid Fire Airsoft LLC, its owners, officers, directors, employees, agents, volunteers, and landowners (collectively, the “Released Parties”), from any and all claims, demands, actions, causes of action, damages, losses, expenses, and liabilities of any kind or nature whatsoever, whether known or unknown, arising out of or in any way connected with my participation in the Activity, including but not limited to injuries, death, or property damage, even if such claims, demands, actions, causes of action, damages, losses, expenses, or liabilities are caused by the negligence (whether sole, joint, or concurrent) or other fault of the Released Parties, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.

Assumption of Risk:

I expressly and voluntarily assume all risks associated with participating in the Activity, whether foreseen or unforeseen, and accept full responsibility for any injury, illness, damage, loss, or expense resulting from my participation.

Indemnification:

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, losses, expenses (including reasonable attorneys' fees and costs), and liabilities of any kind or nature whatsoever arising out of or in any way connected with my participation in the Activity or my breach of this Waiver, Release of Claims, and Assumption of Risk.

Medical Treatment:

I hereby give permission for transportation to any medical facility or hospital and authorize Rapid Fire Airsoft LLC staff and/or any person to render necessary emergency medical care for me. I authorize the release of any medical information necessary for treatment, referral, billing, or insurance purposes.

Governing Law and Venue:

This Waiver, Release of Claims, and Assumption of Risk shall be governed by and construed in accordance with the laws of the State of Iowa. Any legal action or proceeding arising out of or relating to this document or my participation in the Activity shall be brought exclusively in the state or federal courts located in Iowa, and I hereby consent to the jurisdiction of such courts.

Severability:

If any provision of this Waiver, Release of Claims, and Assumption of Risk is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect.

Entire Agreement:

This document constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK, AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A LEGALLY BINDING DOCUMENT THAT RELEASES THE RELEASED PARTIES FROM LIABILITY FOR NEGLIGENCE AND OTHER FAULTS. I AM SIGNING THIS DOCUMENT VOLUNTARILY AND OF MY OWN FREE WILL.
