CLIENT WAIVER, INTAKE & CONSENT FORM

EMS TRAINING PARTICIPATION AGREEMENT

By signing below, I acknowledge and agree to the following: I voluntarily consent to participate in EMS (electrical muscle stimulation) training with Custom Fitness Results LLC.

I understand EMS involves the use of electrical impulses to stimulate muscles and carries inherent risks, including but not limited to: muscle soreness, fatigue, dizziness, or irritation.

I confirm that I do not have any of the following conditions:

Pacemaker or implanted electronic medical device

Metal implants (excluding titanium)

Recent surgery, open wounds, or infections

I agree to immediately inform my trainer of any discomfort or change in health during a session.

| understand and agree to the 24-hour cancellation policy-sessions not canceled at least 24 hours in advance will be charged in full.

| hereby RELEASE, WAIVE, and HOLD HARMLESS Custom Fitness Results LLC (aka SB Custom Fitness), its owners, staff, independent contractors, and partners from any and all claims, liabilities, demands, injuries, losses, or damages related to or arising out of my participation in EMS training, including but not limited to those resulting from negligence. I agree not to reproduce, share, or teach EMS methods, techniques, or systems observed or learned during my training sessions.

Iagree not to reproduce or share any proprietary materials, session structure, training methodologies, or business practices observed or learned during sessions, whether in-person or online. All intellectual property remains the sole property of Custom Fitness Results LLC.

This Agreement is governed by the laws of the State of California.

Any disputes will be resolved in the jurisdiction of Santa Barbara County.

If any provision of this waiver is found unenforceable, the rest remains valid.

This waiver remains in effect for 24 months unless revoked in writing.

All services are payable at the time of booking or in advance. Payments are non-refundable except by mutual agreement or documented extenuating circumstances. Custom Fitness Results LLC accepts various payment methods including credit/debit, Venmo, cash, and online payments.

I consent to the use of photos or videos taken during my training for marketing purposes.

Ido not consent to the use of my image or likeness for marketing.

I have carefully read and understand all the above informationand am fully aware of what I am signing.l acknowledge that this is a release of all liability.
