Acknowledgment of Risk and Waiver of Liability
I, the undersigned participant, understand and acknowledge that participation in martial arts training and related activities involves inherent risks of injury, including, but not limited to, sprains, strains, fractures, contusions, concussions, or more serious injuries. I voluntarily choose to participate in these activities despite these risks and assume full responsibility for my participation.
In consideration of being allowed to participate in any martial arts training, classes, workshops, events, or other activities (hereinafter referred to as "Activities") offered by Hinton Martial Arts Academy (HMAA) hereinafter referred to as "the Club", I hereby agree to the following:
Assumption of Risk: I understand and acknowledge that my participation in the Activities involves physical contact and exertion, which may result in injury, harm, or illness, including, but not limited to, bodily injury, personal injury, property damage, disability, or death. I freely and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Club or others, and assume full responsibility for my participation.
Release of Liability: I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge the Club, its owners, directors, officers, instructors, employees, volunteers, agents, and representatives (hereinafter referred to as "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise.
Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, arising out of, or related to, my involvement in the Activities or my breach of any terms of this agreement.
Medical Treatment: I understand that martial arts training is physically demanding and that I should consult with a physician before beginning any exercise program. In the event of an injury or medical condition, I consent to receive emergency medical treatment as deemed appropriate by the Club. I also agree to assume full responsibility for all medical expenses that may arise from my participation in the Activities.
Fitness to Participate: I certify that I am in good physical condition and have no known medical or other condition that could interfere with my ability to safely participate in the Activities. I will notify the Club in writing of any medical conditions that may affect my participation.
Photographic and Video Release: I grant the Club permission to use my likeness in photographs, videos, or other digital media taken during the Activities for promotional, advertising, or other lawful purposes, without compensation to me.
Compliance with Rules: I agree to comply with all rules, regulations, and instructions of the Club and its instructors while participating in the Activities. I understand that failure to follow these rules may result in my expulsion from the Activities without a refund.
Governing Law and Severability: This agreement shall be governed by the laws of Alberta, and any legal action relating to this waiver shall be commenced exclusively in the courts of Alberta. If any provision of this waiver is found to be unenforceable, the remaining terms shall remain in full force and effect.
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
