1. Assumption of Risk
I, the undersigned, acknowledge that hosting, attending, and participating in birthday parties and private events at WonderPlay & Coffee involves inherent risks, including but not limited to:
• Falls, collisions, and other physical injuries from play structures and equipment
• Equipment malfunction, improper use, or failure to follow safety guidelines
• Food allergies, choking hazards, or other food-related incidents
• Interactions between children and other participants that may lead to injury
• Exposure to illness, including but not limited to communicable diseases such as COVID-19
• Property damage or loss during the event
• Emotional distress or other unforeseen incidents
I voluntarily assume all such risks on behalf of myself, my child(ren), guests, and invitees and agree that participation is entirely at our own risk.
2. Release, Waiver, and Discharge of Liability
In consideration of being permitted to host or participate in a birthday party or private event at WonderPlay & Coffee, I, on behalf of myself, my child(ren), guests, heirs, assigns, and representatives, expressly release, waive, and discharge WonderPlay & Coffee, its owners, employees, agents, landlords, affiliates, and insurers (the “Released Parties”) from any and all claims, demands, suits, actions, liabilities, damages, losses, costs, or expenses, including but not limited to:
• Personal injury, illness, disability, or death
• Property damage, theft, or loss
• Medical or hospital expenses
• Any claims related to negligence, acts of third parties, force majeure events (Acts of God), or any other unforeseen circumstances
This waiver applies to any injury, loss, or damage sustained before, during, or after the event, regardless of whether such injury, loss, or damage results from the negligence of the Released Parties.
3. Indemnification and Hold Harmless Agreement
I agree to indemnify, defend, and hold harmless WonderPlay & Coffee and all Released Parties from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney fees) resulting from:
• My or my guests’ use of the facility, equipment, or services
• Any third-party claims arising from injuries, incidents, or accidents occurring during the event
• Any violation of the terms of this agreement
This indemnification includes claims brought by party guests, parents/guardians, or any other attendees.
4. Parental Supervision & Responsibility
I acknowledge that WonderPlay & Coffee is a play-at-your-own-risk facility, and parental or guardian supervision is required at all times.
• The host (renter) is responsible for ensuring adequate adult supervision of all children attending the event.
• WonderPlay & Coffee does not provide childcare or direct supervision of children beyond enforcing facility rules.
• The host and guests must ensure that children follow all posted rules and safety guidelines; failure to comply may result in removal from the facility without refund.
• The host assumes full responsibility for the behavior, safety, and conduct of all attendees, including any damages to the facility or equipment caused during the event.
5. Medical Authorization
In the event of an accident, injury, or medical emergency involving myself, my child(ren), or any guest during the event, I authorize WonderPlay & Coffee staff to seek and obtain medical care as deemed necessary. I understand that:
• WonderPlay & Coffee staff are not medical professionals and are not responsible for medical decisions or treatment.
• I am solely responsible for any and all medical expenses incurred.
• I release WonderPlay & Coffee from any liability related to medical treatment or emergency care decisions.
6. Food Allergies, Outside Food, & Café Liability
I acknowledge that:
• Food allergies are the responsibility of the host and guests. WonderPlay & Coffee serves food and beverages that may contain common allergens such as nuts, dairy, gluten, soy, and eggs.
• WonderPlay & Coffee does not guarantee an allergen-free environment and is not liable for allergic reactions or food-related illnesses.
• If outside food or cake is brought into the facility, the host assumes full responsibility for its safety, proper handling, and any related health concerns.
7. Facility Use, Decorations, and Clean-Up
The host agrees to the following facility rules for birthday parties and private events:
• Decorations must be pre-approved by WonderPlay & Coffee management. No tape, tacks, nails, or adhesives that may damage surfaces.
• No confetti, glitter, piñatas, or other items that may cause excessive clean-up or damage.
• The host is responsible for removing all personal items at the end of the event.
• The host will be liable for any excessive mess, spills, or damage to the facility, play structures, or equipment. Additional cleaning fees may apply.
• The event must start and end within the reserved rental period; additional time may be charged if the party exceeds the agreed timeframe.
8. Photo & Video Release
I grant WonderPlay & Coffee permission to take photographs and videos of myself, my child(ren), and event attendees for marketing and promotional purposes, including but not limited to social media, websites, and printed materials.
9. Binding Agreement & Legal Enforceability
I understand that this waiver is legally binding and applies to my event, guests, and all future visits to WonderPlay & Coffee, unless revoked in writing.
• If any portion of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• This waiver shall be interpreted as broadly as permitted by applicable law to provide the maximum protection to WonderPlay & Coffee.
