Hold Harmless and Indemnity Agreement
The individual listed on this event registration, by purchase of a 2025 IKC Carnivale wristband, is hereinafter individually and jointly referred to as CARNIVALE PARTICIPANT.
CARNIVALE PARTICIPANT intends to participate in the 2025 IKC Carnivale at their own risk. CARNIVALE PARTICIPANT agrees to hold the Inter-Krewe Council (IKC), harmless against any claim made by CARNIVALE PARTICIPANT, which claim arise, directly or indirectly from CARNIVALE PARTICIPANT’s own carelessness or negligence and to indemnify the IKC and the Holiday Inn Hotel and Suites Clearwater Beach against any and all expenses (including attorney’s fees incurred by its defense of any claim covered by this agreement), witness fees, damages, judgments, fines and amounts paid in settlement and any other amounts that becomes legally obligated to pay because of any claim or claims made against it on account of or because of any carelessness or negligence on CARNIVALE PARTICIPANT’s part.
CARNIVALE PARTICIPANT is fully and personally responsible for CARNIVALE PARTICIPANT’s own safety and actions while and during any participation and CARNIVALE PARTICIPANT recognizes that CARNIVALE PARTICIPANT may be in any case be at risk of contracting COVID-19.
With full knowledge of the risks involved, CARNIVALE PARTICIPANT hereby releases, waives, and discharges the Organization, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by CARNIVALE PARTICIPANT related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.
This agreement shall remain in full force and effect for five years following the date of execution hereof. This agreement may be introduced into evidence at the trial of any claim which I file, or which may be filed on my behalf, said claim having arisen directly or indirectly from my participation in the aforesaid event.
CARNIVALE PARTICIPANT agrees and understands that all electronic signatures are the legal equivalent of CARNIVALE PARTICIPANT’s manual/handwritten signature and consents to be legally bound to this agreement.
By signing the 2025 IKC Carnivale registration form, CARNIVALE PARTICIPANT acknowledges that they have read the foregoing Liability Release Waiver and understand its contents and is fully competent to give their consent. CARNIVALE PARTICIPANT also agrees that they have been sufficiently informed of the risks involved and gives their voluntary consent in signing it as their own free act and deed with full intention to be bound by the same, and free from any inducement or representation.
Agreement of Terms
IKC Carnivale is a rain or shine event with No Refunds. All attendees MUST purchase a ticket to take part in IKC Carnivale'. The IKC Officers and Committee Chairs reserve the right to refuse any potential attendee prior to or during the event.
