    Smart Diehl Academy (“Smart Diehl”) and the client (named below) hereby agree that Smart Diehl will provide educational services to “Client” or “the client.”
  • Fees

    The most accurate and up-to-date pricing information is available at smartdiehl.com, and by submitting this form, the client agrees to pay the rates listed online for the selected program(s).
  • Payment Policies

    The Client agrees to pay for educational services provided by Smart Diehl Academy in accordance with the selected program(s). All payments are due in full before the beginning of each month or semester, as outlined below:
  • Private Pay Clients: Monthly payments are due prior to the first session of each month. If services begin mid-month, a prorated amount is due prior to the first session.

    ESA+ and Opportunity Scholarship Students: To avoid processing delays, full semester payments are required in advance. Parents/guardians are responsible for submitting any necessary reimbursement requests to the funding source.

     Materials Fees and Deposits: Certain programs, including homeschool and enrichment classes, require a materials fee and deposit. Deposits are due at the time of registration. All deposits, class fees, and materials fees are nonrefundable.

    Payment Methods: Payments may be made online or in person. A 3% processing fee applies to all online payments. Payment methods are listed on invoices.

    Invoices are due within five (5) days of the invoice date. Unpaid invoices beyond this period may incur interest at the highest rate allowed by law in North Carolina until the balance, including interest, is paid in full.

    Smart Diehl Academy may amend its prices for educational services with 30 days’ written notice.

  • Cancellation Policy

    If the Client cancels an educational service with less than 24 hours' notice or fails to attend their scheduled service, the Client will be responsible for the full cost of the scheduled service, and no adjustments will be made to previously paid invoices. This policy applies to all services provided by Smart Diehl Academy. In the event that 24-hour notice cannot be given due to sudden illness or emergency, it is the responsibility of the client to promptly reschedule their missed session with the tutor/teacher. No refunds will be issued in these cases. If a Smart Diehl teacher/tutor needs to cancel an educational service and a suitable substitute cannot be arranged, the teacher will promptly notify the client to reschedule the session at the earliest convenience.
  • Late Arrival and Schedule Changes

    Smart Diehl Academy maintains a policy that students arriving late or terminating sessions early will not have their costs adjusted. If a student arrives late or terminates a session early, the full session fee will still apply.If a student arrives more than fifteen (15) minutes after the scheduled start time of a session, Smart Diehl will consider the session canceled without sufficient notice, and the client will be subject to the cancellation policy.In the event of a tutor’s late arrival, any missed time will be made up either at the end of the lesson or at the beginning of the next scheduled session, based on mutual agreement.For students enrolled in Enrichment Classes, Core Program or Private School Path, if a student arrives late to class, Smart Diehl will not make up instructional time or re-teach material missed prior to their arrival. The client understands that any missed work will need to be completed at home.
  • Late Pickup Policy

    Students must be picked up promptly at the conclusion of ALL services. In the event of a late pickup, the following policy applies: First Offense: The client will be subject to a late pickup fee equivalent to the hourly private tutoring rate, set at $55 per hour.
  • Non-Interference With Advantageous Contractual Relationships

    Client acknowledges and agrees that the contracted relationship between Smart Diehl and its teachers/tutors is of significant value. Client understands that interference with this relationship could result in damage to Smart Diehl. As a result, Client agrees to the following:
  • 1. Payments: Client will not make any payment to any teacher/tutor for services provided by Smart Diehl.

    2. Non-Solicitation Agreement: During the term of this Agreement and for a period of two (2) years following its termination, Client will not, for any reason, directly or indirectly solicit, hire, or attempt to hire or engage the services of any teacher/tutor who has provided educational services on behalf of Smart Diehl. Client acknowledges that estimating the actual damages resulting from a breach of this agreement by soliciting, hiring, or attempting to engage the services of any teacher/tutor is difficult. Therefore, in the event of such breach, Client agrees to pay Smart Diehl liquidated damages starting at $5,000, with the possibility of adjustment based on the extent of the breach, which both parties agree is reasonable considering the contractual obligations involved.

    3. Communication with Smart Diehl Only: Client understands that Smart Diehl maintains a contractual relationship with its teachers/tutors. Therefore, any discussions regarding payments for educational services must be conducted solely with Smart Diehl. Client is expressly prohibited from discussing teacher/tutor compensation directly with the teacher/tutor.

    Client acknowledges and agrees to abide by these terms to maintain the integrity of the relationship between Smart Diehl, its teachers/tutors, and the services provided.

  • Obligation of Services

  • Confidentiality: Smart Diehl is committed to keeping your student’s information confidential. We will only contact other parties involved in the student’s education with your consent.

    Continuity of Service: Smart Diehl will not transfer responsibility for tutoring or teaching to another tutor/teacher without your explicit consent.

    Academic Assistance: Smart Diehl is not obligated to complete the student’s homework or assignments. However, our staff is available to assist students with their homework or assignments during sessions.

    Preparedness: Smart Diehl staff will come to each session fully prepared with lessons to effectively tutor/teach your student.

    Provision of Materials: Smart Diehl will provide all necessary materials for tutoring sessions and/or classes unless additional required materials are specified prior.

  • Termination of Services

    Smart Diehl reserves the right to terminate this contract for any reason including but not limited to multiple absences, tardies, and/or disciplinary issues. In this event, Smart Diehl will give the Client seven (7) business days prior notice. No refund will be issued in this case.
  • Smart Diehl Academy Policies and Guidelines

  • Sickness Policy

    At Smart Diehl Academy, the safety and well-being of our students, staff, and visitors are our top priorities. We have implemented the following safety guidelines to ensure a secure and conducive learning environment for everyone:
  • The client agrees not to send their child to any Smart Diehl Academy session or program if the child is sick or exhibiting symptoms of illness, including but not limited to fever, cough, vomiting, diarrhea, or excessive fatigue.

    The student must be symptom-free and fever-free for at least 24 hours without the use of medication before returning to school.

    In the event that 24-hour notice cannot be given due to sudden illness or emergency, it is the client’s responsibility to promptly communicate with the appropriate staff member to reschedule the missed session if applicable.

  • Safety Guidelines

    At Smart Diehl Academy, the safety and well-being of our students, staff, and visitors are our top priorities. We have implemented the following safety guidelines to ensure a secure and conducive learning environment for everyone:
    • Emergency Procedures: Clearly marked emergency exits and evacuation routes.
    • First Aid and Medical Emergencies: Availability of first aid kits and trained staff to provide immediate assistance in case of injuries or medical emergencies. Knowledge of emergency contact information for local medical facilities and emergency services.
    • Safe Environment: Maintenance of a clean and organized learning environment to prevent accidents and injuries.
    • Visitor Policy: The front door remains locked and only staff members open it. Escorting of visitors by authorized staff members while on the premises.
    • Behavioral Expectations: Promotion of respectful and responsible behavior among students, staff, and visitors.
    • Zero-tolerance policy for bullying, harassment, or any form of violence.
    • Communication Protocols: Clear communication channels for reporting safety concerns or incidents to Smart Diehl staff. Regular communication with parents/guardians regarding safety updates and protocols.
    • Training and Education: Ongoing training for staff members on safety procedures and protocols. Education of students on safety practices and emergency procedures.
    • Specialized Safety Measures: Implementation of additional safety measures for specific activities or areas, such as outdoor guidelines are implemented.
    • Continuous Improvement: Regular review and evaluation of safety policies and procedures to identify areas for improvement and ensure compliance with best practices.

    By adhering to these safety guidelines, we create a secure and nurturing environment where students can thrive academically and personally. Thank you for your cooperation in maintaining a safe environment at Smart Diehl Academy.

  • Outdoor Policy

    At Smart Diehl Academy, we prioritize the safety and well-being of our students during outdoor time. As part of our commitment to providing a secure environment for all students. We ask parents to adhere to the following guidelines at both our Mint Hill and Midland locations while recognizing that outdoor activities at our Midland location may involve additional risks, thus making these policies essential.
  • Supervision: Please ensure that your child understands the importance of following instructions and rules set by staff members during outdoor time. We rely on our dedicated staff to supervise students and maintain a safe environment.

     Designated Areas: Encourage your child to play in designated areas and use equipment properly. Remind them to respect boundaries and avoid restricted areas to prevent accidents or injuries.

     Equipment Safety: Reinforce the importance of using equipment safely and responsibly. Encourage your child to report any damaged or broken equipment to a staff member immediately.

     Behavior Expectations: Emphasize the importance of respectful and cooperative behavior during outdoor play. Encourage positive interactions with peers and discourage bullying or aggressive behavior.

     Hydration and Sun Protection: Ensure that your child stays hydrated by providing a water bottle for outdoor play. Additionally, apply sunscreen to protect against sunburn and encourage your child to seek shade when necessary.

     Inclusion and Supervised Play: Support inclusive play by encouraging your child to include others and be mindful of students who may need extra support or supervision. Trust our staff to provide assistance and guidance as needed.

     Emergency Preparedness: Familiarize yourself with our emergency procedures and protocols. Trust that our staff is trained to handle emergencies and will prioritize the safety of all students.

     Weather Considerations: Be aware of weather conditions and ensure that your child is dressed appropriately for outdoors. In case of inclement weather, trust that our staff will make necessary adjustments to ensure the safety of students.

     Cleanliness and Safety: Remind your child to keep the outdoor areas clean and tidy. Encourage them to dispose of trash properly and report any hazards to a staff member.

  • Procedures and Respect for Our Space

    At Smart Diehl Academy, we are committed to becoming a community where we wholly fulfill the academic, social, and creative needs of your child with a well-rounded and enriching education that leads to a genuine love of learning. We strive to maintain a welcoming and conducive learning environment for all parents and students. To ensure harmony and mutual respect, we have established the following procedures:
  • Entering and Exiting the Building:Please enter and exit the building quietly to minimize disruption to ongoing sessions.

    Use of Common Areas:Utilize common areas respectfully, keeping noise levels to a minimum and ensuring cleanliness.

    Respect for Equipment and Facilities:Treat all equipment and facilities with care and respect to ensure their longevity and functionality for everyone's use.

    Personal Belongings:Keep personal belongings organized and confined to designated areas to prevent clutter and maintain a tidy environment. Smart Diehl is not responsible for any lost belongings.

    Communication with Staff:Communicate respectfully with our staff, addressing any concerns or inquiries courteously.

    Follow Safety Guidelines:Adhere to safety guidelines and procedures provided by Smart Diehl Academy to ensure the well-being of all individuals within our premises.

    Attendance and Punctuality:Arrive on time for scheduled sessions and classes, and ensure prompt pickup after sessions to maintain the flow of activities and minimize disruptions.

    Feedback and Suggestions:Feel free to provide feedback and suggestions for improvement, as we value your input in enhancing our learning environment.

    By adhering to these procedures and demonstrating respect for our space, parents and students contribute to a positive and enriching experience for everyone at Smart Diehl Academy. Thank you for your cooperation and commitment to maintaining a harmonious learning environment.

  • Applicable Locations

    The client understands that this contract applies to both the Mint Hill and Midland locations of Smart Diehl Academy. By signing this agreement, you acknowledge and agree that the terms and conditions outlined herein apply to all services provided by Smart Diehl Academy at both locations. This ensures consistency and uniformity in the application of policies and procedures across all facilities operated by Smart Diehl Academy.
  • Consents and Waivers

  • By checking each of the following boxes, I acknowledge that I am providing consent and/or waiving liability as described. These consents and waivers apply to both the Mint Hill and Midland locations of Smart Diehl Academy.

  • Photo and Video Release

    From time to time, Smart Diehl Academy takes photographs and videos of students during various activities, events, and classroom sessions. These photos and videos may be used for promotional purposes, including but not limited to: SDA website, Social media channels, (Facebook, Instagram, etc.), Promotional materials (brochures, flyers, etc.), Newsletters, and/or Educational presentations.
  • Outdoor Activities Information

    I acknowledge that my child will participate in outdoor play activities with Smart Diehl Academy. I understand that outdoor play involves inherent risks, including but not limited to slips, falls, collisions, and exposure to outdoor elements. I hereby waive and release Smart Diehl Academy, its staff, teachers, and affiliates from any and all liability for injuries, accidents, or incidents that may occur during outdoor activities, to the fullest extent permitted by law. I understand that Smart Diehl Academy takes precautions to minimize risks, but I acknowledge that accidents can happen despite these measures. I agree to indemnify and hold harmless Smart Diehl Academy, its staff, teachers, and affiliates from any claims, damages, or expenses arising out of my child's participation in outdoor activities.
  • Activities Liability Information

    I acknowledge that my child may participate in activities including but not limited to physical education, gardening, yoga, arts and crafts, science experiments, or other pursuits (hereinafter referred to as "activities"), at Smart Diehl Academy. I understand that participation in these activities involves inherent risks, including but not limited to physical exertion, use of equipment or tools, exposure to natural elements, and potential contact with allergens or hazardous materials. In consideration of my child being permitted to participate in these activities, I hereby waive, release, and discharge Smart Diehl Academy, its officers, directors, employees, agents, volunteers, and affiliates from any and all liability for injuries, accidents, or incidents that may occur as a result of my child's participation in these activities, to the fullest extent permitted by law. I understand and acknowledge that Smart Diehl Academy takes precautions to minimize risks associated with these activities, but I recognize that accidents can happen despite these measures. I accept full responsibility for any injuries or damages that may occur to my child during their participation in these activities. I agree to indemnify and hold harmless Smart Diehl Academy, its officers, directors, employees, agents, volunteers, and affiliates from any claims, damages, or expenses arising out of my child's participation in these activities.
